FINDINGS OF FACT - SPECIAL USE
1. The Special Use in Flood Plain District, Ordinance Z-160, Section 21.6 as amended does not apply and aU:prerequisites
have been met by Petitioner as verified by: a review of the applicable FEMA Flood Insurance Rate Maps.
2. The Special Use will be consistent with the Character and Permitted Land Use of the zoning district and CarmeVClay
Comprehensive Plan because: the site design: architectural designs and details: and scale of the addition have been
developed in order to complement the existing facility and character of the surrounding area.
3. The Special Use is physically suitable for the land in question because: the expansive site accommodates the building
addition and required additional off-street parking while maintaining open space and landscaped areas. The scale and
architecture complements both the existing facility and is of a style and Quality to complement and enhance the
surrounding area.
4. The Special Use will not injuriously or adversely affect the adjacent land or property values because: adequate off-street
parking and landscaping are provided. The site design and architecture employed in the addition maintain and enhance
the character of the long-time religious use and provide a stable anchor for the community. The Special Use (church)
acts as an appropriate transitional use between Commercial uses planned and zoned along Range Line Road. and
residential planned and zoned to the east of the facility.
5. The Special Use will not adversely affect vehicular or pedestrian traffic flow, nor the adequate availability of water,
sewage, or storm drainage facilities, or police or fire protection because: water. sewage and storm facilities are all
presently available and exist on site. The improvements planned are designed to ensure that these facilities will continue
to function appropriately. Additional off-street parking is being provided not only to replace those lost to the building
addition. but to provide the additional off-street parking required by the addition itself. No new curb-cuts or access
points are being created or requested by this expansion.
6. The Board has reviewed the requirements of Ordinance Z-160, Section 21.3 (1-25) as they relate to this Special Use, and
does not find that those criteria prevent the granting of the Special Use.
DECISION
IT IS THEREFORE the decision of the CarmeVClay Board of Zoning Appeals that Special Use Docket
is granted, subject to any conditions stated in the minutes of this Board, which are incorporated herein by
reference and made a part hereof.
