The real estate is zoned to the R-2/Residence District and the B-3/Business District. Variances of Developmental Standards are required of the following Sections ofthe Zoning Ordinance for Carmel and Clay Township (the "Ordinance"): 1. Section 8.4.1 (R-2/Residence District) - Maximum Height of 42 feet (25 feet maximum permitted); and, 2. Section 27.3.2 (Additional Parking and Loading Regulations) - to allow for a temporary parking lot area to be constructed without curbing (curbing required). A church is classified as a Special Use in both the R-2/Residence and B-3/Business Districts. A Petition requesting Special Use Approval for the proposed remodeling and addition has been filed concurrently with this request. The proposed remodeling and addition represents a 19,617 square foot addition to the existing 53,673 square foot facility (a 26 percent expansion). The remodeling and addition will occur within the portion ofthe real estate zoned to the R-2/Residence District. Reasons Supporting the Variances of Developmental Standards: The addition to the Carmel United Methodist Church is proposed to provide the growing congregation and Carmel community with additional classroom and community meeting space for this community focal point and anchor. In addition, the proposal includes expanded off-street parking to ensure that the parking needs of the existing church and its expansion are met in a design that maintains the character and integrity of the surrounding area. The addition is designed in an architectural style and of a quality which complements the architecture of the existing church and is compatible with the surrounding uses in the area. Building Height - The existing church building is 40 feet tall and features a 76 foot tall spire. The proposed addition, at 42 feet in height, represents a very minor increase in the overall height of the current facility. In addition, the proposed addition is set back more than 150 feet from the nearest property line. Detailed Description of RequQ (page 2) o Off-Street Parking - A temporary off-street parking area is proposed at the south side of the real estate. The temporary parking area is designed to handle the parking needs of the church during the construction process. The use or value of the area adjacent to the subject property will not be substantially affected in any adverse manner because: the addition to the Carmel United Methodist Church will provide the growing congregation and Carmel community with additional classroom and community meeting space for this community focal point and anchor. Expanded off-street parking ensures that the parking needs of the existing church and its expansion are met in a design that maintains the character and integrity of the surrounding area. The addition is designed in an architectural style and of a quality which complements the architecture of the existing church and is compatible with the surrounding uses in the area. In addition, the building addition will be set back more than 150 feet from the nearest property line. The temporary off-street parking area will be removed once construction ofthe permanent off-street parking areas are completed. 3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: the height limit would create an addition out of scale with the existing forty foot tall building, compromising the architectural style designed to complement the architecture of the existing church and the surrounding uses in the area. The subject parking area is designed to be temporary in nature while permanent parking is constructed. The installation of curbing for the limited period of time the parking area will be in place creates practical difficulties in that removal of the temporary parking area will be more difficult and costly. The following are our responses to your comments dated February 5. 2001. 1. No response required. 2. Per phone conversation with you on February 23, 2001, you indicated that John Duffy responded that no additional fees would be required from the Church. 3. The City of Carmel did make improvements to 126th Street; these have been added to our development plans. The survey, however, which was included in the original TAC submittal, was performed prior to the completion of the improvements. Therefore, it does not show the now-completed street improvements. 4. We have revised the plans to show the current right-of-way of Rangeline Road and 126th Street. 5. The existing right-of-way encroachment at the northeast corner of the existing parking lot has been referred to the owner for their action. 6. Per the surveyor, they have found no evidence that this 6th Street right-of-way parcel has been officially vacated. 7. This island is only striped. The GD1.0 plan has been revised to show a different shading pattern for paving being removed. P.O. As shown on the accompanying plan G1.1, the asphalt area at the northeast corner near the house has been changed to show curbing. At the south side of the property, however, the Owner has requested additional, temporary, paved parking be constructed to handle their parking needs during the construction process. This has not been shown to be curbed. Laurence Lillig and Terry Jones, with the City of Carmel, indicated this is a valid request that the Church may make to the Board of Zoning Appeals. The Church, however, will need to give a reasonable time limit that this would be used for temporary parking. If they decide to make it permanent parking, they would need to add curbs and landscaping per code. 9. The right-of-way lines have been clarified on the Drawings. 10. The arrow on the Drawing was pointing to a stop sign that was not shown. This has been corrected. The dashed lines represented an old curb cut that was removed in the reconstruction of the 126th Street frontage. This has been removed from our drawings. 11. On sheet SU1.1, the existing structures have been denoted and a schedule for the new structures added. 12. The pipe inverts and materials have been added to sheet SU 1.1. 13. Fanning/Howey Associates, Inc. representatives have physically walked this north property line and have found that the Church has kept their side of the property line cleaned out and free draining. The only thing that was evident that the Church may need to do is remove a small piece of concrete at the end of the existing culvert on their property. Other than this correction, the Church has not restricted drainage flow. The comer of the property to the north actually sits lower than the Church property and receives surface water from the surrounding neighborhood. Th~re also appears to be an existing drywell or other drainage structure on this property, which has been filled with gravel and topped with an iron grate. We feel that since this structure and the wet area actually falls on the neighbor's property, they need to be involved in its correction. We also have also included in these revised plans a copy of the erosion control plan that was requested by Mr. John South at the Technical Advisory Meeting.
