DEVELOPMENTAL STANDARDS VARIANCE 1. The approval of this variance will not be injurious to the public health, safety, morals and generai welfare of the community because; '!he existing tcMn hares and vacant lots do not encroach up:m any other property. All existing utility easenents ranain unchanged. '!he Kensington Place Replat of nr+nher. 2000 reduced the building lots fran 22 to 19. creating IOClre green space than that of the originally approved plat. An easement on lDt 10 has been recx>rded for Kensington Place residents to access ~adowlark Park. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: There is no encroachne1t involved to any property adjacent to Kensington PlaCe. The variances requested for catq)liance and consistency only affect the property in Kensinqton Place. There is no encroachment of any lot upon any other lot in Kensington Place. Adjacent properties have not been adversely affected fer twelve years. 3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: ThiI:teen (13) tCMn hares have been built and one (1) lot with footings 1='Oured since 1989. It would not be practical to destroY these e.xistinq structures. DECISION IT IS THEREFORE the decision of the Carmel/Clay Board of Zoning Appeals that Developmental Standards Variance Docket No. V- 38-01 and V-39-01 are. granted, subject to any conditions stated i~ the minutes of this Board. which are incorporated herein by reference and made a part hereof. ~3 .2001 SECRETARY.
