FINDINGS OF FACT - DEVELOPMENTAL STANDARDS VARIANCE
I. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the
community because:
The parkinl! spaces will not interfere with the ril!ht-of-wav established for U.S. 31 or with the traffic circulation or
parkinl! of the general public visitinl! the heart hospital or the attached medical office buildinl!.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially
adverse manner because:
The parking spaces will be adiacent to U.S. 31 and will be screened from U.S. 31 to the east and the conunercial
development to the north and south by landscapinl! and hidden from the view of the residential area to the west by the
proposed buildinl!s. Therefore. these parkinl! spaces will not have any imoact on the area adiacent to the property and
will not affect the use and value of the area adiacent to the property.
3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of
the property because:
The confil!UTation of the site reQuires that the hospital and medical office buildinl! be located to the south of the site.
Consideration of the residential area to the west requires that the buildinl!s be located as far to the east of Illinois Street
as possible. Efficient and functional parkinl! is necessary for the physicians working in the hospital (a permitted use for
the site). This reQuires a reserved parking area for the physicians that can be accessed and used without interference from
the general patient and visitor vehicular and pedestrian traffic. Based upon the optimal site layout. this area is best
located directlv to the west of the dedicated service drive and within the 90 foot build-to-line area. In order to provide
adeQuate. convenient and safe parkin!!: for the employees. visitors and patients of the hospital and the medical office
building. some parkinl! spaces in the I!eneral parkinl! area to the north of the buildings encroach into the 90 foot build-to-
line area. Placement of these spaces in this area eliminates the need to locate parking west of Illinois Street and adiacent
to the residential area. which would inmact the neighborhood to the west and which would reQuire pedestrians to cross
Illinois Street to reach the hospital and the medical office buildinl!.
DECISION
IT IS THEREFORE the decision of the Carmel/Clay Board of Zoning Appeals that Developmental Standards Variance
Docket No. is granted, subject to any conditions stated in the minutes of this
Board, which are incorporated herein by reference and made a part hereof.
