CONSENTTO ENCROACH
THIS CONSENT TO ENCROACH (heroinafter the "Agreement") is entered into by and between Hofinger, Robert P & Stacy L, 13052
Thurmond Way, Carmel, Hamilton County, Indiana 46074, (individuaity and collectively, "Owner"), and the City of (:arrnel, Hamilton
County, Indiana, by and through its Board of Public Works and Safety ("City").
wf1NESSETH:
WHEREAS, owner owns in fee simple Lot 30 ("Lot") in SHELBOURNE ESTATES, which is located within the corporate limits of
lire City of Carulcl, Indiana ("Subdivision"), which real estate is more particularly described in Exhibit A, attached hereto and
incorporated herein by the reference; and
WHEREAS, the official plat of the Subdivision was recorded in PC 3 S1:1DE, 91 , Instrument Number 2002-86426 in the Office of the
I lamilton County Recorder on 1 1/12/2002. as SHh"L.BOURNF FSTATES (the "flat"); and
WHEREAS, the current Owner wishes to install a Driveway Extension and basketball goal on the Lot (the "Site improvement"); and
WHEREAS, Owner has given the City a sketch ("Sketch") depicting the location of the Site Improvement on the Lot, a
copy of which is attached hereto and incorporated herein by this reference as lixhibit B; and
WHEREAS, the Site Improvement will he constructed on portions of the Lot designated as 30-foot Drainage, Utility
and Sewer Easement, identified as "10' D.U. & S.F."on ExhlbitB (the "Easement"); and
WHEREAS. the Easement is beneficial to the City and its residents; and
WHEREAS, as indicated on the Sketch, the Site hnpfo Willent will encroach (the "Encroachment') rrpnn the Flascment,
which Encroachment is crosshatched on Exhibit B; and
WHEREAS, City of Carmel Board of Public Works and Safety approves the Owlncr's request fur a variance from
C'nrrocl City Code Section 6-227(4); and
WHEREAS, Owner and City acknowledge the location of the Encroachnrent; and
WHEREAS, Owner acknowledges that this Agreenent does not Triply any approval of existing or (inure irllprnveitlellB
not indicated by Owner on Exhibit B; and
WHEREAS, the location of the Site Improvement as indicated by the Owner on Exhibit B should not materially
interfere with tilt, City's use of the Easclucnt.

NOW, Tf1EREF0RE, for and in consideration or tile mutual covenants attd agreements cenatincd herein and
other good and valuable consideration, the sufficiency and receipt ofwhich are hereby acknowledged, the
parties mutually promise, agree and covenant as follows:
1. 'Elie foregoing preambles, recitations and deftnifions are made a part hereof as though such were Cully
set fodlt herein.
2, The City consents to the Encroachment Cer only so long as
(t) the Encroachment exists; and
(ii) Owner complies with all of the terms and provisions of this Agreement.
3 Owner covenants and agrees not to extend, increase, modify, alter, landscape, reconfigure or otherwise
change the Site Improvement from what is depicted oft Exhibit €3, and to maintain the Site Improvement in
good condition and repair.
4. Owner agrees that City shall have the Fight to remove any portion of the Site Improvement as City deems
necessary, in C'ity's sole discretion, to install, protect and/or repair any utility lines, sewer lines or drainage
ditches located in the F'.asement, or for any other lawful purpose, and that, should the City lake such action, the
City shall incur no obligation to repair, replace or reimburse Owner for the cost of any damages thereby caused
to the Site Improvtnent, the Lot, or to Owner
:. Owner agrees and acknowledges' drat the City's consent to encroach upon the Easement, as provided in this
instmnrcut, regards the C ity's Easement interests only, and does not constitule permission or aathoaty for tote
Owner to otherwise enlcr on, in, under, over, or upon the property interests or any other person without that
person's consent even ifsuchproperty interests are also located within the Easement.
b- Owner agrees to indemnify and hold harmless City, its nffrcers, officials, uten.bers, employees, invitees,
licensees and agents, trom and against any and all losses, liabilities, damages, claims, judgrmenu, attorney fees
and costs ansing from any bodily injury and/or deadt, and front any destruction or damage to any property of
mproveme�ts, located on the Lot, or otherwise, and/or for any failure. of proper disclosure pursuant to
Paragraph 12 hereof, which results directly or induecdy from any act ofOwner, its employees, contractors
and/or agents in, on, under, across or to ,hc Easement,
7.. C)wner agrees to reimburse City 1'm' -:ally and aft costs and expenses incurred by City to replace m repair any
damage to the Easemcill and any i5nproventems located therein caused by the installation, construction,
mainlenancc amilor operation of the Site Improvement.

1 1 The Owner agrees to provide full disclosure of this Agreement to all persons, entities and others who acquire
by or through Owner any interest in the Lot on and after the effective date of this Agreement.
12. Owner agrees not to alter the ground surface elevation within the limits of the easement at any time.
13. Owner agrees to remedy any drainage problems or issues, saturated soil or standing water on the Lot or
adjacent properties determined by the City to be resulting from the Encroachment.
