The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: the increased height of the buildings will be consistent with and complimentary to the height of the buildings developed and to be developed in the U.S. 31 Overlay Zone and the existing office buildings on the "Conseco" office campus directly to the south. Therefore, there will be no injury or other detrimental effect on the public health, safety, morals and general welfare of the community. 2. The use and value ofthe area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: the increased height of the buildings is consistent with the height of the buildings developed and to be developed in the area adjacent to the property. Therefore, there will be no effect on the use and value of the a~aantanaandproperlk~ 3. The strict application ofthe terms ofthe Zoning Ordinance to the property will result in practical difficulties in the use of the property because: the Ordinance would restrict the height of the buildings to 35 feet which would prevent the petitioner from developing the property consistent with the adjacent properlies and with the current comprehensive plan. DECISION IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that Development Standards Variance Docket No. 06080021 V is granted, subject to any conditions stated in the minutes of this Board, which are incorporated herein by reference and made a part hereof. 2006.
