situation is not fully of your own cause or control, I would say that continuous constuction has commenced and I
that your zoning approvals are not in jeopardy. Finally, I will ask for the permit to be issued tomorrow, and follow-
up with Gary to get whatever outstanding comments to you. I figure we can work through the engineering issues
concurrent with construction.

Hi Mike,
I have a couple of questions, but first I need to relay to you the following context.
Approvals were obtained on 6/25/05 and, because construction had not commenced, John Robinson
requested and you granted a 6 month extension. Since then, the existing Sunrise building was demolished, but
the construction contractor, Zeller Construction and Development (Bruce Zeller), has been delayed in obtaining a
building permit. John Robinson relays to me that the delay is caused by the disappearance of their I
architect/owner's representative. Apparently, after the DP/ADLS, zoning waivers, and developmental variances
were obtained, the architect/owner's rep left for a job in Chicago and "dropped the ball". This was not '
discovered until Bruce Zeller became involved and attempted 10 obtain a building permit, only to learn that there
were many outstanding technical/construction matters. Bruce has succeeded in clearing most of these issues,
but has been waiting for communication from the engineering department.
My questions are twofold. First, I wanted to confirm with you that the demolition of the building, and the
subsequent attempts to obtain a building permit, constitute the commencement of continuous construction,
obviating the need for another ex1ension; if not, we may need to ask the BZA for a variance extending the time.
Please let me know. Once the building permit is obtained, they will immediately continue with the physical
process of development and building. They are very anxious to get going, and somewhat distraught over the
situation.
Second, I wanted to know whether you thought there was anything we might diplomatically do to get feedback
from the engineering department. I could call and inquire, but I know that they are very busy, making prompt t
replies somewhat difficult. Perhaps we could be placed on the T AC agenda for 9/20, but they really do not want
to wait that long. I am just brain stormlng--they are very anxious to get this redevelopment completed. '
Any thoughts you may have would be helpful. Thanks.

The plan is missing 11 shade trees and 6 ornamental trees. Chris McComas valued the ~hade
trees at $381.25 and the ornamental trees at $227. That total would be $5558.75. The
check can be made out to the Carmel Urban Forestry Fund.

The substitution for the globe maple should be from the attached recommended Street Tree
List, or sugar maple (Acer saccharum) is ok as well. If you want to have your landsc~per
look at the list to recommend a species to you, or he can call me. If you want to make
the substitution commitment in a letter form, just address it to me. '

Attached is an AutoCAO drawing with the latest changes in the landscape plan.
1.
I changed the trees on the north to the Magnolia trees.
2. Lake County Nursery in Perry Ohio began carrying this tree is Fall of 1999 and J.
Frank Schmidt & Son Co. in Boring, Oregon also carries them.
Some information found off the internet about these trees.
Deciduous tree, 15 ft (4.5 m) high, with 18 it (5.5 m) spread, very denseiy
branched, compact, formal globe ("lollipop") habit. Often grafted on a standard. Leaves
sharply and acutely dentate, red-brown in spring, developing to medium green, and yellow
in fall.
-Zone 4 Introduced in 1873 by Van Houtte.
I will ernail the information about these trees to Scott Brewer.

I met with the Urban Forester on Wednesday and he will approve our plan based on the
following:
1. He would like the tress at the end of the walk to the adjacent building to the
north changed to a Ginko or Magnolia.
2. He would like to get some information for his file on Globe maples
3. For the trees we can not plant to meet the requirements he would like us to make a
donation to the Urban street tree fund in the amount of the value of the trees. He wbuld
like us to corne up with a number based on the following: 1. cost of the tree 2. east to
plant and 3 cost for the one year warranty. Can you give me an idea of this cost?

Can you please see if you can get a hold of the Carmel Urban Forester and see if he has
completed his review. We were before the plan commission tonight and the fact that we can
not provide all the trees required has become an issue that we need to bring to closure.

I need to do some research in our records, because negotiations about this plan where suddenly halted last year
without any indication why. The plan is short trees, and certain numbers are required, or alternatives committed
to, and the final conditions were not completed at the time. I was not at the approval meeting, so I need to check
on what is required. If the Plan Commission, did not have all the information, or imposed certain conditions, ,

I apologize, but we are struggling to find any documentation of this project having been reviewed. I am
trying to establish where this project is located and when it was reviewed so we can check status of any
comments having been addressed. Did the project change names? Do you have drainage approval and
approved construction drawings from Engineering? Have any and all Board of Public Works and Safety
approvals been obtained and any outstanding fees paid and performance guarantees been posted?
