Gordon Byers called me this morning, and whined for several minutes about our process that seems to require petitioners
to supply informational packets in advance of the meeting. He obviously wanted to avoid being tabled to the June meeting.
His argument: If he submitted an application with enough info to get a docket number, he should not then be required to
submit anything else before the hearing.
He then tried to suggest that the state law prohibited advance communication with the Board. I pointed out that the statute
is intended to prevent petitioners or remonstrators from "lobbying" Board members to get them to vote a certain way. It is
not intended to keep them in the dark about the facts surrounding a petition until the hearing.
Let's talk about this issue in the next day or two, and determine whether we need to make any adjustments.

I anticipate that Gordon Byers will try to tag along on Steve McVicker's petition for the National Bank of Indianapolis. A
little history regarding this: When the Fidelity Keystone Office Park came through for ADLS approval, the Department
identified a series of sign violations on site and set a deadline for either their abatement or for DSV petitions to be filed.
When that deadline arrived, Mr. Byers and Mr. McVicker were contacted regarding the National Bank of Indianapolis signs
(Mr. McVicker having been identified by Gordon as the individual who would be handling the matter). Unfortunately,
following the Plan Commission approval, Gordon never advised Mr. McVicker of his role in the matter, therefore, when he
was contacted by us, Steve was understandably surprised. I gave him a filing deadline extension to the following Monday.
On that date, not only did Mr. McVicker bring in the applications for the National Bank of Indianapolis, but Gordon rode his
coattails in to file the Multi-Tenant Building Complex Center Identification Sign petition. Rather than argue the point, I
decided to broaden the scope of the extension to include Gordon's. Now it comes time for BZA, and Mr. McVicker has
submitted informational pakets for his signs, but Gordon has not submitted packets for his.
The petitions are unrelated other than as to location, and the Board has no information on Gordon's sign. Do not let him
move forward.
