1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the
community because:
The accessory structure will be well constructed,will provide a buffer to the back yard,and will be landscaped.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially
adverse manner because:
There will be no impact on the use of adjacent properties by the construction of the accessory structure. The
accessory structure provides extra storage space at 96 Red Oak Lane,allowing the third bay of a garage to
he used fora car(improving value.) The general style of the shed will he similar to the primary structure
3. The strict application of the terms of the Unified Development to the property will result in practical difficulties in the
use of the property because:
96 Red Oak is a well landscaped corner lot. Complying with the UDO would require removal of landscaping,
and placement of an accessory structure in a highly visible location (taking away from the natural wooded
nature of the'backyard'). Placement as proposed,provides a visual and physical barrier to the backyard while
maintaining the assets of this unique site.
