'eals The regular monthly meeting of -the Board of Zoning Appeals was held on Nov. 24, 1969.
All members were present with the exceptions of Egger and Hash. Gradle was present.
Minutes of the previous meeting were read and approved.

golf course will provide community with recreational facilities and add beauty to
to -the area. Plan Commission t hinks this is a favorable place for golf course
and they will_ come back at a future date with plans for any buildings they may
wish. This area is in an area which floodsabout once in every five years. Green-

the proposed Special Exception herein requested is located in the appropriate dis-
trict where such use is permitted, -that -the requirements of the Master Plahr�7oning
ce Ordinance Nave been met by the applicant and have been complied with in a manner
consistent with the report of the Plan Commission and that the granting of the
Special Exception requested is consistent with the spirit, purpose, and intent
of the Master Plan Zoning Ordinance and will not substantially or permanently
injure the appropriate use of neighboring property and will serve the public
convenience and welfare."

Improvement Location Permit for the Special Exception requested by the applicant

2.A. Docket No. BA 16-69. Variance application by Lighthouse 'Tabernacle, Inc.,
erection of sign southwest corner of 98th Street & U.S. 431, (Keystone).
Public Hearing was held Oct. 27, 1969 at 8:15 p.m. Action deferred, information r-ego RQ4
from Indiana State Highway Dept. Set back changed to W -0". Letter requested
on Odt.30,1969 by Gradle fr(x Clinton A. Venable, Chief, Division of Traffic -
State Highway. Venable'°s letter stated, "we wish to inform you that 'the submitted
plan has been reviewed and found to be satisfactory. However, you should be ad-
vised that the proposed sign should in no way resemble or have the appearance of
a traffic signal or flashing beacon." getter, ff'ori-Webb, Webb, Smith, Pearce &
Barr, attorneys for Mr. & Mrs. Armon C. Dawson, upon whose land this church was
built, advised them--- of covenant. "Only appropriate and becoming signs shall
be erected designating the name of the church and the hours of worship."This is
to advise that any sign which exceedsthe following description will be deemed by
Mr. and Mrs. Dawson to be a violation of said covenant: "No sign shall have more
than ore readable side, be no larger than 50 square feet total area, illuminated
by no more than two 40 watt florescent lights. No said lights shall flash or
blink in any way to attract or divert attention to said sigh. Noauxillary lights
of any type are to be used. This includes additional florescent lights, light
bulbs, carbon arc, mercury vapor lamps or any glass tubing filled with one or
more of the rare gasses, commonly called neon lights. No additional illuminated
signs, letters, insignia or slogans. Reading material must be con twined in -the

50 square feet, sign area. No sign or surrounding or supporting superstructures

of worship." Letter, from Armon Dawson to Leroy New states: "'Phis _letter which
announces the feelings of Vera and me under_ whose names any further action
must be taken is also the unanimous feeling of more than eighty people on a
remonstrance sheet. I was not at the p is hearing when the room was .full of
these remonstrators. I was told that either Mr. Greeman or Mr. Porteous of
the board brought up about what Mr. Dawson's intent might be as what "Appro-
priate and becoming" is." Letter from Rev. William Totman dated Nov.21,1969
stated: "We are writing concerning the variance of a sign for Lighthouse
Tabernacle, 2599 East 98th Street, Docket BA 16-69. After conferring with
Mr. Harold Horine, Traffic Safety Engineer and Mr. Merle A. Newlin, Mainten-
ance Engineer for the State Highway Department we were told they have no
jurisdiction whatsoever over anything off -the right-of-way line. IIowever,
they both agree -they can see no traffic hazard that would be caused by -the
erection of this sign."
Porteous doesn't -think petitioner is acting in good faith in accordance :with
private covenant. He feels members should give petitioner a chance to clear
up the conflict between the private covenant and proposed plan.
Wilson made motion thatthe variance application by Lighthouse Tabernacle, Inc-.
Docket No. BA 16-69 be denied because it doesn't add to the spirit and intent
of the area and he does not agree with petitioner's reasoning for this type
of sign. Porteous seconded.Haston--aye, Porteous --aye, Wilson --aye, Greenman -aye.
Petition denied.
It was observed -that Michael Morgan (Indiana Systems) 3740 N. Keystone Indiana-
polis, Indiana, private investigator, brought a tape recorder into the meeting
without notifying anyone of his intentions.
New Business
1B. Horace &, Hilda Hadley requested to appear before the board. Failure to
comply as stated in letter from Building Commissioner. Dated June 26, 1969.
Horace Pa. Hilda Hadley did not appear. Letters on file pertaining to this
matter. Gradle suggested turning matter over to Town Attorney.
Porteous made motion to turn matter over to Town Attorney for action. Wilson
seconded. Haston--aye, Porteous --aye, Wilson --aye, Greenman --aye. Motion
passed.
2B. Public Hearing date set on variance application on lot 27 Rolling Meadows,
2nd section, by James H. Barnett, 171 Pearl Street. Sid.eyard variance.
Docket No. BA 18-69 to be held on Dec. 221,1969 at 8:00 p.m.
3B. Public Hearing date set on variance application by Edwin J. Knauss, bldr.
Lot 13 TWildwood Estates. Front bldg. line set back, due to error in placement
of house on lot. ket No. 19-69 on Dec. 22, 1969 at 8:15 p.m.
