The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: We are requesting a lot coverage of 86% which is not drastically over the standard 80% that the city typically uses. The extra lot coverage we are requesting will not create any cause of concern in terms of public health, safety or morals as the project will be aesthetically pleasing and we plan on using the proximity of the Monon Trail to our advantage. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: We are not taking away from adjacent property because we plan to utilize the Monon Trail to our advantage and have been working with the city in negotiations to create another crossroad to the south of the property that would connect Monon Boulevard to 3rd Avenue. 3. The strict application of the terms of the Unified Development to the property will result in practical difficulties in the use of the property because: Due to helping the Carmel Redevelopment Commission by deeding over some of our land on the East side of the property near the Monon Trail, our original plans for `The Concourse" building became over the allotted 80% coverage ratio. Making us redo the plans to adhere to lot coverage UDO Standard would cost time, money and resources not only in relation to The Concourse land, but to our adjacent property to the South we plan on developing and to the crossroad construction we have discussed with the city. DECISION IT S THEREFORE the decision of the Carmel Board of Zoning Appeals that Development Standards Variance Docket No. PZ ZOZ5—o0Og9 V is granted, subject to any conditions stated in the minutes of this Board, which are incorporated herein by reference and made a part hereof.f. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: We are requesting 8'sidewalks in some cases instead of the 10-12'requirement. Near the outside of the property would still have 10'sidewalks where most of the public would be in relation to the project. Closer to the middle of the property, up near the building itself we are requesting some of the sidewalks to only be 8'. We believe this distinction is still a safe variance from the typical requirement and would not pose any safety concerns. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: Due to the sidewalks that require the variance being in a location that is not spotted easily from outside the property, adjacent areas will not be able to tell in the slight variance in the sidewalk width. Therefore, use and value is not likely to be affected in anyway. 3. The strict application of the terms of the Unified Development to the property will result in practical difficulties in the use of the property because: Making the sidewalks wider would force the lot coverage percentage of the property to go even higher and would harm the aesthetic design of the building as well as possibly making a reduction in the amount of apartments necessary. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: Granting a ground sign 0'set back from the Right-of-Way and not requiring an equal landscaped green area at the base of"The Concourse"permanent sign will not be injurious to public safety or general welfare because of the design of the project. There is still landscaping surrounding the signage it just does not lay at the base of the sign and still looks appeasing in design. The sign does not alter or interfere with the ROW making the variance request no cause for concern in relation to public health, safety or general welfare. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: The variances we are requesting do not cause any visible outliers that would harm the function or viewing of the property. These changes would also not lessen the use or value of any adjacent area near the property. 3. The strict application of the terms of the Unified Development to the property will result in practical difficulties in the use of the property because: If we are not given this variance it would disrupt the entire project by derailing our main entrance into "The Concourse". The permanent sign welcomes people to the property in an appropriate and appeasing way while not causing any disruption to the property or surrounding areas.
