(formerly known as Zaring Homes) were scheduled to appear before you with respect to the above- referenced matters. I have been informed that Ms. Barnett was ill and unable to attend Monday night's meeting. Unfortunately, I was out of town on Monday and could not be reached prior to your meeting. It was a result of these circumstances that representatives of Drees Premier Homes, Inc. were not in attendance at your Monday night meeting. It is my understanding that the Board dismissed SUA-63-01 and continued the remaining cases. Lakes at Hazel Dell, Section I, Common Area 7 (V-139-00) Petitioner seeks a Developmental Standards Variance of Section 25.7.01- 4(m): Suspended and Projecting Signs. The site is zoned S-l/Residence. Filed by Joseph M. Scimia of Baker & Daniels for Zaring Homes of Indiana. Joe Scimia, attorney with Baker & Daniels, 600 East 96th Street, Hamilton County, Indiana, appeared before the Board on behalf of Zaring Homes who has filed a request for three variances to legally establish three signs that provide signage for the Lakes at Hael Dell. Dawn Barnett, representative of Zaring Homes, was also in attendance. The subdivision is located south of 126th Street, east and west of Hazel dell Parkway. The site consists of approximately 280 homes sites, developed in four separate communities; The Estates; The Meadows; The Overlook; and The Glen. s:\BoardofZoningAppeals 2 (--; ~~ u u There are three signs located at the entrances to the Lakes at Hazel Dell: Sign A is located off of 126th Street at Autumn Gate Way; Sign B is located on Dellfield Boulevard East; and Sign C located on Dellfield Boulevard West. Section 25.7.01.4 of the Carmel Sign Ordinance prohibits suspended and projecting signs except in Old Towne Carmel. Zaring Homes hired a local design firm to do the design work for the site and the signs were then constructed. The prior work that the sign consultant had done was for a project located in Old Towne Carmel. The sign design firm did not understand that these signs were prohibited other than in the Old Towne Carmel area. The Sign Consultant took the signs through ADLS review by the Plan Commission and they were actually approved. However, the subsequent approvals for a variance for the design as well as building permits were never obtained. Sign A is located at the entrance to Autumn Gate Way, outside of the right-of-way in all respects. The base is approximately 5 feet from the right-of-way. A picture of the sign was displayed; there is a brick base with a suspended pole, metal construction suspended from the arm, announcing The Overlook at Hazeldell. Sign B is located on the east side of Hazel dell Parkway, approximately 5.7 feet from the right-of-way, similar in construction, and announces The Estates at Hazeldell. The final sign is located on Dellfield Boulevard West, again, approximately more than 5 feet from the right-of-way, of identical construction and announcing The Meadows at Hazeldell. Mr. Scimia provided Findings of Fact for each variance as well as ballots for each Board Member. Members of the public were invited to speak in favor or opposition to the petitions; no one appeared and the public hearing was closed. Department Report, Laurence Lillig. The petitions are "after the fact" for Subdivision Signs erected without the necessary Plan Commission ADLS approvals, since received, or a sign permit which the Department cannot issue until a decision has been rendered by the Board of Zoning Appeals. These signs have been constructed within drainage and utility easements and Board of Public Works approval was required and granted. The Department recommends favorable consideration of these petitions. Chuck Weinkauf asked if there were an explanation for the obvious oversights. Zaring Homes is a large organization and must have been aware that permits were needed for the signage. There must be a reason as to why this happened before the fact. s:\BoardofZoningAppea1s\Minutes\2000oct24 3 "..J o o I Joe Scimia offered the following explanation: The signs were designed as all the others have been, and the petitioner was not aware of the requirement that a projected or suspended sign could not be allowed other than in Old Towne. However, ADLS approval was obtained, and the petitioner thought that was all that was needed. When the error was discovered, they immediately tried to bring them into compliance. The petitioner is fully aware of his obligations and is trying to bring the signage into compliance. The petitioner hired local consultants that did not do their job. When the petitioner appeared before the Board of Public Works, there were three signs that were not approved, and those signs have been removed. Charles Weinkauf commented that the Board, historically, has not looked favorably upon after-the-fact situations. Obviously, mistakes are made. Michael Mohr commented that the Board must be careful about approving after-the-fact situations. Joe Scimia asked that the Board approve the signs, as presented. In response to questions from Leo Dierckman regarding the design and architectural interpretation of the signs, Laurence Lillig said the easement issue has been resolved and the ADLS issue has been resolved with respect to the permanent signs. The Plan Commission did approve the ADLS feature, and the Department has no objection. North Augusta Subdivision, Section 2, Lot 29a - Majestic Corner Plaza (V-177-00) The petitioner seeks approval of a Developmental Standards Variance of Section 27.5: Amount of Parking Spaces Required from 180 to 145 for three general office buildings totaling 54,000 square feet on 2.55 acres. The site is located on the southwest comer of West 97tfi Street and North Augusta Drive. The site is zoned S-I/Residence. Filed by Ronald L. Bussell for Majestic Residence, Inc. Ronald Bussell, 301 East Carmel, Carmel, appeared before the Board representing the applicant. This particular project has received ADLS approval from the Plan Commission and the petitioner is seeking a variance from the parking requirement.
