The Director of the Department of Community Services has determined that the described property became a non-conformity use when the business ceased operations on or about March 1, " < 2000 and the City Council rezoned the property from B3 to C 1. Petitioner believes that the use continues and that the building is a legal non-conforming use never having lost its status because of the interruption of the operation of the business. 8) State reasons supporting the Appeal: (Additionally, complete the attached question sheet entitled "Findings of Fact-Appeal"). The Goodyear Tire & Rubber Company store closed following the death of the franchisee in March 2000 at a time the City of Carmel was negotiating with the owner of the real estate to purchase the property for incorporation into Civil Center. Those negotiations terminated after more than one (1) year of duration during which time the City rezoned the B3 property to C 1 making the Goodyear store a non-conforming use. A second option for you would be to apply for a variance of use, according to the rules of the BZA., to allow for the operation of an Automobile Service Station. I realize this determination probably does not meet favorably with you.
