The Roman Catholic Diocese of Lafayette-In-Indiana, Inc. C'Orantor'). previously
recorded a Dedication of Public Right-of-Way on September 30. 2002, as Instrument
#2002-00071428. in the office of the Recorder of Hamilton County. Indiana ("Dedication
of Public ~ght-of-Way"). Thereafter, Grantor discovered that the legal description
contained in the Dedication of Public Right-of-Way contained a typographical error.
This conected Dedication of Public Right-of-Way is intended to correct the erroneous
legal description contained in the Dedication of Public Right-of-Way.
Therefore, the Grantor. the fee simple owner of the real estate described in what is
attached hereto as Exhibit A ("Property"). whi.ch Property is located in the City of
Carmel, Hamilton County, State of Indiana, and depicted in the attached drawing and
referred to herein as Exhibit "B". for the sum of $1.00 and other good and valuable
consideration, the receipt and sufficiency of which is hereby acknowledged, dedicates the
Property to the City of Carmel, Indiana ("Grantee'') for public right-of-way purposes
only, subject to all easements. agreements, mongages, and restrictions of record.
This Corrected Dedication of Public Right-of-Way is not subject to Indiana Corpome
Gross Income Tax..

RE: l06th Street/Haverstick Road Right of Way Dedication
Dear Board Members:
Mr. James E. Shinaver of Nelson & Frankenberger, representing the Saint Elizabeth Ann Seton Parish, has
requested the Board sign the Dedication of Public Right of Way documents presented for approval. These
documents dedicate right of way on 106th Street and on Haverstick Road, contiguous to Church property.
These dedications will result in a total 45-foot north half right of way dedication on l06th Street and a total
40-foot east half right of way dedication on Haverstick Road.
On behalf of the City of Carmel, I would like to thank Mr. Shinaver, the Saint Elizabeth Ann Seton Parish
and the Roman Catholic Diocese of Lafayette-In-Indiana, Inc. for these Dedications of Right of Way. I
recommend the Board accept and sign these documents.

We have reviewed the revised plans and comment letter dated July 11,2001. It appears that aU issues from
our JWle 27, 2001 review have been addressed. Therefore, assuming there will be no other revisions or
additions to the last drawing submitted, this office is prepared to approve a minimum of3-sets of certified
construction drawings for this project.
Please be advised that the following requirements remain to be satisfied prior to approval of the start of
construction.
1. Board of Public Works and Safety Approval Requirements:
. Commercial Curb Cut on I06lh Street - The request to the Board for approval of this curb cut
should include a reproducible exhibit showing a) the proposed drive and acceVdecellanes; b)
opposing drive and its alignment with the proposed drive; c) all appropriate dimensions including
proposed drive width, acceVdecellengths and widths, radii, etc.
2. A Street CutlRight of Way Permit and $2,000.00 License and Permit Bond will be required for the
work in the right of way of 106th Street. The permit form is available through this office. There is no
charge for the permit.
Please provide documentation of the I06lh Street, 45-foot right of way dedication to the City of Carmel.
