(V) Wichern Garage Setback Variance.
The applicant seeks the following development standards variance approval for a garage addition:
2. Docket No. PZ-2023-00111 V UDO Section 2.04 20’ rear yard building setback
allowed, 10’ requested.
The site is located at 11393 Royal Cir. (Sutton Place Subdivision, Lot 22). It is zoned S1/Residence.
Filed by Dennis Wichern and Patricia McGarry, owners.
General Info:
• The Petitioner seeks approval for an attached 2-car garage building addition.
• The site is a corner lot that has two front yards.
• Surrounding this site are single family residential homes.
• HOA (Homeowners association) approval and ARC approval have been granted.
• The adjacent neighbor is on the Architectural Review Committee (ARC), and he supported the HOA request.

Variance Requested:
Rear Setback -
• The UDO (Unified Development Ordinance) requires at least a 20-ft setback, and the Petitioner requests 10-
ft. This is a variance of 10-ft or a 50% change.
• The side will be brick, and the back will be Hardieplank siding painted to match the existing trim color.
Remaining Review Comments:
• The Petitioner addressed all planning/zoning review comments.
Final Comments:
• The Planning Dept. supports the variance request.
Findings of Fact:

Recommendation:
• The Dept. of Community Services (DOCS) recommends positive consideration of this variance request, and
with adoption of the Findings of Fact submitted by the Petitioner.
