DEPARTMENT REPORT

(V) Black Residence, Fence Variance.
The applicant seeks the following development standards variance approval:
5. Docket No. PZ-2023-00120 V UDO Section 5.09 (B) – Maximum 42 inch tall fence allowed in
the front yard, 48 inches requested.
The site is located at 612 Alwyne Rd. (Harrowgate Subdivision Lot 75). It is zoned R2/Residence. Filed by
David and Cindy Black, owners.
General Info:
• The Petitioner proposes to erect a 48-inch tall black decorative metal fence in the front yard.
• The subject property is a Corner Lot, which has two front yards.
• Single family detached homes surround the subject site.
• Please see the Petitioner’s info packet for more detail on the variance request.
Variance Requested:
Fence Height -
• Per the Unified Development Ordinance, fences in the front yard cannot be more than 42 inches tall.
• Petitioner requests a 48-inch tall fence, which is a variance of 6 inches, or a 14% change.
• The black decorative metal fence design will allow for some vision through it, so that it is not a solid wall.
Remaining Review Comments:
• The Petitioner addressed all planning/zoning review comments.
Final Comments:
• The Planning Dept. supports the variance request.
Findings of Fact:
• Please refer to the Petitioner’s Findings of Facts included in their BZA Info Packet.
Recommendation:
After all comments have been addressed, the Dept. of Community Services (DOCS) recommends positive
consideration of the variance requests, and with adoption of the Findings of Fact submitted by the
Petitioner.
