The applicant seeks the following development standards variance approval: 8. Docket No. PZ-2023-00124 V UDO Section 2.04 Minimum 30’ aggregate of side yards required; 27’ requested. The site is located at 1344 N. Claridge Way (Claridge Farm Subdivision, Lot 58). The site is zoned S1/Residence. Filed by Michael and Megan Fennerty, owners. General Info: • The Petitioner proposes a garage and patio addition to the home that will be 10-ft from the side property line. • Single family detached homes surround the subject site. • The building addition will match and/or complement the existing house’s design, materials, and colors. • Variance is requested to reduce the minimum allowed aggregate of side yard setbacks. • Please see the Petitioner’s info packet for more detail on the variance request. Variance Requested: Side Yards Aggregate - • Per the Unified Development Ordinance, the total aggregate of side yard building setbacks must be at least 30 feet. • The proposed aggregate of side yard building setbacks is 27 feet (10 ft. + 17 ft.). This is a variance of 3 feet, or a 10% change. • HOA (homeowners association) approval has been granted. Remaining Review Comments: • The Petitioner addressed all planning/zoning review comments. Final Comments: • The Planning Dept. supports the variance request. Findings of Fact: • Please refer to the Petitioner’s Findings of Facts included in their BZA Info Packet. Recommendation: • After all comments have been addressed, the Dept. of Community Services (DOCS) recommends positive consideration of the variance request, and with adoption of the Findings of Fact submitted by the Petitioner.
