All rights of public, the State of Indiana or any political subdivision of the State of Indiana in and to that part of the Real Estate which has been taken or used for highways, streets, rights -of -ways or related purposes; and 3. All applicable zoning, building and land use, and other governmental restrictions, laws, ordinances, rules and regulations. Grantor, as its sole warranty herein, specially warrants to Grantee, its successors and assigns, that it will forever defend title to the Real Estate (subject to the matters to which this conveyance is hereinabove made subject) against those claims, and only those claims, of persons claiming title to or asserting claims affecting title to the Real Estate, or any part thereof, under, by, through or based upon, the acts of Grantor or anyone acting by, through or under Grantor, but not otherwise. The undersigned person executing this Special Warranty Deed on behalf of Grantor has been duly authorized and fully empowered by all necessary actions of Grantor and has full power and authority to execute and deliver this document on behalf of Grantor. This Special Warranty Deed may be in counterparts and, when fully executed and assembled, shall constitute a fully executed Special Warranty Deed.
