Dear Mr. Reis:
Your request to reschedule the Public Hearing for Docket No. SU-95-01 cannot be
accommodated. The Item was properly scheduled for the August 27, 2001, meeting of the Board of
Zoning Appeals. Prior to your letter dated August 20, 2001 ,your office submitted no request to
appear on the September 24, 2001, agenda. For future reference, the Department cannot honor
verbal requests to table or appear on specific agendas. Your office's failure to follow up its request
in writing is not Mr. Dobosiewicz's fault.
The petition will be tabled for defective notice pursuant to Article VII, Section 4, and for
failure to submit informational packets pursuant to Article IV, Section 8, of the BZA's Rules of
Procedure.

Dear Mr. Weinkauf:
Our firm represents Plum Creek Partners, LLC in their Special Use application to
construct a multi-tenant commercial building located north and west of the intersection of Hazel
Dell Parkway and 13 1st Street. The August 27,2001 meeting agenda indicates a public hearing
scheduled as item 18h for the building to be constructed on Lot 4 of Hazel Dell Comer. Please be
advised that we requested that the public hearing on this proj ect be scheduled for September 24,
2001 in our August 9, 2001 telephone conversation with Jon Dobosiewicz of the Department of
Community Services. The reason for the delay in scheduling this meeting for your consideration
is to allow the Carmel Clay Plan Commission to consider and approve the architectural design,
lighting, landscaping and design of the proposed development.
As the agenda inadvertently includes this item, we respectfully request this item not be
tabled, but rather that the public hearing be rescheduled for September 24,2001. Thank you very

Dear Mr. Crosby:
This office has reviewed the plans submitted for this project. We apologize for the delay and offer the
following comments:
General Information
1. The project site is located within current City of Cannel Corporate Limits.
2. Jurisdictions:
. Streets and Right of Way (Hazel Dell Parkway/East 131't Street) - City of Cannel
. Water, Sanitary Sewer, Storm Sewer - City of Carmel
. Mitchner Ditch - Hamilton County Surveyor's Office
3. Board of Public Works and Safety Approval Requirements:
. Water and Sanitary Sewer Availability (Connection).
. Any permanent improvement, including irrigation systems, to be installed in public right of way or
dedicated easements will require a Consent to Encroach Agreement between the City and the
Owner or Owners. If an irrigation system is planned, additional Water Availability will be
required from the Board.
I am enclosing a schedule of Board of Public Works and Safety meeting dates and agenda deadlines
for your use. Please use the Engineering Department deadlines for submission to the Board.
Any submi.~sion to the Board requires prior final approval by the Carmel Clay Plan Commission
and/or the Roaul of Zoning Appeals and completion of review by the Technical Advisory
Committee. All written requests to be placed on the Boaul's agenda must include the appropriate
Docket Numbers and the (late (or (lates) of approval by the Plan Commission amI/or BZA.
4. Water and Sanitary Sewer Connection Fees:
. Connection Fees are based upon the average user factor tables from Section 9-35 (water) and 9-
200 (sanitary) of our Utility Ordinance. The Connection Fees are $1,310.00 per ED.U. for water
and $795.00 per E.D.U. for sanitary sewers. The Equivalent User Contribution Multiplier for
Retail projects is 1.0 E.D.U. per 1,000 square feet. Since this appears to be a multiple tenant type
building, the Retail Classification will be utilized to calculate Connection Fees. I am enclosing
copies of our Average User Factors for Water and Sanitary Sewers and our current Fee Schedule.
Note: Any deviation from the Connection Fee calculations listed in our Ordinance will require
Carmel Utilities ami Roaul of Public Works and Safety approvals. Such reque:;ts must be
accompanied by proof of a minimum of one years worth of actual water usage, recapped by
total gallons per month, and must inelude the name, location, size amI/or number of seats of the
facili~}' being utilhe(l as a base for calculation of fees.

5. T.AC. Review/Drawings submitted for approval:
We request that all comments and comment letters generated by tins office be answered in writing and
be accompanied by a drawing reflecting requested revisions. Final drawings will not be approved for
construction until all issues have been resolved. All Cannel Utility issues must also be resolved. TIle
design engineer must certify all drawings submitted for final approval. TIns office will require a
minimum of five-sets of approved drawings after all issues have been resolved. TIle drawings will be
stamped approved and signed by both tile City Engineer and Director Cannel Utilities. TIle
Developer/Owner will receive one-set which is to be maintained on the construction site at all times.
Carmel Utilities will receive two-sets. Our Public Works Inspector will receive one-set and one-set
wi II be maintained in tile Department of Engineering. If more tl1an five-sets are requested to be
approved, tile additional sets must be submitted with tlle five-sets.
6. Please be advised that any installation of signs, walls, irrigation systems, etc. within dedicated right of
way or easements will require a Consent to Encroach Agreement between tile Owner/Developer and
tile City of Cannel. This agreement requires review and approval by our Law Department and Board
of Public Works and Safety approval.
7. Carmel Utilities does not subscribe to "Holey Moley" and should be contacted directly for all water
and sanitary sewer locates.
8. Carmel Utilities will provide a separate review of tins project for water and sanitary sewer issues.
9. 1 am including copies of the following items with tins correspondence:
. Department of Engineering Commercial Project Approval Procedures.
. Department of Engineering Subdivision Requirements.
. Performance Release Procedure
. Permit Data, Contacts, etc.
. Commercial Pennitting Procedures.
1 will send a copy of our Residential Subdivision and Commercial Irrigation System Requirements
upon request.
BONDING REQUIREMENTS
10. Performance Guarantees
. Monuments (at lot boundaries)
Please provide individual, detailed certified Engineer's Estimates for 100% of the cost of labor
and materials for tile above improvement. Post individual Performance Guarantees in the amount
of the Engineer's Estimates. Three-year Maintenance Guarantees will be required upon release of
tile Performance Guarantees.
. Street Cut/Right of Way Permit and Bonding Requirements
Upon initial review, there do not appear to be requirements in tins regard.
PROJECT COMMENTS
11. Connection Fees:
The building is listed at 12,950 square feet. According to our Utility Tables under the Retail
Classification, 12,950 square feet @ 1.0 E.D.U.s per 1000 square feet = 12.95 E.D.U.s.
Water - 12.95 E.D.U.s @ $1,310.00 per E.D.U. = $16,965.00
Sanitary Sewer 12.95 E.D.U.s @ $ 795.00 per E.D.U. = $10,295.00
Totals 12.95 E.D.V.s $2,105.00 $27,260.00
We understand this is to be a "tenant space" type building and several different types of businesses
may be located in the building. Until more detailed information is forthcoming, the above calculation
seems to be the appropriate classification to use.

14. It appears the ground signs planned for this facility are to be installed in dedicated easements. As
explained previously, this will require a consent to encroach agreement.
The above comments are based upon the Engineering Department's initial review. Please provide our
office with a follow up letter and revised plans, indicating all revisions. Second and subsequent reviews
will focus only on revised items. It is critical that our office be made aware of all modifications made on
the plans being re-submitted, particularly if any such changes are considered "new" or fall outside of our
initial review.
