SIPE JEWELERS Fred, The square footage shown on the drawings on file is 4383.88 square feet. A 2700-square-foot addition would constitute a 61.6% expansion; this would require a reapproval by the BZA. By virtue of the fact that Use Variances are a land use issue, TAC review is mandatory. I imagine that the majority of comment would have to do with drainage, fire protection and building code, so I doubt it would be as intensive as your first go-around. The addition raises the parking requirement to a total of 24 spaces (at a ratio 1 per 300 square feet of gross floor area). The plans on file show 20 spaces (19 plus 1 handicap). You might consider filing a DSV petition for the difference, since a storage basement doesn't really affect the amount of travel generated to and from the site. My comments are as follows: 1. On the site presently, there are about 55 trees with trunks greater than 6 inches in diameter (<6" DBH) that provide benefits for the neighborhood and the City of Cannel. The plans propose clearing the site and replacing those trees with 13 shade trees and 7 ornamentals, most of 1 ~ inch diameter. This represents an unacceptable net loss of tree benefits for a use variance in Carmel/Clay Township. A reforestation project needs to be proposed for this project. Reforestation guidelines: when a large area of woods will be cleared for a commercial project in a residentially zoned area, the removal of such trees shall be subject to a reforestation plan to be submitted for approval. The plan shall include, but not be limited to, such information as site assessment, plant material source, species (native species are required for reforestation), number and size of plants, and a planting management and maintenance plan. The plan shall also include the location and size of the reforestation project. The area to be planted shall roughly match the area to be cleared; though not all planting has to be limited to the same property as the woods to be cleared. The planting shall be 40% understory trees and 60% dominant canopy trees. Stock shall meet the following scale for planting density: 100 2" caliper trees per acre 200 1" caliper trees per acre 350 hardwood seedlings or whips per acre The adjacent property has committed to a reforestation project because of their similar zoning request. If an off site project is proposed in Cannel, the cash value of the replacement of the trees for mitigation has been considered as an acceptable option. This plan does not meet the Perimeter Buffering requirements found in Appendix A of the City of Carmel and Clay Township Zoning Ordinance. For perimeters that border similar commercial properties, the requirements include minimum side yard widths of 5 feet, and rear yards of 10 feet, planted with 3 Shade Trees, 2 Ornamental Trees, and 9 Shrubs (or three Evergreens) per 100 linear feet. Perimeters that border residential areas must plant 5 Shade Trees, 5 Ornamentals, and 27 Shrubs (9 Evergreens) per 100 feet, within rear yards of25 feet and side yards of 15 feet. 3. Planting within dry detention areas should be considered, using species that are adaptable to those environmental conditions. Non-invasive prairie grasses could be considered as substitutions for trees in dry detention areas. Some species are well adapted to such environments and could significantly increase stormwater infiltration rates in those areas. This needs to be considered because ofthe drainage and stormwater attenuation benefits being provided to this neighborhood by the water flow across this property now. 4. On the planting details: note, which reads, "TREE SHALL BEAR SAME RELATION TO FINISH GRADE AS IT BORE TO PREVIOUS EXIST. GRADE," needs to be changed to read TREE TO BE PLANTED SO THAT ROOT FLARE IS AT, OR SLIGHTLY ABOVE, GRADE LEVEL. Root balls shall be set on undisturbed or compacted existing soil to prevent settlement. 5. On General (Planting) Notes: all plant materials shall meet American Standard for Nursery Stock (1996). Irrigation shall be frequent enough for establishment of all plant materials including trees. Irrigation plan should include estimated amount and frequency for plant materials. Any changes in materials shall be approved by the director of the Department of Community Services. 6. On the Plant Schedule: minimum height for Evergreen trees should be 8 feet. Please select a native species as an alternative to Red Maple (Acer rubrum), it is over planted in this area and can become invasive. In urban settings, it tends to become injured and then subject to disease, insects, and quick decline. River Birch, Sugar Maple, or Oak species would be acceptable substitutes. Re-Plat Lot 175a Home Place The District has received plans for this re-plat which are significantly different than the ones submitted in August 2000. The current plans show only one lot (rather than 2) but no information has been provided on how the property will connect to the District's sanitary sewer. Saddle Creek Sections 11 & 12 The District has received plans and the District's consulting engineers have completed their initial review. Once revisions have been completed and reviewed, the plans will be ready to be submitted by the District to IDEM for State approval of the sanitary sewer plans. Indiana Development Training Center The District has received plans although it is unclear if this project has any effect on the District's sewer system. Additional information will need to be provided. Building permits should NOT be issued without the District's connection permit. J. C. Sipe Jewelers (Use Variance) The District has received plans and provided comments to Fred Simmons, the project architect. The plans need to be revised to include the District's construction specifications and information on the means of connection to the existing sanitary sewer in the area. Pike's Spring Mill Heights (Section 1, Lot 5) Dev. Stds. Variance) This project is located in the District's service area but the neighborhood remains served by individual septic systems.
