("Sprint PCS ") was granted an improvement location permit (the "Building Permit") issued by the Director (the "Director") of the Department of Community Services (the "Department"), Carmel, Indiana for a wireless communications antenna facility (the "Sprint PCS Antenna") on the property located at 1388 Queens Way, Carmel, Indiana (the "Site"). Richard Deer, an owner of property adjacent to the Site ("Appellant"), has filed an ApI1eal (the "Appeal") to the Board of Zoning Appeals (the "BZA") seeking a determination that the Building Permit was not validly issued on account of the alleged failure by Sprint pes to obtain a variance or special use approval pursuant to the Zoning Ordinance, Ordinance Number Z-160, as amended, of the City of Carmel and Clay Township, Hamilton County, Indiana ("Zoning Ordinance"). Under a plain reading of the Zoning Ordinance, the Sprint PCS Antenna is a Permitted Use, and Appellant's Appeal is without basis. Factual Backf!Fouitd The Building Permit permits the collocation by Sprint PCS of the Sprint PCS Antenna on an existing 135' tall antenna tower property (the "Existing Tower") located on tIle Site. The Site is legally described on Item Number 1 of the Exhibit Book, and is zoned S-1 under the Zoning Ordinance. The Existing Tower was erected in 1987. As further described in Item Number 2 of the Exhibit Book, the collocation of the Sprint PCS Antenna on the Existing Tower is necessary to provide seamless, reliable wireless telephone and other communication services to persons located in parts of the City of Carmel and environs. 568601_1. DOC l~ Q On or about May 14, 2001, Sprint pes entered into a lease agreement with Edwin Zamber to install and operate the Sprint PCS Antenna on the Existing Tower. Sprint PCS has determined that if it had not been able to collocate on the Existing Tower, no other suitable existing towers or structures were available within its requisite search area, and that Sprint PCS therefore would have had to build its own tower support structure to meet its coverage requirements. o On or about February 22, 2001, a contractor for Sprint PCS contacted the Department to discuss the Sprint PCS Antenna. In connection with those discussions, the Department staff acknowledged that the Sprint PCS Antenna was a Permitted Use, and requested that Sprint Q PCS house its ground level equipment in a brick clad equipment shelter (the "Shelter"). The Q Shelter's architecture and style duplicates the design and character of the existing home and ~ pool house, and it meets all applicable zoning requirements, including height and setback. As a part of the approved plans and specifications, Sprint PCS agreed to landscape the area surrounding the Shelter. On or about April 17, 2001, Sprint PCS, through a site acquisition r.; firm, made an application with the Department for the Building Permit. On or about June 4, 2001, Sprint PCS submitted revised plans for the Building Permit application to include the Q Shelter requested by the Department's staff. A copy of such plans are attached to the Exhibit Book as Item Number 3. On or about June 15, 2001, the Department issued the Building Permit for the Sprint ~ PCS Antenna. The Building Permit bears identification number 2001.0627.B, and a copy is attached to the Exhibit Book as Item Number 4. On or about July 9, 2001, Sprint PCS ~ engaged Q Serve Communications .("Q Serve") as the general contractor for the installation of the Sprint PCS Antenna. On or about August 6, 2001, Q Serve began construction pursuant to Q 568601_1.DOC 2 ~ the Building Permit. The Shelter's foundation and all four block walls have been constructed. (~ The brick veneer of the Shelter is partially complete and other necessary building materials have been delivered to the Site. ~ On or about August 15, 2001, the Appellant filed an application for an appeals action with the BZA objecting to the issuance of the Building Permit. On or about August 15, 2001, Jeff Kendall, Building Commissioner for Carmel issued a stop work order on the project. (Jj Without notice or hearing, on or about August 23, 2001, the Director sent Q Serve a one-page letter revoking ~print PCS' s Building Permit (the "Revocation Letter")I. The o Revocation Letter sets forth but one basis for the purported revocation: ~ This office has determined that, prior to the issuance of a permit for the proposed "Equipment Shelter" on the "Lease Area" (as described in your Application for Improvement Location Permit), the "Parent Tract" should have been divided into two (2) or smaller parcels. Under Chapter 3 of the Carmel Clay Zoning Ordinance, this constitutes the subdivision of land requiring plat approval by the Plan Commission. Notably, the Revocation Letter does not allege that Sprint PCS requires a special use permit, o variance, special exception or similar zoning relief for the Sprint PCS Antenna. At no time prior to its receipt of the Revocation Letter had Sprint PCS been informed of any alleged need (,; for plat approval by the Plan Commission. A copy of the Revocation Letter is included as Number 5 of the Exhibit Book. , On June 6, 2002, the BZA held a public hearing (the "June 6th BZA Hearing") to ~ consider the Appeal, at which three members of the BZA were present. At the June 6th BZA ~ I The alleged revocation of the Building Permit is not the subject of Appellant's Appeal, but is the subject of a separate appeal filed by Sprint PCS with this Board on or about September 24, 2001 (the "Sprint Appeal"). Hence, Sprint PCS understands that the grounds set forth in said revocation are not part of the Appellant's Appeal and cannot be addressed hereby. Sprint PCS hereby reiterates and reaffirms the positions expressed in the Sprint Appeal. ~ 568601_1. DOC 3 Q Q Hearing, the Department recommended denial of the Appeal on the grounds that the Sprint PCS Antenna was a Permitted Use under the Zoning Ordinance. A motion to grant the Appeal received a vote of two members in favor, and one against, the Appeal. At the June 6th BZA Hearing, the BZA's President and Attorney each stated that, under the BZA's Rules of Procedure, a vote of two to one in favor of granting an appeal is insufficient, and continues the matter to the subsequent hearing of the BZA on June 24, 2002. Le1!al Analvsis 1. The Sprint pes Antenna is a Permitted Use under Section 5.1.1 The Sprint PCS Antenna is a Permitted Use pursuant to Section 5.1.1 of the Zoning Ordinance. Section 5.1.1 governs the collocation of Antenna in the S-1 Residence District. The Sprint PCS Antenna is an "Antenna" under the Zoning Ordinance, and the Existing Tower is a "tower" thereunder. Hence, in the S-1 Residence District, Section 5.1.1 expressly permits, as a Permitted Use, an Antenna (including the Sprint PCS Antenna) that is to be collocated on an existing or previously approved tower. Accordingly, as a Permitted Use under Section 5.1.1, no special use permit or other zoning relief is required as a condition to the issuance of the Building Permit. Q o Q Q Q Q In defiance of a plain reading of the Zoning Ordinance, Appellant argues that, in order to qualify as a Permitted Use under Section 5.1.1, an Antenna must be collocated on a Tower containing other "Antenna," and that the private radio communications use of the Existing Tower does pot qualify as an "Antenna." Specifically, the Appeal quotes statements the Director allegedly made in connection with the issuance of the Building Permit: " . .. an 'Antenna,' if collocated with an existing 'Antenna,' on an approved and/or existing tower, is a permitted use." [emphasis in original]. However, Appellant's alleged citation is not an appropriate quotation or Q ~ ~ 568601_1.DOC 4 Q application of Section 5.1.1 of the Zoning Ordinance. As Section 5.1.1 actually states that an Q Antenna is a Permitted Use if it is "collocated with an existing or previously approved tower" [emphasis added], Section 5.1.1 does not require collocation with an existing Antenna? Having reached the formidable obstacle that the Zoning Ordinance does not say what he Q would like it to say, Appellant employed a new tactic at the June 6th BZA Hearing and looked outside ,the Zoning Ordinance to a < dictionary definition of the word "collocation." More Q specifically, Appellant argues that the following dictionary definition of the term "collocation" requires that Section 5.1.1 be read as requiring an on-going location of the Sprint PCS Antenna with another "Antenna": ~ 'Collocate' is defined in Webster's New Collegiate Dictionary as 'to set or arrange in a place or position; esp.: to set side by side' and as 'to occur in conjunction with something'. Q However, nothing in that definition refers to other "Antenna" or otherwise supports Appellant's position. On the contrary, said general definition supports Sprint PCS' position. If"collocation" means to "to occur in conjunction with something," then the Zoning Ordinance clearly addresses r;; what the Sprint PCS Antenna must be collocated with - - namely, a tower. Section 5.1.1 expressly permits an Antenna to be "collocated on an existing or previously approved tower" [emphasis added]. Q Moreover, any possibility that said tower need be an existing "Antenna" tower is eliminated by the Zoning Ordinance's definition of the term "Tower.") The Zoning Ordinance IQ defines "Tower" as "a ground or roof-mounted pole, spire, structure, or combination thereof Q 2 Had the drafters of the Zoning Ordinance desired to require that collocation only be permitted on an" Antenna" tower said qualification might easily have been included, but is noticeably absent from Section 5.1. Presumably the drafters did not include such a qUalification because there is no logic or purpose served by doing so. 3 Please note that Section 5.1.1 utilizes the lower case" t" for the term "tower," indicating an even broader reading of this term should be permitted. Q 568601_1 ,DOC 5 c;j taller than fifteen (15) feet, including supporting lines, cables, wires, braces and masts, intended c;j primarily for the purpose of mounting an antenna, a meteorological device, or similar apparatus above grade. . . " Notably, the Zoning Ordinance's definition of "Tower" does not require that a tower constitute a communications tower. Since said definition4 broadly encompasses towers r;,;, hosting meteorological devices and other non-communications related equipment, Appellant's argument that the term "collocation" requires location with other "Antenna" fails based on a (,; reading of the Zoning Ordinance's definition of "Tower." Furthermore, as noted. at the June 6th BZA Hearing, even if there were any ambiguity under the Zoning Ordinance regarding the meaning of "collocation," industry custom and r.;; practice would eliminate any doubt. Specifically, in the wireless communication field, the term "collocation" includes the mounting or installation of an antenna on an existing tower or other r;Jj structure for communications purposes. 2. Section 25.13.4 Supports Sprint pes' Position Appellant further attempts to circumvent a plain reading of Section 5.1.1 by invoking ~ Section 25.13.4 of the Zoning Ordinance. Section 25.13.4 provides, in part, that "any tower or radio or television transmission antenna in existence or operation as of the effective date of this amendatory ordinance [i.e. July 11, 1997] may continue to exist and operate as a nonconforming ~ use without a use variance or special use or special exception approval so long as the use is not substantially altered and the height of the antenna or tower is not increased. . ." Said provision ~ of Section 25.13.4 focuses solely on the "tower." By contrast, Section 5.1.1 directly addresses collocation of "Antenna." Since Sprint PCS proposes to make no material alteration to the Existing Tower, the Sprint PCS Antenna may be collocated on the Existing Tower without r;Jj 4 Once again, the lower case" a" was used in reference to "antenna," indicating the broadest possible interpretation of that term. ~ 56860IJDOC 6 iii further inquiry under Section 25.13.4. Even if that were not the case, one cannot imagine a less iii substantial alteration than that proposed by Sprint PCS. Sprint pes' willingness to remove the . large existing "side arms" on the Existing Tower, and to utilize much smaller "flush mounted" antennae, cannot constitute a substantial alteration; otherwise Sections 5. L 1 and 25.13.4 would ~ be stripped of any relevance and meaning. Since the use of the Existing Tower will not be altered, but will remain as an antenna tower, Section 25.13.4 expressly provides that no variance, ~ special use or special exception is required, and Appellant's arguments must fail. Moreover, Section 25.13.4 clarifies that collocation on an existing tower need not be on a tower containing other "Antenna"; ~ ~ This paragraph authorizes the owner of a tower or antenna to construct a new tower or antenna on the same premises at a height not to exceed the existing tower or antenna if the use of the premises is not substantially altered and the existing tower or antenna is removed immediately upon completion of the new tower or antenna. Hence, Section 25.13.4 - may require the removal of existing antenna thereby further evidencing the lack of a requirement that the Sprint PCS Antenna be collocated with other" Antenna". t;,,;, 3. Section 5.2 Does Not Support Appellant's Claim Appellant also cites Section 5.2 of the Zoning Ordinance in support of his assertion that ~ the Sprint PCS Antenna requires a special use permit or variance. Exhibit B of the Appeal claims that "Section 5.2 of the S-1 zoning district dictates that a variance must be obtained prior r;, to placing the Sprint pes Site antenna on the site because an initial 'Antenna' must be located 'on or within a structure other than a tower'." - Appellant, however, misstates Section 5.2. That Section actually states that an Antenna iii is a Special Use "if visually integrated with or camouflaged on or within a structure other than a tower (such as a chimney stack, church spire, light standard, monument, power line support ~ 56860I_LDOC 7 C41 Q device or water tower)". [emphasis added]. As clearly stated by the plain language of the Zoning Ordinance, Section 5.2 does not apply to an Antenna to be located on an existing tower, hence it does not apply in this case. As a Permitted Use, the Sprint PCS Antenna does not require the approval of the BZA nor is a variance required before the issuance of a building permit. The erection of the Antenna on the Existing Tower will not circumvent the purpose of requiring a special use because the Zoning Ordinance allows, as a Permitted Use, an Antenna to be erected on an existing tower. The Existing Tower has existed since 1987 and clearly constitutes an existing tower. C41 .r.i 4. Section 5.3.7 Does Not Support Appellant's Claim The Appellant also claims that the Sprint PCS Antenna would violate Section 5.3.7 of the Zoning Ordinance because it permits '"private radio and television reception and transmittal ~ (i; towers and antennas...", while the Sprint PCS Antenna will be used for commercial purposes. Section 5.1.1 allows an Antenna to be collocated on any existing or previously approved tower. However, by Appellant's own admission at the June 6th BZA Hearing, Section 5.3.7 does not govern the use of the existing tower. The use (i.e., private versus commercial) of the Antenna is not a factor in determining whether it is a Permitted Use. 5. The Department Position and Industry Practice Supports Sprint pes' Position Thatthe collocation of the Sprint PCS Antenna on the Existing Tower is a Permitted Use . under Section 5.1.1 of the Zoning Ordinance is supported by the actions of Department staff. Specifically, not only did the Department staff issue the Building Permit, but even the Director's alleged revocation of the Building Permit was not premised on the grounds articulated by Mr. Deer, but on different grounds relating to plat approval (see the Revocation Letter, Item Number 5 of the Exhibit Book). ~ 'i; ~ (i; ~ 568601_I.DOC 8 " At the June 6th BZA Hearing, the Director confirmed his belief that the Sprint PCS Q Antenna could be placed on the Existing Tower as a Permitted Use under Section 5.1.1 of the Zoning Ordinance. This conclusion was apparently premised not only on a plain reading of the Zoning Ordinance, but is also consistent with the past practices of the Department relative to the ~ collocation of Antenna by Sprint PCS' competitors in the City of Carmel/Clay Townships. 6. Indiana Law - Statutory Construction of Ordinances Q The BZA also must not look beyond the clear and unequivocal language of Section 5.1.1 of the Zoning Ordinance. Indiana law is clear - "an ordinance must be interpreted as it is written and a reviewing tribunal is not free to go beyond its terms." Laws v. Lee, 471 N.E.2d 1229, r.- 1232 (Ind.Ct.App. 1984). Here, the BZA, as the reviewing tribunal in this matter, is constrained by the rules of statutory construction, which apply to the construction of an ordinance as well. ~ Woerner v. Indianapolis, 177 N .E.2d 34, 37 (Ind. 1961). In Indiana, the general rule of statutory construction is as follows: ~ [W]here the language or statute is clear and plain there is no room for construction, and courts have no power to supply supposed defects or omissions or resort to construction for the purpose of limiting or extending its operation, and judicial construction is not allowable to interpret the law which is plain upon its face. !~ I Meade Electric Company. Inc. v. Hagberg:, 159 N.E.2d 408, 413 (Ind.App. 1959) (citations omitted). ~ The BZA must not consider the various alternative readings of the Zoning Ordinance proposed by Appellant and must not look beyond the plain meaning of the words contained in ~ 5 Any disparate treatment of Sprint PCS gives rise to consideration under Section 332 (c) (vii) of the Federal Telecommunications Act of 1996, including the discrimination amongst providers of functionally equivalent services. 42 U.S.C. 332(c)(vii)(b). ~ 568601_1 :DOC 9 Q the Zoning Ordinance. The collocation of Sprint's Antenna is a Permitted Use and there exists Q no ambiguity in the language in Section 5.1.1. The language of Section 5.1.1 unequivocally permits an Antenna to be "collocated on an existing or previously approved tower" and, (i; therefore, Deer's Appeal must be denied. CONCLUSION The collocation of the Sprint PCS Antenna on the Existing Tower is a Permitted Use ~ under the Zoning Ordinance and, as such, the Building Permit was properly issued. This conclusion is supported not only by the plain meaning of the Zoning Ordinance, but also by the r.;; Appellant's proffered dictionary definition of "collocation". Moreover, the Director of the Department of Community Services who issued the Building Permit agrees that the collocation in this case constitutes a Permitted Use. ~ The Appellant's contention that a variance or special use approval is required is not supported by the provisions of the Zoning Ordinance. Section 5.2 of the Zoning Ordinance applies only to the collocation with a structure other than a tower. Section 24.13.4 prohibits (i; alteration to the use and height of the "tower"; neither of which will change. The Sprint PCS Antenna clearly constitutes a Permitted Use under Section 5.1.1 of the ~ Zoning Ordinance. As such, Appellant's arguments that specific zoning relief was required are incorrect. Q Q Q '" EXHIBIT 2 -- w BACKGROUND INFORMATION Sprint PCS and its affiliates have acquired licenses from the Federal Communications Commission ("FCC") to provide Personal Communication Services ("PCS") throughout the United States, which they market under the name "Sprint PCS." On or about June 23, 1995, Sprint PCS, through a partnership, was the successful bidder at an auction held by the FCC for a PCS Wireless broadcast license in the Indianapolis Major Trading Area (the "Indianapolis MT A") which includes Carmel, Indiana. Copies of the licenses covering the Indianapolis MT A are attached to the Exhibit Book as Item Number 6. In order to meet its continuing obligations under the FCC license and to serve its customer base, Sprint pes must develop and maintain a system of "cell sites" to serve portable wireless communication handsets and mobile telephones. These "cell sites" consist of antennae mounted on poles, buildings or other structures, connected to small equipme!1t cabinets located near the antennae. The antennae feed the low power radio signals received from mobile communications devices through electronic devices located in the equipment cabinets and, ultimately, into an ordinary phone line from which the call can be routed to anywhere in the world. Cell sites are integral to the PCS network of Sprint PCS. To maintain effective, uninterrupted service to a PCS telephone user traveling in a given area, there must be a continuous interconnected series of cells, which overlap in a grid pattern approximating a honeycomb.. Additionally, each cell site must be located within a limited area so that it can properly interact with the surrounding cell sites and thereby provide reliable coverage throughout the cell.
