A commercial Sprint PCS site can only be located in a residential neighborhood zoned ~ 1 under specific circumstances dictated by the Zoning Ordinance and after a hearing before the BZA (the "BZA"). The property located at 1388 Queens Way does not comply with those circumstances as regulated by the Zoning Ordinance and no hearing was held before the BZA. The purpose of the S-l zoning district is "to provide for the development of innovative residential environments in keeping with the rural character of the district." Any interpretation of the standards of the Zoning Ordinance by the Director should be guided by this stated purpose. A commercial Sprint PCS Site, with an ancillary equipment building, is not in keeping with the purpose and intent of the S-l zoning district. According to the Director, the Sprint PCS Site is permitted because under Section 5.1.1 of the Zoning Ordinance (S-l District standards), an "Antenna," if collocated with an existing "Antenna," on an approved and/or existing tower, is a permitted use. However, the Director's analysis is flawed because the "term [Antenna] does not include the amateur radio station antennae" which is currently attached to the existing tower. As such, Section 5.1.1 of the Zoning Ordinance does not apply to the case at hand because there is no "Antenna" (as defined by Section 3.7 ofthe Zoning Ordinance) upon which the Sprint PSC Site antenna can collocate with. Consistent with Laurence Lillig's initial recommendation and Section 5.2 of the Zoning Ordinance, the Sprint PCS Site and the ancillary equipment building requires Special Use approval from the BZA. In addition to the Special Use approval required by the BZA, Section 5.2 of the S-l zoning district dictates that a variance must be obtained prior to placing the Sprint PCS Site antenna on the site because an initial "Antenna" must be located "on or within a structure other than a tower." If you could locate an Antenna on an amateur radio station tower (a permitted use), the whole purpose of requiring a special use for an Antenna could and would be circumvented. The 130 foot tower site is in its present location because Section 5.3.7 permits "private radio and television reception and transmitting towers and antennas. . ." Since the tower was originally constructed in 1987, it has been used solely for private purposes. The attorney for Mr. Zambers, in a letter dated February 22, 2001, stated that the location of the Sprint PCS Site and the ancillary equipment building will allow Sprint PCS to serve "its customers and the general public in this area." Such commercial uses are not private and should not be permitted on the private tower site without a public review of the proposed uses at the site by the BZA. Currently, if a church wants to attach an antenna to a church spire, a Special Use is required under Section 5.2 of the S-l Zoning Ordinance. In light of such requirements, it is hard to imagine how a commercial Sprint PCS Site, an ancillary equipment building and a paved access road can be constructed and permitted in a residential neighborhood, without a public hearing in front of the BZA. Comer lots and through lots are exempt from this paragraph 6. 35 o ZONING ORDINANCE o (7) When closer than ten (10) feet to main building, they shall be considered as part of the main building and shall be provided with the side and rear yards required for the main building; and (8) When more than ten (10) feet from a main building, they may be erected within five (5) feet, or easement plus three (3) feet, of a side or rear lot line, but not within any easement. 5.3.2 A private swimming pool may be permitted as an accessory use, but shall be located only within the side or rear yard.. No swimming pool or its deck shall be closer than ten (10) feet to the property line. For purposes for safety, the following shall apply: (1) walls or fencing deemed to be impenetrable by the enforcing authority, that is not less than five (5) feet high completely surrounding the swimming pool and the deck area with exception of self-closing and latching gates and doors, both capable of being locked; other means not less than five (5) feet high and deemed impenetrable by the enforcing authority at the time of construction and completely surrounding the pool and deck area when the pool is not used; and (2) a combination of subdivisions (1) through (2) that completely surrounds the pool and deck with the exception of self-closing and latching gates and doors which are capable of being locked; and (3) in conjunction with (1), (2), or (3) a safety pool cover may be used provided that: A there is a continuous connection between the cover and the deck, so as to prohibit access to the pool when the cover is completely drawn over the pool; B. it is mechanically operated by key or key and switch such that the cover cannot be drawn upon or retracted without the use of a key; c. it is capable of supporting a four hundred pound imposed load upon a completely drawn cover; D. it is installed with a track, rollers, rasils or guides; and E. bears an identification tag indicating the name of the manufacturer, name of the installer, installation date, and applicable safety standards, if any. AMENDED BY Z-261 & Z-272. 5.3.3 Tennis courts may be permitted as an accessory use but shall be located only within a side or rear yard. Open wire mesh fences surrounding tennis courts may be erected to a height of 16 feet if such fences only enclose a regulation court area and standard apron areas. Lighting of the court area shall not create more than five foot candles of light 25 feet from the court perimeter. 5.3.4 Quarters for bonafied servants employed by the occupants of the dwelling are permitted. 36 u ZONING ORDINANCE o 5.3.5 One guest house with cooking facilities may be permitted as an accessory building on lots containing not less than one (1) acre. 5.3.6 Accessory lighting is permitted; however, no lighting shall cause illumination at or beyond any lot line in excess of 0.1 foot-candles of light. . 5.3.7 Private radio, television reception and transmitting towers and antennae are permitted subject to applicable local, state and federal regulations. No structure shall be located or permitted within ten (10) feet of a power transmission line. 5.3.8 Accessory uses such as public utility installations, private walks, driveways, retaining walls, mail boxes, nameplates, lamp posts, birdbaths and structures of a like nature are permitted in any required front, side or rear yard. 5.4 Height and Area Requirements (See Section 26.0 for additional regulations.) 5.4.1 Maximum height: 25 feet. 5.4.2 Minimum lot area: A Lots without service by a community water system and a community sanitary sewer system, 43,560 square feet. B. Lots with service from a community water system, and private septic system, 35,000 square feet. C. Lots with service from a community sanitary sewer system and private water system, 25,000 square feet. D. ("Sprint PCS") by Thomas F. Bedsole and Richard S. Nikchevich, hereby respectfully submits this Written Appearance pursuant to Article VII, Section 5 of the City of Carmel and Clay Township Board of Zoning Appeals Rules of Procedure in opposition to Appellant's Appeal and states as follows: 1. Sprint PCS provides Personal Communic~tions Services in Carmel, Indiana and the remainder of the Indianapolis metropolitan area pursuant to a license from the Federal Communications Commission, and is the holder of Building Permit Number 2001.0627.B (the "Building Permit") for the installation of an Antenna facility (the "Sprint PCS Antenna") on an existing tower located at 1388 Queens Way Road, Carmel, Indiana (the "Zamber Tower"). 2. Appellant, Richard Deer, has filed the subject Appeal seeking a determination ~hat the Building Permit was not validly issued on account of the alleged failure by Sprint PCS to obtain a Special Use Permit pursuant to the Zoning Ordinance, Ordinance No. Z-160, as amended, of the City of Carmel and Clay Township, Hamilton County, Indiana (the "Zoning Ordinance"). 3. Section 5.1.1 of the Zoning Ordinance expressly permits an Antenna that is collocated on an existing or previously approved tower as a Permitted Use. The proposed Sprint PCS Antenna is to be collocated on the existing Zamber Tower. As such, the Antenna did not constitute a Special Use, and no hearing before the Board of Zoning Appeals (the "BZA") was required as a condition to the issuance of the Building Permit. 4. In the subject Appeal, Appellant claims that the Building Permit was not properly issued and quotes statements of the Director of the Department of Community Services (the "Director") allegedly made in connection with the issuance of the Building Permit: ". . . an 'Antenna,' if collocated with an existing 'Antenna,' on an approved and/or existing tower, is a permitted use." [emphasis in original]. The Appellant argues that because the Sprint PCS Antenna will not be collocated with an existing Antenna, the Sprint PCS Antenna is not a Permitted Use under the Zoning Ordinance. The Appellant's alleged citation, however, is not an appropriate quotation or application of Section 5.1.1 of the Zoning Ordinance. Section 5.1.1 actually states that an Antenna is a Permitted Use ifit is~ollocated with an existing or previously approved tower". [emphasis added]. Hence, Section 5.1.1 does not require collocation with an existing Antenna. 5. Appellant further states that the Sprint PCS Antenna and ancillary equipment building (the "Sprint PCS Site") require Special Use approval from the BZA and that "Section 5.2 of the S-1 zoning district dictates that a variance must be obtained prior to placing the Sprint PCS Site antenna on the site because an initial 'Antenna' must be located 'on or within a 128224_2 u u structure other than a tower'." Appellant, however, misstates Section 5.2. This Section actually states that an Antenna is a Special Use "if visually integrated with a camouflaged on or within a structure other than a tower (such as a chimney stack, church spire, light standard, monument, power line support; device or water tower)". [emphasis added]. As clearly stated by the plain language of the Zoning Ordinance. Similarly, Section 5.2 does not apply to Antenna to be located on an existing tower, hence it does not apply in this case. As a Permitted Use, the Sprint PCS Site does not require the approval of the BZA nor is a variance required before the issuance of a building permit. The erection of the Antenna on the existing tower will not circumvent the purpose of requiring a special use because the Zoning Ordinance allows, as a Permitted Use, an Antenna to be erected on an existing tower. The Zamber Tower has existed since 1987 and clearly constitutes an existing tower. 6. The Appellant also claims that the Sprint PCS Antenna would violate Section 5.3.7 of the Zoning Ordinance because it permits ''private radio and television reception and transmittal towers and antennas.. .", while the Sprint PCS Antenna will be used for commercial purposes. Section 5.1.1 allows an Antenna to be collocated on any existing or previously approved tower. The use (i.e., private versus commercial) of the Antenna is not afactor in determining whether it is a Permitted Use. Section 5.3.7 governs whether an amateur radio tower will be considered a Permitted Use. It is not relevant in determining whether the collocation of the Sprint PCS Antenna is a Permitted Use. 7. That the collocation of the Sprint PCS Antenna on the Zamber Tower is a Permitted Use under Section 5.1.1 of the Zoning Ordinance is supported by the actions of City staff. Specifically, not only did the City staff issue the Building Permit, but even Michael Hollbaugh's alleged revocation of the Building Permit was not premised on the grounds articulated by Mr. Deer, but on different grounds (see Exhibit A hereto)l. 8. Areas within a development that serve either a portion of or the entire development. (Example common area - signs, lighting, landscaping, maintenance shed, etc.) AREA, GROSS. Entire area of project or platted area. ASSESSED V ALUA TION. The monetary value placed on a property and/or building as established by the assessor with authority over the jurisdiction of this ordinance. BASEMENT. A story having part, but not less than one-half, of its height below grade. A basement is counted as a story for the purposes of height regulation if subdivided, used for dwelling purposes other than by a janitor employed on the premises and/or as walk-out access. BERTH OR BAY, LOADING AND UNLOADING. The off-street area required for the receipt or distribution by vehicles of material or merchandise, which in this Ordinance is held to be a twelve- foot (12') by forty-five-foot (45') loading space with a fifteen-foot (15') height clearance and paved with a hard surface in accordance with the current standards of the City ofCarmeJ. BLOCK. A unit or property bounded by one or more streets and by streets and/or railroad rights-of-way, waterways or other barriers. BLOCK FRONTAGE. Property having frontage on one side ofa street and lying between the two nearest intersecting or intercepting streets, or nearest intersecting or intercepting street and railroad right-of-way, waterway or other barrier. BOARD. The CarmeVClay Board of Zoning Appeals. BORROW PIT. An area of land from which earth is removed for use on another site and a permanent or temporary irregular terrain is created. BUFFER, GREENBELT. The area of a development which abuts the perimeter of the development and which is designed specifically to provide a buffer and visual screen to adjacent land. BUFFER OR SCREEN, SOLID VISUAL. May include, but not be limited to a minimum five-foot (5') high solid evergreen hedge; stone, brick or wood fence; earth mounding or other suitable material or any combination a minimum of five (5) feet in height. If a chain link fence (with or without screen slats) is used, a minimum of five-foot (5') high solid evergreen hedge shall be provided on the residential or commercial side of the fence. Open wire mesh fences surrounding tennis courts may be erected to a height of sixteen (16) feet if such fences only enclose a regulation court area and standard apron areas. Lighting of the court area shall not create more than five (5) foot candles of light twenty-five (25) feet from the perimeter of the court. 5.3.4 Quarters for bonafide servants employed by the occupants of the dwelling are permitted. 5.3.5 One guesthouse with cooking facilities may be permitted as an accessory building on lots containing not less than one (I) acre. 5.3.6 Accessory lighting is permitted; however, no lighting shall cause illumination at or beyond any lot line in excess of 0.1 foot-candles of light. 5.3.7 Private radio and television reception and transmitting towers and antennas are permitted subject to applicable local, state and federal regulations. No structure shall be located or permitted within ten (10) feet of a power transmission line. 5.3.8 Accessory uses such as public utility installations, private walks, driveways, retaining walls, mail boxes, nameplates, lamp posts, birdbaths and structures of a like nature are permitted in any required front, side or rear yard. 5.4 Height and Area Requirements (See Chapter 26 for additional regulations.) However, nothing shall prevent the use of a temporary construction facility for the storage of tools, material and equipment by a contractor during building construction. 25.1.2 No residential accessory building may be erected in front of a main building, or in the required front yard on the side of a comer lot, unless the accessory building is attached to the main building by a common wall. 25.1.3 A private residential garage or accessory building shall not exceed the living area of the primary structure. The combined square footage of the resident, garage and accessory building shall not exceed the maximum thirty-five percent (35%) lot coverage allowed. 25.1.4 Filling station pumps and light standards may be located in the required front yard, but not within thirty (30) feet ofland which is used or zoned for residential use. 25.1.5 Trash receptacles must be enclosed in all commercial and industrial areas. 25.2 .Ecnccs 25.2.1 On residentially used or zoned lots of less than two acres, fences located within any required front yard shall not exceed forty-two (42) inches in height, as measured from the topmost point thereof to the ground adjacent to the fence. At least twenty-five percent (25%) of its area shall be open as viewed on any line perpendicular to the vertical plane of the fence. Such open spaces must be reasonably dispersed throughout the entire area of the fence, except where solid stone or brick walls are permitted. 25.2.2 Residential fences located within any required side or rear yard shall not exceed six (6) feet in height, as measured from the topmost point thereof to the ground adjacent to the fence. 25.2.3 Residential fences not located within any required yard but within the buildable area shall not exceed nine (9) feet in height, as measured from the topmost point thereof to the ground adjacent to the fence. 25.2.4 Any fence placed upon an erected earth berm or masonry wall must govern its height as measured to the ground adjacent to said earth berm or wall. 25.2.5 Open wire mesh fences surrounding tennis courts may be erected to a height of sixteen (16) feet, if such fences shall only enclose a regulation court area and standard apron areas. 25.2.6 Fences enclosing an institution, a public park, schools, and commercial or industrial property may consist of an open mesh fence not to exceed a height of ten (10) feet. CITY OF CARMEL &: CLAY TOWNSHIP ZONING ORDINANCE 25.2.7 No sign, fence, wall, shrub or other obstruction to vision shall exist in the area designated as the vision clearance area of comer lots. 25.2.8 No fence shall be constructed within the approved subdivision retention/detention drainage facility easement. 25.2.9 No fence shall be constructed within the twenty-foot (20') mandatory planting strip associated with frontage places and hammerheads. (adopted per Z-318) 25.3 Mohile Home C-ourt!; 25.3.1 Each lot provided for the occupancy of a single mobile home unit shall have an area of not less than five thousand (5,000) square feet and a width of not less than fifty (50) feet, and each mobile home court shall provide a total gross court area of not less than five (5) acres. The maximum gross density of the court shall be ten (10) units per gross acre. 25.3.2 Each mobile home site shall abut or face a clear unoccupied space, driveway, public or private roadway, or street of not less than twenty (20) feet in width, which shall have unobstructed access to a public highway or street. 25.3.3 Space between mobile homes may be used for the parking of motor vehicles if the space is clearly designated. Each mobile home unit shall have two parking spaces. 25.3.4 The mobile home court shall be surrounded by a fifty-foot (50') wide landscaped strip. 25.3.5 A planting screen six (6) feet high is required where a mobile home court abuts a residential district. 25.3.6 The mobile home court shall provide a water distribution system and a sanitary collection system with conneCtion to a public sanitary system. 25.3.7 Adequate storm water drainage by surface and subsurface means shall be provided. 25.4 Recrp.ational Vehicle!; 25.4.1 Recreational vehicles may not be stored any closer to a lot line than three (3) times the maximum height of the recreational vehicle, except when completely enclosed. Non-motorized recreational vehicles may not be stored on a public right-of-way at any time. Motorized recreational vehicles may be stored on a public right-of-way for a period not to exceed ten (10) days per month. 25.4.2 At no time shall parked or stored vehicles be occupied or used for habitation as defined herein. 25.4.3 The owner of a recreational vehicle shall not park or store such vehicle in such a manner as to create a dangerous or unsafe condition on the property where parked or stored. Parking or storage of the recreational vehicle while not locked or chocked, whether loaded or not, shall be considered a dangerous and unsafe condition. 25.4.4 No recreational vehicle shall be connected to gas, electric, water or sanitary sewer service for purposes of habitation, except as cited herein. 25.4.5 Non-resident recreational vehicles may be parked in a front yard or driveway, not on the public right-of-way and used for habitation, including temporary connection to any appropriate utilities, Chapter 25: Additional Use Regulations 25-2 as amended per Z-307; Z-318; Z-310 ~ CITY OF CARMEL &: CLAY TOWNSJDP ZONING ORDINANCE .. for a period not to exceed ten (10) days per month. 25.5 Weed!;: and ~olid Wa!;:te~ 25.5.1 All developed or improved property in the Business, Industrial and Manufacturing Districts, and all developed or improved residential lots, shall be maintained so as to be free of weeds and other unsightly growth of plant materials. 25.5.2 Trash, garbage and all solid wastes shall not be stored outside of any building for a period of longer than seven (7) days, except when construction is in progress. 25.6 Grading. Grading, filling, excavating or any change in the grade of any property is permitted, but shall not be detrimental to surrounding properties in appearance or in the diversion of storm water. 25.7 Signs Signs shall be in accordance with the Cannel-Clay Township Sign Ordinance. 25.8 Temporary C-omrrrnction Facilitie~ Temporary construction facilities are permitted to remain on a job site during all phases of construction and must be removed within 30 days of the issuance of a Certificate of Occupancy. No permit is necessary for temporary construction facilities except where permanently connected to water and sewer utilities. 25.9 Orainage Any obstruction of the natural flow of drainage in the jurisdictional area of this Ordinance is prohibited. 25.10 R eqJliTed C-ommunity Facilitie~ When community facilities (water, sanitary sewer, and storm sewer) are required in a particular zone district and one or all of the public systems are unable to support an additional load, the Plan Commission may grant approval for use of an alternative method of providing the service or services with the provision that public facilities will be utilized when they become available. 25.11 Principal Owelling StnlchlTe - Minimum Width All single family or duplex dwelling units shall be required to be constructed with a width of no less than twenty-three (23) feet. 25.12 ~atellitp. All ground-mounted satellite receiving antennas shall be located only within the rear yard of any residential and commercial principal structure as defined by the CanneVClay Zoning Ordinance. 3. Satellite receiving antennas shall not be allowed on the roof of any principal or accessory structure. 4. Only one (I) satellite receiving antenna shall be located on anyone lot. 5. A satellite receiving antenna and support structure shall be limited to a maximum height ofthirtc.(.H (lJ) fifteen (IS) feet (amended per Z-310) 6. A satellite receiving antenna having printed matter on its surface shall be treated as a sign relative of the Cannel-Clay Township Sign Ordinance. 7. A building pennit shall be required prior to the erection of a satellite receiving antenna. 8. AU cables, wires and connectors from a satellite receiving antenna to other equipment shall be buried underground. 9. A satellite receiving antenna shall not be located within five (5) feet of any property line, easement or public right-of-way. 10. All satellite receiving antennas shall be obscured from the view of adjacent property owners of public rights-of-way by: buildings, screen wall, fence, berm, evergreen planting or any combination thereof. Such screening devices shall be at least eighty percent (80%) obscuring when viewed from adjacent property or public road right-of-way, as approved by the Department of Community Services, Plan Commission and/or Board of Zoning Appeals when applicable. 11. Towers shall be permitted in the Residential Districts only as special exceptions, and as such are subject to the approval of the Board of Zoning Appeals under Chapter 21 of the Zoning Ordinance. If a tower is located in an overlay zone, it may also be'subject to ADLS approval in accordance with the development standards established for that overlay zone. 2. T .igJttinf. A tower may not be illuminated by artificial means or display strobe lights unless such lighting is specifically required by federal or state law for that tower. However, when incorporated into the approved design of a tower, light fixtures that are used to illuminate athletic fields, parking lots, stadiums, or other such facilities may be attached to the tower. 3. I.and"l'.aping A fifteen-foot (I5') landscaped and maintained area, composed of trees not less than two and one half (2Yz) inches (caliper) in size (measured at forty (40) inches and spaced fifty (50) feet on center), and including a solid visual buffer or screen of at least five (5) feet in height, shall be provided on all sides of a tower, unless otherwise determined by the Commission (pursuant to ADLS review) or unless otherwise required by the Board for special use or special exception. 4. ~igJIllgr.. No sign (other than a warning or equipment information sign needed for health and safety purposes) may be affixed to a tower. 5. Interference Any telecommunications services provided or transmitted via a tower must comply with all federal and state laws regulating interference levels and emissions. 6. rnllnclltinn. In the case of an application for a special use or special exception seeking approval for the erection of a new tower, the Board shall, before approving such special use or special exception, require the applicant to make a written commitment that: a. if technologically feasible, the tower will be designed and erected in such manner that it can reasonably accommodate the equipment of up to four (4) wireless telecommunications service providers (however, if a public agency wants to locate its equipment on the tower, the agency may be counted as one of those service providers); b. the owner of the tower will offer to any wireless telecommunications service provider that seeks to collocate its equipment on the tower commercially reasonable lease or license terms, so as to accomplish the purpose of minimizing the number of such towers that must be erected in the Cannel/Clay community, and agree to submit any disputes regarding the commercial reasonableness of such terms to binding arbitration; and c. the owner of the tower will notifY the Director within thirty (30) days after any oral or written communication from a wireless telecommunications service provider inquiring about collocation on the tower, providing the Director with the name and address of the provider making the inquiry. . 7. F.nfnrcement. If, after thirty (30) days notice from the Board, a person subject to a binding commitment refuses to honor or abide by such commitment, the special use or special exception approval shall be revoked by the Board. 25.13.2 Snhmitt~1 ReqJJirement~~ I. Pint PllIn. An application for a permit to erect a tower must include a Plot Plan showing the proposed location of the tower. 2. Site PllIn. An application for a permit to erect a tower must include a Site Plan that shows not only the locations of all structures on the subject parcel but also the locations of all structures on adjacent parcels. 3. rnde rnmplillnCe. An application for a permit to erect a tower must include a report from a qualified professional engineer that: a. describes the tower_height and design including a cross section and elevation; b. documents the height above grade for all potential mounting positions for collocation of equipment and the minimum recommended separation distances between wireless telecommunications service antennas; c. describes the tower's capacity, including the number and types of antennas that it can accommodate; d. documents that the applicant will operate the tower and any attached antennas in compliance with applicable federal and state law; e. documents that the applicant has, before filing the application, investigated the possibility of collocation with the owners of all other towers in the vicinity; and f. includes any other information that may be reasonably requested by the Director as necessary to evaluate the application. 4. In~ctinn Before a tower is placed in service, the owner must submit to the Director a report from a qualified professional engineer that demonstrates that the tower complies with all structural and electrical standards. 25.13.3 Ahllndnnment nfTnwer. Ifa tower is abandoned or remains unused for a period of six (6) months, the owner shall remove the tower and all associated facilities from the site. Such removal shall be completed within twelve (12) months of the cessation of operations at the site.
