Sharp ORDINANCE D-1832-06 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, ADOPTING AND ADDING CHAPTER 8, ARTICLE 5, SECTION 8-47, SUBSECTION 8-47(3)(31) TO THE CARMEL CITY CODE WHEREAS, the Common Council is authorized and empowered to regulate vehicular parking within the City's corporate limits; and WHEREAS, it is in the best interests of public safety and welfare to prohibit vehicular parking on Shelbome Road from its intersection with 131 st Street to its intersection with 141 st Street, as the same is located within the City's corporate limits. NOW, THEREFORE, BE IT ORDAINED, by the Common Council of the City of Carmel, Indiana, as follows: Section I. The foregoing Recitals are incorporated herein by this reference. Section 2. Chapter 8, Article 5, Section 8-47, Subsection 8-47(a)(3l) of the Carmel City Code should be and the same is hereby adopted and shall read as follows: Sect. 8-47(a): "(31) On either side of Shelborne Road from its intersection with 131st Street to its intersection with 141 st Street." Section 3. The Carmel Street Department shall post appropriate signs and markings on the above- described public street. Section 4. The remaining provisions of Carmel City Code Chapter 8, Article 5, are not affected by this Ordinance and remain in full force and effect. Section 5. All prior ordinances or parts thereof inconsistent with any provision of this Ordinance are hereby repealed, to the extent of such inconsistency only, as of the effective date of this Ordinance. However, the repeal or amendment by this Ordinance of any other ordinance does not affect any rights or liabilities accrued, penalties incurred or proceedings begun prior to the effective date of this Ordinance. Those rights, liabilities and proceedings are continued and penalties shall be imposed and enforced under such repealed or amended ordinance as ifthis Ordinance had not been adopted. Section 6. If any portion of this Ordinance is for any reason declared to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portions of this Ordinance so long as enforcement of same can be given the same effect.
