CARMEL BOARD OF ZONING APPEALS HEARING OFFICER
DEPARTMENT REPORT
MONDAY, JULY 24, 2023
(V) Ott Detached Garage Variances.
The applicant seeks the following development standards variance approval:
1. Docket No. PZ-2023-00143 V UDO Section 5.02 (B)(1) Accessory buildings cannot be located
forward of any principal building on a corner lot, 65-ft in front of house requested along 116th St.
2. Docket No. PZ-2023-00146 V UDO Section 5.02 (B)(3) Maximum 24’x 30’ detached garage
ground floor area allowed, 30’ x 60’ requested. (And, the combined square footage of the ground floor
area of garages and/or accessory buildings shall not exceed 75% of the ground floor area of the
principal building, 129% requested.)
The 1.6-acre site is located at 11595 Freeport Dr. (Cypress Estates Subdivision, Lot 1). It is zoned
R1/Residence and Monon Overlay – Natural Section. Filed by Robert and Joyce Ott, owners.
General Info:
• The Petitioner seeks approval for a detached accessory building.
• The site is a Corner Lot that has two front yards – along 116th St. and along Freeport Dr.
• A private tennis court exists between the house and 116th St.
• Surrounding this site are single family residential homes to the south/west/east, and Engledow landscaping
company to the north across the street.
• There are only two other landowners in the subdivision, and they are supportive of the project.

Variances Requested:
Location -
• The UDO (Unified Development Ordinance) states that accessory buildings cannot be located forward of any
principal building on a corner lot, and approximately 65-ft in front of house is requested along 116th St. This
is a variance of 65-ft.
• The proposed structure will be located 100-ft away from 116th St. and 43 ft. away from Freeport Dr.
• The exterior materials will be brick and horizontal siding to match the existing house, and the roof will have
dimensional shingles.
• Trees, including evergreen trees, exist along 116th Street; however, additional landscaping will be installed.
Size -
• The UDO (Unified Development Ordinance) allows for a maximum 24’x 30’ detached garage ground floor
area (720 sq. ft.), and approximately 30’ x 60’ is requested (1,891 sq. ft.). (And, the combined square footage
of the ground floor area of garages and/or accessory buildings shall not exceed 75% of the ground floor area
of the principal building, and 129% requested.)
• The detached accessory structure will be used for a garage and a sport court, such as for pickleball.
Review Comments:
• The Petitioner addressed all planning/zoning review comments.
Final Comments:
• The Planning Dept. supports the variance requests.

Recommendation:
• The Dept. of Community Services (DOCS) recommends positive consideration of this variance request, and
with adoption of the Findings of Fact submitted by the Petitioner.
