Lot 97 of Lexington Farms was platted under the Cluster Housing Development provision of the Subdivision Control Ordinance in 1987. This section of the zoning ordinance stated that the minimum distance between two buildings in a side yard is 10-feet. Even though the City has repealed the Cluster Housing Development section of the Subdivision Control Ordinance, the Department does refer all owners of lots within cluster subdivisions to the Open Space Ordinance, Chapter 7 of the Subdivision Control Ordinance. Here, it exempts residential lots from the rear and side yard setback requirements, among others, while maintaining at least 6-ft of distance between buildings.
