BZA Public Notice Sign Procedure & Affidavit
Procedure:
The petitioner shall incur the cost of the purchasing, placing, and removing the sign. The sign must be placed
in a highly visible and legible location from the road on the property involved with the public hearing.
The public notice sign shall meet the following requirements.-
1 . Must be placed on the subject property no less than 20 days prior
to the public hearing date.
2. Sign must follow the sign design requirements:

PETITIONERS
To Whom It May Concern,
Rob Shea at Oasis Outdoor Living and Landscapes is applying on behalf of property owner Ken
Lovick for a variance on existing zoning code to allow construction of a pool, patio and covered
structure 9’ into the existing drainage easement.
The current regulations of the city state a 3’ buffer outside of the drainage easement. With
support from the HOA and approval from Hamilton County, we seek this variance to ensure that
we can safely and professionally install an inground fiberglass pool and patio as to not interfere
with the existing home and deck structures. The pool is average size for the city and measures
35’ x 14’. These pools require an overdig of 4’ around them to allow for proper plumbing and
the homeowner would like room for safe mobility around all sides of the pool and to exit safely
on all sides as needed. This design places the pool and patio as close to the house as possible
while maintaining adequate walks and over dig practices during installation. This project would
not be cost effective to have to adjust the existing home or deck to accommodate for an average
size pool in this neighborhood. Proper drainage will remain with permeable pavers and drain
pipes away from the home to the easement for positive flow to the rear.
