Based on the landscape plan, Lattice failed to install 11 river birch. Cinergy has removed 2 trees in the last year due to storm-related occurance and 2 trees need to be removed for safety/reliability reasons. In all, 15 trees need to be planted to comply with ours or Lattices agreement with the city. I want to move this through and get done this spring. Let me know what, if any of Cinergy's responsibility will be. If Lattice is involved I want to see their plan first in order to protect our interests which were not protected with the initial installation. If Cinergy is to take responsibility for some or all of it let me know and I can get you a cost estimate. Thanks. If so Global should take the lead and we should approve any location of plantings. I would like to make sure we are not solving Globals problems. I appreciate Toms willingness to work with the City. There are still about 14 trees that need to be planted. 10-11 birch and some existing trees that were removed. I would like to go over the plan or meet out there and find an area to plant these trees so that they do not interfere with the overhead lines. I understand the past problems and I think getting the trees in a suitable area can be found. Let me know what you would like to do. The original plan was not approved by Duke and therefore modifications at this time will be made in order to eliminate future maintenance concerns. This letter is being sent to serve as confirmation Duke will honor the original agreement with the city with the modifications previously discussed with you. In order to create a species composition that is more diverse I decided to deviate from the original plan. A combination of bald cypress (4), swamp white oak (1), willow oak (4) and river birch (4) will be placed in this general area. The original plan was saturated with river birch. River birch (4) planted too close to overhead power lines on the north side of the sub will be transplanted with the new plant material on the west to southwest side of the substation. In all 14 trees that were never planted under the original agreement will be planted. Some sizes are slightly larger in order to compensate for the delay in planting. Our contractor, Cicero Lawn & Garden, has been given the expectation to complete this project by October 31 , 2006. Please do not hesitate to contact me if you have any questions.
