The applicant seeks the following development standards variance approval: 7. Docket No. PZ-2023-00177 V UDO Section 5.09(C) Maximum 6’ tall fence along side/rear property line allowed, 8’ requested. The site is located at 107 Bennett Rd. (Village of Mt. Carmel Subdivision Lot 50). It is zoned S2/Residence. Filed by Kevin Brennan, owner. General Info: • The Petitioner seeks approval for an 8-ft tall privacy wood fence along a portion of the side property line. • The site is located in the Village of Mt. Carmel residential neighborhood. • Surrounding this site are single family detached residential homes. • A Homeowners’ Association does not appear to exist for this neighborhood. • Please see the Petitioner’s info packet for more detail on the variance request. Variance Requested: Fence Height - • The UDO (Unified Development Ordinance) allows for a maximum 6 foot tall fence along the side and rear property lines, and the Petitioner requests an 8 foot tall fence along certain portions of the side property line. This is a variance of 2 feet or a 33% change. • The proposed fence structure will be located along the south property line and also perpendicular to the side of the house. It will begin approximately 75-ft back from the street. • The section of fence that will be 8-ft tall in height will only be 48- to 57-feet long. The rest will be 6-ft tall. Review Comments: • The Petitioner addressed all planning/zoning review comments. Final Comments: • The Planning Dept. supports this variance request. Findings of Fact: • Please refer to the Petitioner’s Findings of Facts included in their BZA Info Packet. Recommendation: • The Dept. of Community Services (DOCS) recommends positive consideration of this variance request, and with adoption of the Findings of Fact submitted by the Petitioner. • (Please note that a Fence Permit application still needs to be finalized, if not yet done.)
