RESOLUTION OF THE CARMEL/CLAY BOARD OF PARKS AND RECREATION REQUESTING
ESTABLISHMENT OF A NEW CASH ACCOUNT WITHIN PARKS AND RECREATION NON-REVERTING
CAPITAL FUND 103
The Carmel/Clay Board of Parks and Recreation (the “Board”) met at a duly called and
authorized meeting of the Board held on the date set forth below, such meeting being called pursuant
to a notice stating the time, place and purpose of the meeting received by all of the Board Members,
and the following Resolutions were made, seconded and adopted by a majority of those present at
the meeting, which constituted a legal quorum of the Board.
WHEREAS, the Board is a political subdivision created and authorized to administer the
Carmel/Clay Department of Parks and Recreation (the “Department”) pursuant to that certain
agreement entitled “Interlocal Cooperation Agreement” signed by the respective authorized officials of
Clay Township, Hamilton County, Indiana (the “Township”) and City of Carmel, Indiana (the “City”) on
July 30, 2002 and effective January 1, 2003, as amended from time to time; and
WHEREAS, the Interlocal Cooperation Agreement Section 6.4 allows the Board to request the
establishment of a special non-reverting capital fund for the purpose of acquiring land or making specific
capital improvements; and
WHEREAS, the Parks and Recreation Non-Reverting Capital Fund has been duly established by
the City within Carmel City Code Section 2-122; and
WHEREAS, the Township is obligated under the Interlocal Cooperation Agreement to make any
distribution of Local Income Tax (“LIT”), previously referred to as County Option Income Tax (“COIT”),
attributable to Carmel/Clay Central Park (the “Central Park LIT”) available for capital expenditures
budgeted by the Park Board; and
WHEREAS, the Township has historically deposited the Central Park LIT within the Township’s
Park Capital Non-Reverting Fund 1215 consistent with the terms of the Interlocal Cooperation
Agreement; and
WHEREAS, the Indiana State Board of Accounts (the “SBOA”) notified the Township that
effective in 2023 all Central Park Bond LIT may only be deposited within and expended from the
Township’s General Fund, therefore making it more difficult to track the Central Park LIT to ensure
compliance with the Interlocal Cooperation Agreement; and
WHEREAS, the Township has confirmed with the SBOA that the Central Park LIT may be paid to
the Park Board and deposited within the City’s Parks and Recreation Non-Reverting Capital Fund 103
without violating SBOA Rules; and
WHEREAS, the City Controller has confirmed that a new Cash Account may be established within
Fund 103 to clearly segregate and track all Central Park LIT funds received from the Township; and
WHEREAS, Carmel City Code Section 2-122(a)(3)(a) requires the written agreement of the City
and Township to authorize expenditures from the Parks and Recreation Non-Reverting Capital Fund 103,
ensuring the Township retains a level of control over the expenditure of the Central Park LIT.
NOW, THEREFORE, BE IT RESOLVED that the Carmel/Clay Board of Parks and Recreation
requests the City Controller to establish a new Cash Account within the Parks and Recreation Non-
Reverting Capital Fund 103 for the receipt of the Central Park LIT and titled as such.
Adopted and approved by the Carmel/Clay Board of Parks and Recreation this 14th day of
March 2023.
