VILLAGE GREEN ENVIRONMENTAL IMPACT
Rezoning 211 West Smokey Road in Cannel Indiana from R2- Single Family Residential
to The Village Green Planned Unit Development (VGPUD) is bad for the environment
and the people of Carmel for three reasons.
First the VGPUD is situated on a flood plane as identified on the attached FEMA Flood
plane map. This flood plane results from the watershed of Little Cool Creek that runs
across and adjacent to the VGPUD. The dark shaded area is the flood plane surrounding
Little Cool Creek.

This area has only been developed as Single Family Residences as it is only suitable for
a few Single Family Homes, the horse grazing pasture and the heavily wooded area that
currently exist there. Here is a photo of the area as it looks today:

Petitioners Rezone Procedure
1) The Carmel Clay Plan Commission must f11:st review the petition for
rezone. Contact Ramona Hancock at 317-571-2412. Ramona may also
be reached at rhancock@ci.carmel.in.us
2) The Plan Commission secretary must provide the Clerk- Treasurer's
Office with the Plan Commission Certification which indicates the
official recommendation of the Plan Commission. An Ordinance
number will not be issued until one is requested by the Department of
Community Services.
3) The Department of Community Services must contact the Clerk-
Treasurer's Office to obtain an Ordinance number and to discuss the
date the Ordinance will be heard by the Common Council. The
Ordinance must be heard at a public hearing.
4) Petitioner (petitioner's attorney) is responsible for obtaining a sponsor
for their Ordinance.
5) Petitioner must publish the public notice in The DailY Ledger at least 10
days before the desired public hearing date. A sample public notice and a
copy of Carmel City Code Sec. 3-32 requiring public notice may be
obtained from the Clerk-Treasurer's Office. No rezone requests will be
placed on a City Council agenda unless they are published at least 10
days before the desired hearing date.
6) Petitioner must send a copy of the proof of publication to the Clerk-
Treasurer's Office as soon as it is obtained from the newspaper.
7) Rezone requests require a public hearing and two readings before the
Council. The public hearing may be heard at the f11:st meeting.

8) The petitioner must prepare 8 packets. Please have line numbers printed
in the left margin of the ordinance that will be distributed to
each Council member (if each page is numbered at the bottom you do
not need to have numbers run continuous per page). Deliver packets to
the Clerk- Treasurer's office by the agenda deadline date (an electronic
version of the Ordinance is also required to be forwarded to the Clerk-
Treasurer afrne@ci.carmel.in.us). Packets must include a copy of the
Ordinance, map, legal description and any other correspondence or
documentation the petitioner deems helpful to his request. The Clerk-
Treasurer's Office will disseminate the packets to the appropriate
recipients. In addition to the 8 packets, the petitioner must supply the
Clerk-Treasurer's Office with one original (DO NOT add line numbers
in the left margin on the original document) of the rezone Ordinance.
The Clerk-Treasurer's Office must receive the packets and original
Ordinance in accordance with the deadline for Council meeting agendas
(City Code 3-19)
9) After the first reading, the Ordinance may be heard by a standing
committee of the Council. The committee assignment is made by the
President/President Pro Tempore.
10) Amendments to ordinances may be added at the first or second reading
by simple majority vote. Each and all amended versions of City
ordinances pending before the Common Council for its consideration
shall clearly indicate, in the lower left hand corner of every page thereof,
the time and date on which the same is printed.
11) Shortly after Council approval, the Ordinance will be available to the
petitioner and any other interested parties on LaserFiche. The original
Ordinance will be retained in the Clerk-Treasurer's Office.

Please add to item No.1 of the unresolved issues that the commitment for upgrades to
Smokey Row Road shall be as provided by the petitioner via email to Engineering on April
21, 2006, less the improvements to the existing bridge. The commitment for the roadway
improvements prescribed by the Thoroughfare Plan would be equal to $82,669 per the cost
estimate provided by the petitioner. The Department would also expect that the existing
sight distance issue associated with the location of the entrance to the development be
constructed by the petitioner and that these costs would be exclusive of the commitment
(cannot credit against the commitment). The Department will work with the petitioner on an
acceptable solution to the sight distance issue at the next stage of approval.
As it relates to Item No.2 of the items requested at the last meeting, a proper path to
the west should include construction of a pedestrian crossing of Little Cool Creek.
Construction of such a bridge would result in a level of commitment/participation from the
developer that is substantially higher than commitments/participation provided by recent,
similar developments when considering the request for roadway improvements and remedying
the existing sight distance issue. The Department suggests that the petitioner extend the
existing culvert as necessary to facilitate the construction of the path across the
frontage. The path may need to be angled out towards the road as it approaches the
slightly widened culvert. Construction of the path from the proposed entrance to the west
property line is included in the requested commitment above. Therefore, construction of
the multi-use path across the frontage as well as extension of the pipe culvert may be
credited against the above requested commitment.
In any approvals by the Plan Commission, the Department requests that such approvals be
conditional upon incorporating Items 16, 24, 25, 27 and 34 of a letter dated January 17,
2006 from Engineering to the petitioner into the final construction drawings.
All other previous comments/issues have been satisfactorily addressed.

Enclosed is the location of the Visual Tree Assessments that were performed for the Village
Green development. A total of 14 trees were assessed in the construction zone.
These 14 trees were comprised of 5 trees species: 5 black cherry (prunus seratina), 4 ash
(Fraxinus sp.), 3 sycamore (Platanus occidentalis), 1 American beech (Fagus grandifolia), and 1
black walnut (Juglans nigra). It was determined that removal is recommended for 10 of the 14
trees that were assessed.

Enclosed is the wetland study requested by the Special Study Committee at their last
meeting. The consultant has found that there are wetlands that will be impacted by the
project.
We have submitted the study to the Corps of Engineers for the review and comment on
wetlands and potential Waters ofthe US conflicts. As you are aware from the Cities
mitigation efforts on the Carmel City Center and Illinois Road projects, mitigating those
issues is a routine part of land development.
In anticipation of requests by the Corps of Engineers, we have submitted a site plan
showing one possible solution to this issue. We understand that the design of the
mitigated wetlands will be a part of construction plan approval.

Enclosed please find information regarding a wetland delineation completed by Williams Creek Consulting, Inc.
(WCe). The field work was conducted in April of 2006. WCC identified two wetlands, Little Cool Creek, and the JW
Morrow Legal Drain. Wetlands A and B are forested wetland systems and are within the 100 years floodplain of Little
Cool Creek, therefore may be considered jurisdictional. JW Morrow Legal Drain appears to have been constructed
for stormwater drainage in upland and hydric soils. Please review the historical aerials to verify concurrence that the
feature may not be considered regulated by the USACE.
If you have any questions or need additional information, please contact me at your earliest convenience. If a site

First let me thank you for meeting with our Village Green team. The time you gave us in your
busy schedule underscores the importance you place on great development in the City of Carmel
and particularly along the Monon Trail.
Most of the issues we face in the Village Green community are similar to all new developinents,
traffic, density, and storm water management. We have outstanding consultants, Steve Fehribach
from A&F Engineering, and Jim Shields from Weihe Engineers, to ensure we get those issues
right. We believe the plans we have submitted exceed all the standards and look forward to
confirmation from your staff.
Of particular importance to this development is our relationship to the Monon Trail and the
natural environment. At the very beginning of this project we employed the services of Jud Scott,
,. Vine and Branch, to work with us to protect the natural features that make this a great location.
Mr. Scott and our landscape architect, John Lapp, Parsons and Associates, have developed a set
of plans for protection of trees and new landscaping to enhance this site.
In response to your concerns about the homes relationship to the Monon, we have developed new
elevations for the front and back of those homes along the Monon that have incorporated your
recommendations. I have enclosed those new elevations that reflect your and our desire to
provide an outstanding view of these buildings from the Trail. They combine extensive brick
with minor use of cement fiber siding to provide additional texture.
Drees Premier Homes and our partner, Bay Development, look forward to a new community that
will set the standard for urban living in a natural setting for Carmel and Indianapolis. I want to

Additional Traffic Data and Analysis
Based on comments submitted within the City of Carmel Department Report, A&F Engineering
conducted an additional analysis at 136th Street & Rangeline Road and at 1361h Street & the proposed
"Village Green" access using traffic counts that were collected in late August 2005. These counts were
taken while school was in session for another project which A&F Engineering completed. Based on the
analysis of the August counts, along with the "Arden", "Traditions on the Monon" and "Village Green"
projected traffic volumes, the intersections will operate at levels of service that are equal to the results
published in the original traffic study.
The following summarizes the results obtained with the August traffic counts.

We have reviewed the plans submitted for review at the January 18, 2006 Technical Advisory Committee
meeting. We offer the following comments:
GENERAL INFORMATION
1. The project site is located within current City of Carmel Corporate Limits.
2. Jurisdictions:
. Streets and Right of Way- City of Carmel (136th Street/Lark Drive)
. Water - City of Carmel Utilities
. Sanitary Sewers - City of Carmel Utilities
. Storm Sewers/Drainage - City of Carmel.
. Legal Drains - Hamilton County Surveyor's Office.
3. Board of Public Works and Safety Requirements:
. Water Availability and Sanitary Sewer Availability approval from the Board is based upon the
total number oftownhome units and number of bedrooms per unit. Reference item #11 below
for a more detailed expl.anation. If a community swimming pool or bathhouse is planned,
additional Water and Sanitary Sewer Availability approval from the Board will be required
and additional Water and Sanitary Sewer Connection Fees will be assessed. If entryway or
other community irrigation systems arelplanned, these will also require additional Water
Availability approvalfrom the Board a~d additional Water Connection Fees will be assessed
based upon the size and usage of the system.
. Commercial Curb Cut Approval- This approval will be required for the 136th Street entrance
and possibly for the Lark Drive connection, depending on what is planned at that location.
Provide a letter to this office requesting BPWS Commercial Curb Cut approval. Provide an 8
Y2 x 11 exhibit or exhibits detailing the requested curb cut(s) with all appropriate dimensional
data includinKwidth, radii, acel/decel/passingblister dimensions, existing and opposing
streets or drives, etc. .
. Temporary Construction Entrance approval if the location is' at a site other than a permanent
curb cut on either 136th Street or Lark Drive. Submission requirements are the same as for
commercial curb cut.
. Any permanent improvement to be installed within dedicated right of way or dedicated
easements. This approval would require a Consent to Encroach Agreement between the
Owner and the City of Carmel.
. Secondary Plat approval if applicable.
. Dedication of Right of Way if not platted.

I am also enclosing a schedule for Board of Public Works and Safety meeting dates and agenda
deadlines for your use. Please use the Engineering Department deadlines for submissions to the
Board.
Any submission to the Board requires prior approval by the Carmel Clay Plan Commission
and/or the Board of Zoning Appeals (if applicable) and completion of review by the Technical
Advisory Committee. All written requests to be placed on the Board's agenda must include the
appropriate Docket Number and the date (or dates) of approval by the Plan Commission and/or
the Board of Zoning Appeals (if applicable).
4. T.A.C. Review/Drawings submitted for approval:
We request that all comments and comment letters generated by this office be answered in writing
and be accompanied by a drawing reflecting requested revisions. Final drawings will not be
approved for construction until all Engineering Department and Utility Department issues have
been resolved. The design engineer must certify all drawings submitted for final approval. This
office will require a minimum of five-sets of drawings for approval after all issues have been
resolved. The drawings will be stamped as approved and will be signed by the City Engineer and
Director of Carmel Utilities. The Owner will receive one-set which is to be maintained on the
construction site at all times. Carmel Utilities will receive two-sets, our Public Works Inspector
will receive one-set and one-set will be maintained in the Engineering Department. If additional
approved sets are desired, we will approve a maximum of two-additional sets. However, the
additional sets must be submitted with the required five-sets.
5. Please be advised that any installation of signs, walls, irrigation systems, etc. within dedicated
right of way or dedicated easements will require a Consent to Encroach Agreement with the City
of Carmel. This agreement, with the exception of irrigation systems, requires BPWS approval.
The City Engineer may approve irrigation system agreements.
6. Carmel Utilities should be provided drawings for review of water and sanitary sewer issues. They
will provide a separate review regarding these issues. .
7. Carmel Utilities does subscribe to "Holey Moley" who should be contacted directly for all water -
main and sanitary sewer main locations.

BONDING REOUlREMENTS (
. 9. Upon initial review, it appears the following bonding requirements may apply to this project:

. Sidewalks (Interior-builders lot right of way sidewalks and Exterior-common area/perimeter
right of way sidewalks/asphalt paths may be bonded separately).
. Right of Way Improvements may be bonded separately. This could include accelldecellanes,
passing blister, pavement widening, thermoplastic striping, stone shoulders, curbs, etc.
Erosion control may require a Performance Guarantee. This will be determined later.
The amount of the Performance Guarantee is based upon a certified Engineer's Estimate for 100%
of the cost of labor and materials to construct the individual improvements, to be provided by the
design engineer. Please provide detailed Engineer's Estimates for each improvement including

quantities, unit costs, pipe sizes and materials, etc. Upon completion and release of individual
Performance Guarantees, a three-year Maintenance Guarantee will be required. The Maintenance
Guarantee amount is based upon 15% of the Performance amount for Streets and Curbs and 10%
of the Performance amount for all other improvements. Performance Guarantees may be
Performance or Subdivision Bonds or Irrevocable Letters of Credit. Please reference the
enclosures for more detailed explanation of our procedures.
Right of Way Permit and Bonding
Any work in the dedicated right of way of 136th Street and/or Lark Drive will require an approved
Right of Way Permit and a License & Permit Bond. The bond amount is determined by the
number of instances of work in the right of way at $2,000.00 per instance. However, if the work is
included in the scope of work of a required and posted Performance Guarantee, the Performance
Guarantee may be used to satisfy the bond requirements of the Right of Way Permit.- Please
contact our Right of Way Manager, Fred Glaser, to arrange right of way permitting and bonding.
10. We have engaged Crossroad Engineers, PC to review all drainage plans and drainage calculations
submitted to this office for review. We will share Crossroad's comments as they are received.
When construction plans are submitted for review for this development, please provide a set of
drawings and drainage calculations directly to Crossroad.
AVAILABILITY AND CONNECTION FEES
11. Availability (acreage) Fees must be paid after all other Engineering Department requirements
have been satisfied and prior to approval and start of construction activities. Availability Fees are
based upon total platted acreage or legal description acreage for the development at the current
rate of$1,010.00 per acre for Water Availability and $1,365.00 per acre for Sanitary Sewer
Availability.
Based upon the indicated acreage on the primary plat, the following Availability Fees would
apply:
Water - 9.0 Acres @ $1,01O.00/Acre = $ 9,090.00
Sanitary Sewer - 9.0 Acres (tV, $1.365.00/Acre = $12.285.00
Total Availability (acreage) Fees $21,375.00
Connection Fees-Based on the drawings submitted, there appear to be 10-buildings with a total of
50-single family townhome units. Please provide this office with a listing of the buildings, units
per building and number ofbedroorns per unit. The current Water Connection Fee is $1,310.00
per EDU. The current Sanitary Sewer Connection Fee is $795.00 per EDU totaling $2,105.00 per
EDU/single family residence. Connection Fees are paid when the infrastructure has been
completed, satisfactory test results obtained and the development has been released for building
permits. Connection Fees are paid on a building-building-lot basis. The EDU calculation is based
on the following:
I-Bedroom Unit @ 0.54 EDUs per Unit
2-Bedroom Unit @ 0.81 EDUs per Unit
3-Bedroom Unit @ 1.00 EDU per Unit
The Availability and Connections Fees are current as of this date but are subject to future
revisions.
If an irrigation system, swimming pool or clubhouse is planned for this' development, additional
Water and/or Sanitary Sewer Connection Fees will be assessed based upon the
recommendations of the Director of Carmel Utilities.
PROJECT COMMENTS
12. Please provide concrete monuments at all external comers.
13. Please indicate and label the existing and proposed rights-of-way of 136th Street.
14. On Sheet C002, please rotate some of the text so that it can be read from the bottom of the sheet or
from the right side of the sheet.
15. Any open cuts of the 136th Street pavement must be approved by the Board of Public Works and
Safety.
16. Please indic~te the construction of the full road cross-section, including curbing adjacent to the
parking spaces.
17. The asphalt path must be 10 feet wide instead of the 8 feet shown.

18. Please label the 136th Street parking spaces as 10-foot parking spaces.
19. Please indicate the curb return radii at the 136th Street entrance as 40-foot radii.
20. The cross-section of 136th Street must conform to the same cross-section (i.e. distance from the
centerline to the face of curbs) as Traditions on the Monon.
21. After a review of the plan, due to the short distances from the inlets to the detention pond, the
Department requests eliminating the two southern drainage runs between the buildings and
installing this pipe in the right-of-way and into the pond. In laying out this run, please keep
manholes out of mainline pavements and curbing and ensure piping is not installed under mainline
paving or curb. If not possible, please contact the Department of Engineering to discuss.
22. The storm sewer system must be stubbed out to 136th Street to drain the right-of-way. The
Department of Engineering cannot remember if this was discussed in the past, but per comment
#25 below, the Department of Engineering standard is to provide detention for the fully developed
right-of-way per the thoroughfare plan across the frontage.
23. Having lots 25, 26, and 9 encroach into the legal drain easement may be problematic in the future.
Please separate.
24. Please contact Crossroad Engineers to obtain drainage review checklist for consideration in
developing secondary plat and that design effort. The Department would expect the secondary
plat and construction drawings submitted to conform to the requirements of the checklist.
25. Please provide detention volume for the fully developed site and for the fully developed
thoroughfare plan right-of-way for the 136th Street frontage. This requirement shall apply
regardless of watershed limits. Please provide adequately sized pipes to carry water from the
street to the proposed ponds.
26. If off-site easements will be necessary to install the utilities, these easements must be secured prior
to the Department of Engineering approving the drawings.
27. Please provide ADA ramps where the entrance crosses the asphalt path and at all interior street
intersections.
28. The Department requires that the construction drawings be developed in accordance with the City
of Carmel digital submission standards and that all required submittals for primary plat, secondary
plat, and construction drawings be made.
29. The City has adopted a new paving policy. Please revise any notes, specifications, and details to
accommodate this policy. The language of these policies must be added to a specification sheet on
the plans.
30. The City has adopted a new curbing policy. Please revise any notes, specifications, and details to
accommodate this policy. The language of these policies must be added to a specification sheet on
the plans.
31. Is the 72" RCP in the southeast comer deep enough below the IS" RCP crossing over it?
32. Lots must be indicated such that they do not encroach into the IS-foot easements.
33. For the north-south street in the southwest ?orner, indicate and label the right-of-way and roadway
widths, indicate as a one-way street to the south, and indicate curbing on both sides.
34. The walk is outside the right-of-way along the 6-foot parking spaces on the north side of
Greenford Pointe. The walk must be in the right-of-way or an easement must be provided.
35. We will review the north lake when more detailed drainage information is provided. As we
discussed, please review this plan with the IDNR. '
36. 136th Street was recently milled and resurfaced, so even though this is a standard request, we are
waiving this requirement.
37. Please confirm with the Department of Community Services the need for some type offence or
protective screen adjacent 'to the detention pond where the ponifis adjacent to the Monon
These comments represent the Department of Engineering's initial review of the primary plat for this
project. We request that all responses to our comments be provided in writing. Failure to provide written
responses may result in the delay of the review process.
It is critical that this office be made aware of all modifications made on the plans being re-submitted,
particularly if any such changes are considered "new" or fall outside of our previous reviews. Please
provide revised plans including all revisions. Please notify us of any changes and specifically state any

All bonds and performance guarantees must be posted prior to Engineering Department approval of
construction plans. Board of Public Works and Safety approvals and any other governing agency approvals
(if required) must be obtained prior to Engineering Department approval. All performance guarantees must
be posted prior to submission of secondary plats for Board of Public Works and Safety approval.
The Department reserves the right to provide additional comments based upon subsequent reviews and on
the grading and drainage system upon receipt of drainage calculations and more detailed construction
drawings that provide grading elevations, pipe sizing and invert elevations. These comments may affect
the drainage system layout presented on the primary plat.

Dear Mr. Shinaver:
We have reviewed the concept plans submitted to the Hamilton County Surveyor's Office on
January 4, 2006, for this project and have the following comments:
1. The proposed project falls in the incorporated area of'the City of Carmel
2. The proposed project DOES partially fall in a Carmel Wellhead Protection Zone.
3. The proposed project falls in the Marrow - Follett Regulated Drain Watershed.
4. Please note this site will be required to comply with the new Hamilton County
Stonnwater Management Technical Standards Manual, along with any additional
requirements &om the City of Carmel Manual
s. Per IC 36-9-27-36, the minimum reduction allowed on an open regulated ditch is
25' ftom the TOB on both sides. The current proposal shows a 30' easement,
which will only be allowed on the tile potion of the regulated drain.
6. The HCSO does not believe the proposed relocation of the regulated drain will
not have a negative impact of the drainage system. The proposal adds several
sharp turns to the drain and new manholes, which will provide restrictions to the
flow. Also, how will a 72" pipe have cover on it when it runs in the bank on the

pond? How would maintenance work ever be preformed on this new 72" pipe
when you have a pond on one side and a building on the other? Where would you
stack the spoils? How will the 15" Rep cross the 72" RCP?
7. The HCSO would suggest routing the 72" drain thru the pond with a staged
orifice systems to control the release rate for the onsite detention. Please contact
Cor additional information.
8. No landscape planting will be allowed within the proposed regulated drainage
easements per Indiana Code 36-9-27-33(d). The current landscape plans shows
trees being located within the regulated drain easement. Please revise.
9. Please submit complete constnlctton plans~ the secondary pla~ and drainage
calculations to this office when they become available.
10. The Hamilton County Surveyor's Office has no objections to the rezone.
