Dear Thanh: At the meeting held on Monday, August 28, 2023, the Carmel Board of Zoning Appeals Hearing Officer took the following action regarding the Development Standards Variance (V) request filed by you for the property located at 3240 E. 104th Street: APPROVED WITH CONDITION: 3240 E. 104th St. Fence Variance - Development Standards Variance approval for: • PZ-2023-00147 V: Maximum 42-inch fence allowed in the front yard; 72 inches granted. Also, minimum 25% visibility required; 0% visibility granted. • CONDITION: The Petitioner agrees to installing a sidewalk along their street frontages (or paying into the Throughfare Fund) if/when the City ever installs sidewalks along their streets. Please be advised that per Article 9.15 of the Unified Development Ordinance, the aforementioned Development Standards Variance approval is valid for three (3) years. By that time, either continuous construction of the improvements must be underway, or a written request for a one-time, six-month extension of the approval must have been received and approval granted by this Department. The expiration date of the approval is August 28, 2026. Please include a copy of this letter with any permit application.
