review of December 29,2004.
The comments from the City review have been satisfactorily addressed. Please submit all copies necessary

be posted prior to Engineering Department approval. Also, Board of Public Works and Safety approval (if

Dear Mr. and Mrs. Roller:
This letter is to notify you of a proposed landplan revision to the Village of West Clay Section 12002-B,
the section that adjoins the western boundary of your property. These changes have been proposed in a
set of construction plans and secondary plat submitted to the City of Carmel on November 30, 2004.
The proposed landplan revision removes the street stub that was proposed as an extension of Hourglass
Drive to your west property line. The street stub has been removed and the internal road from the south
(Milford Street) has been extended north to the Perez homestead. The lot configuration has been adjusted
along the new street layout.
This proposed revision is graphically illustrated on the "Stub Street Exhibit" enclosed with this letter.
The exhibit indicates the previous street stub to your property, as well as the revised street layout with the
street extension to the north.
The City of Carmel requested that we notify you of this proposed change to allow you the opportunity to
express concerns with the modification. In the event you are concerned with our proposal please feel free
to contact myself or Jon Dobosiewicz at the City of Carmel (571-2417) to further discuss our proposed
reVISIon.

Please send correspondence to the adjacent land owner of the land to the east of section 12002-B to let him/her know about
the change in the direction of the stub street. (and please CC: DOCS). Please include in the letter that the owner should
contact DOCS if they have a problem with the change in the direction of the stub street. If there is no concern by the
adjacent property owner, then the secondary plat will be approved/signed by the Director. If there is concern by the adjacent
land owner, then DOCS will have to revisit the secondary plat design.

Dear Jon,
Please fmd enclosed a revised set of construction plans for the Village of West Clay Section 12002-B. I'm
resubmitting construction plans to your attention to make you aware of a change to this project.
The construction plans and secondary plat went to a March 17,2004 TAC meeting at the City of Carmel.
The project was submitted as one overall project, Section 12002. It was then split into two sub-sections
12002-A and 12002-B. The overall sets of construction plans received approvals from all agencies,
however Brenwick Development indicated they were only starting construction on Section 12002-A and
only posted bonds accordingly. The City of Carmel Engineering Department held off on the official
approval of Section 12002-B because of bonds.
Since this time several items have changed. The 10+/- acres to the east of Section 12002-B was sold and
developed as a homestead or estate lot. Therefore, Brenwick has decided to remove the stub street to the
west and change it to stub to the north, at the same general location.
The secondary plat and construction plans for Section 12002-B has been revised to reflect this change.
The plans have also been submitted to the City of Carmel Engineering Department as well. This includes
geometry changes, lot configuration, intersection details, storm sewer within this specific area, street plan
and profiles in this specific area, and erosion control etc. . ..
The secondary plat and construction plans are for your review and suggestions with respect to Secondary
Platting.

We have reviewed the sanitary sewer plans for the revised Village
of West Clay Section 12002 A & B and offer the following
comments:
1. The invert elevations of the drop pipes into manholes
A403 and G402 need to be noted on sheets C401 and
C402.
2. The detail depicting a pre-cast drop manhole on sheet
C802 appears to be a build in place drop-manhole. This
detail should be updated. We can send you a detail that
conforms to CTRWD Standard Specifications upon
request
3. All special requirements dictated by the pipe line
Company should be noted on plans. This includes back
fill, digging requirements, inspection etc..
4. Due to lack of cover between manholes G402 to G404,
mandrel testing will be postponed until 30 days after final
grade has been established unless t c3\a has been
filled prior to pipe installation. \. \

Dear Mr. Burke:
The City has received your comment letter and revised drawings dated July 15, 2004. Thank you for
addressing the City's comments. Based on a review of your comments and the submitted drawings, the
issues from the City's second review on June 23, 2004 were satisfactorily addressed with the exception of
the following items:
Secondary Plat
3,5. This Department does not desire the overlap of the property boundaries and easements into the
existing Panhandle Eastern easement. This Department understands that prior commitments may
have been made and that this entire development has been through the Primary Plat approval
process. It is unlikely that Panhandle Eastern would allow any other utilities to be constructed
within their easement. This would defeat the purpose of platting a DU&SE easement on the lots
for the benefit of the local and the City utilities. The City requests that language be added to the
Plat and the Development Plan that states that any easement or right-of-way shown across or
within the Panhandle Eastern Pipeline easement is subject to the rights of that easement and
Panhandle Eastern Pipeline approval.
Development Plan, Sheets CIOI and CI02
10. Engineered Fill, please provide a material specification (gradation) to establish minimum
properties of this material, or leave it out.
15. Thank you for adding "2' Above 100 yr Flooding Source." Please define lowest opening (door,
window, drain, etc.)
18. The City has had experiences where long, flat swales are filled in or modified when the homes are
constructed, creating a drainage problem Is their any requirement on the drawings or in
subsequent agreements to control the individual homebuilder to do nothing that will alter the
swale and it's intended function from that on the approved design drawings? Has consideration
been given to changing the aligrunent of the pipe to shorten the swale and make the other swale
slightly longer?
Profiles, Sheets C401-C402 and Sheets C601-C603
27. Has the County reviewed and approved the areas with less cover?
28. The City requires subsurface drains on both sides to adequately drain the subgrade. Please add
subsurface drain crossings to the profiles.
31. The City is not assuming control of the storm sewers. However, piping at slopes less than 0.3%
are difficult to install and any joint settlement or pipe settlement may result in the piping being at

no slope, or at a reverse slope. Please review the pipe slopes with the County. If the County
accepts the proposed pipe slopes, the City will not pursue this item further.
34. Thank you for adding the detail. Will your street/paving contractor include the future depressed
curbs in his bond?
Based on additional review, the City provides the additional comments:
I. Sheet CIOO - Why is the design based on a design speed of20 MPH? Is it intended for all the
streets to have a posted speed limit of 20MPH or less? The City standard is 25 MPH.
2. Sheet CIOI - Why are the widths of some streets dimensioned F-F instead ofB-B? There's a
note in the upper right comer of the drawing that is partially cut off. On the right side of the
sheet beneath "DANGER! USE EXCESSIVE CAUTION!" is the contraction "it's." This
should be spelled "its". Maybe the heading "USE EXCESSIVE CAUTION!" should read
"USE EXTREME CAUTION!"
3. Sheet C102 - On lot 250, please correct the MFPG elevation.
4. Sheet C107 - All signs are to be installed by the City of Carmel Street Department, but please
provide a more detailed standard plan for this installation. Because of the unusual nature of
the intersection geometry, much more specific information than sign symbols in the general
location of the signs is needed. Please precisely locate the signs using stationing, distances
from intersecting centerlines, or some other method. Please refer to the !MUTCD for the
proper way of signing intersections with one-way streets. "Do Not Enter" signs will likely be
required. The City recommends the use of a sheet similar to the Intersection and Cul-de-sac
Details sheet for the Traffic Control Plan. Sidewalks and any other features that will affect
the placement of the signs should be shown. In the legend, the symbol "SN" is shown for
both the street name sign and one-way sign. Under "SPECIFICATIONS" are notes "SEE
DETAIL C80S" and "SEE DETAIL C804." Where are these details? There is a stop sign
indicated at the west Milford StreetlMilford Street intersection. If this is a one-way street,
why is there a stop sign at this location?
The above comments are based upon the Engineering Department's third review. Please provide our office
with a follow up letter regarding this review and revised plans, indicating all revisions. If you have
questions, please contact me at 571-2441.

The City has received your comment letter and revised drawings dated June 3, 2004. Thank you for
addressing the City's comments. Based on a review of your comments and the submitted drawings, the
issues from the City's ftrst review on March 15, 2004 were satisfactorily addressed. Based on the same
review, the City offers the following comments:
Secondary Plat
1. Is the 12' space between Lots 249 and 250 part of Block "A"?
2. Whyis'there a 20' DU&SE across Lot 244 and a 15" DU&SE everywhere else in the immediate
area?
3. Lots 232, 233,234,235,236 and 240 encroach into the Panhandle Eastern Pipeline easement.
Why were these encroachment areas not included as a part of Block "B" and Block "C"?
4. Does the 20' DU&SE on Lot 232 need to terminate at the Panhandle Eastern Pipeline easement?
5. Is it warranted to add language to the plat that any easement or right-of-way shown across the
Panhandle Eastern Pipeline easement is subject to the rights of that easement and their approval?
6. Please add a Sheet Map to Sheets 1-4, Section 12002-B.
7. Please label easements in the rear of Lots 253,254 and 255 on Sheet 1 of 5 and Sheet 4 of 5 for
Section 12002:-B.
8. There is a Block "B" typo on Sheet 3 of 5 for Section 12002-B.
9. Need to add an easement between Lots 238 and 239 in Section 12002-A.

10. Please define "Engineered Fill" in the speciftcations and establish a minimum speciftcation for the
material. Edit General Note 14 as needed.
II. Is a sidewalk required for both sides of Bull Court?
12. Is a flood route provided for clogged inlets and swales? Please indicate on the drawings.
13. Is it possible to move the notes concerning the Panhandle Eastern Pipeline easement to a more

14. Ensure General Note 9 agrees with the information presented in the details.
15. Please define MFPG better for homeowners and builders. The City has difficulty explaining this
item to homeowners both during and after home construction.

16. Add a note to intercept existing SSD at Structure P601.
17. Label existing Claridge Farms Section 2 regulated drain.
18. The lots on the south side of Milford Street are served by very long swales. This office
recommends no more than three (3) lots of consecutive rear yard swales before a storm structure
or inlet is placed to collect runoff.
19. All swales shall be a minimum of 1 % slope. Please label slopes on the drawings.
20. Street cross slopes shall be a minimum of 2% slope.
21. Traffic heading west on the Milford Street "eyebrow" will have difficulty turning right. Is it
possible to pull the radius back?
22. The proposed sidewalks do not align with the existing sidewalks at the western edge of Milford
Street.
23. The City recommends aligning the 9' chat/asphalt paths at the western edge of Milford Street and
the eastern edge of Section 12001.
24. The proposed 9' chat/asphalt path is reduced to 4' walkways to cross Hourglass Drive. Would it
not be better to continue the 9' path to cross Hourglass Drive?
Traffic Control Plan, Sheet CI07
25. Will the path crossings be striped as crosswalks?
26. Please add a stop sign at the intersection of the southbound Milford Street one-way street where it
intersects Milford Street proper (by Tipton Green Commons).
Profiles, Sheets C401-C402 and Sheets C601-C603
27. There are a few instances where 2' minimum cover per County Standards is not provided.
28. The City recommends the addition ofSSD's and water main crossings to the Storm and Sanitary
profiles to ensure there are no conflicts. There are SSD crossings between the following structures:
605-602; 606-602; 603-602; 621-620.
29. Has the owner secured permission from Panhandle Eastern Pipeline to install utilities under the
existing pipelines? Typically these companies do not allow utilities under the pipelines.
30. The City assumes that existing Structure A403 is a drop manhole.
31. The City typically requires a minimum of 0.3% slope for all storm sewers. However, the proposed

32. The sanitary sewer between Structures 405 and 406 is very close to the existing pipeline. The
space provided does not allow for much Contractor deviation in construction. How is this sewer to
be installed?

33. Street cross slopes shall be a minimum of2% slope.
34. It is apparent from the details that chair back curb is to be installed along all roadways. This type
of curb does not facilitate driveway access. Is it intended to cut out the curb and install depressed
curbs when the final driveway location for each lot is determined? Please provide details for
depressed curbs at driveways and for transitions between straight curb and depressed curb. The
City requires Performance Bonds for the Contractor to put the curbing in initially. How does the
builder cutting out and replacing this curbing impact the original work and bond?

36. Spacing between sidewalk joints shall be no greater than 1.25 times the width of the sidewalk.
37. Add note that sidewalk at driveways shall be 6" minimum or driveway thickness, whichever is
greater.
38. The City recommends deleting duplicate details that appear on Sheets C803 and C806. The
County standard details apply for this project.
39. City and County standard is a 6" diameter SSD for street and swale under drains.
40. Revise Detail 7 on Sheet C801 to show the SSD completely under the curb section.
41. Edit all pavement sections on all sheets to be as follows: I" H.A.C. Surface #11 over 5" H.A.C.
Base #5D over 7" Compacted #53 Stone. Additionally, add a note to the pavement section

minimum of three-sets of drawings for approval after all issues have been resolved. The drawings
will be stamped as approved and will be signed by the City Engineer. The Owner will receive
one-set which is to be maintained on the construction site at all times. Our Public Works
Inspector will receive one-set and one-set will be maintained in the Engineering Department. We
will approve an additional two-sets of drawings, totaling five-sets if desired. The additional sets
must be provided with the minimum three-sets.
5. Please be advised that any installation of signs, walls, irrigation systems, etc. within dedicated
right of way or dedicated easements will require a Consent to Encroach Agreement with the City
of Carmel's Board of Public Works and Safetv.

The amount of the Performance Guarantee is based upon a certified Engineer's Estimate for 100%
of the cost oflabor and materials to construct the individual improvements, to be provided by the
design engineer. Please provide detailed Engineers Estimates for each improvement including
unit costs, quantities, materials and types of materials, etc. Upon completion and release of
individual Performance Guarantees, a three-year Maintenance Guarantee will be required. The
Maintenance Guarantee amount is based upon 15% of the Performance amount for Streets and
Curbs and 10% of the Performance amount for all other improvements. Performance Guarantees
may be Performance or Subdivision Bonds, Irrevocable Letters of Credit or
Cashier's/Certifiecl/Official Checks. Please reference the enclosures for more detailed explanation
of our procedures.

We have reviewed the construction plans submitted to the Hamilton County Surveyor's
Office on March 5,2004 for this project and have the following comments:
1. The proposed project falls in the jurisdiction of the City of Carmel.
2. Please coordinate the storm sewer design with this office and the City of Carmel.
3. The proposed project falls in the Village of West Clay Regulated Drain
Watershed.
4. This proposed site DOES NOT fall in a Carmel Well Head Protection Area.
5. This project will be a Hamilton County Regulated Drain Subdivision, subject to
approval of the Hamilton County Drainage Board. As per the prior agreement for
the Village of West Clay, the underdrains \\'ill not be part of the regulated system.
6. Please submit the follo\\'ing procedural items to this office, petition for regulated
subdivision, non-enforcement request for subdivision, outlet permit, engineer's
estimate, and all associated bonds for 100% of construction cost. The applications
are available on ourwebsite at ht1;o://www.co.hamilton.in.us. go to Departments,

8. HCSO Standard Detail D-16 requires all swales to have 1 % fall or underdrains
and no less then 0.5% fall. Some swales in this section do not meet the
requirement of the standard detail.
9. Please show location of street underdrain on the P & P sheets where the
underdrain crosses the storm sewer pipes and no structure in at that point. A few
locations could cause a conflict with the underdrains and storm sewer pipes in this
section.
10. Hamilton County Surveyor's Office requires 2' of cover over any regulated storm
drain. Please try to increase the cover on any storm runs that do not meet this
requirement.
11. Please label trash grate required on sheet C 101 for structure 0631.
12. The surface drainage from the rear of lots 237 thru 239 is not defined and could
cause drainage issues for the future HO. Claridge Fann Section 2 to the south of
these lots is a regulated drain subdivision and drainage facilities exist that could
provide drainage for this comer of section 12002-A. Please contact me for
additional information or ideas for this area.
13. The daylighting of the SSD drain between the gas lines is not an ideal situation
and other possible solution should be explored.
14. The curb turn-outs on Bull Court will discharge a large amount of water a sUtface
flow and could cause standing water problems in the area. Is the City of Carmel
acceptable with this design as part of their street system?
15. Please remember that even though a variance was granted for street trees in the
beginning of this project, NO tree are to be planted over a regulated drain storm
sewer. I notice a few storm runs in the current design that could allow this a
happen and no landscape plan was submitted with this set of drawings.
16. Please note the additional comments may be warranted at a later date.

Thank you for revising the radius of the Milford eyebrow, intersection detail, and signage. We are
assuming that the lot line revisions and path reduction were not associated with our review. Please call to
discuss if you feel it is necessary. We don't have issues with this item.
The above comments are based upon the Engineering Department's fourth review. By letter dated August
12,2004, ML Kevin Krulik transmitted to this office copies of approved IDEM sanitary sewer permits,
certified engineer's construction cost estimates, performance bonds for asphalt streets, performance bonds
for curbs, performance bonds for sidewalks, and performance bonds for street signs. These items were
provided for Section 12002-A only. Because the construction plans that have been under review include
both Section 12002-A and Section 12002-B, but the required paperwork provided was for Section 12002-A
only, on the construction plans submitted for approval, please block out by cross-hatching all that pertains
to Section 12002-B. This is to make it clear that construction plan approval is for Section 12002-A only.

The City has received your comment letter and revised drawings dated July 15, 2004. Thank you for
addressing the City's comments. Based on a review of your comments and the submitted drawings, the
issues from the City's second review on June 23, 2004 were satisfactorily addressed with the exception of
the following items:

3,5. This Department does not desire the overlap of the property boundaries and easements into the
existing Panhandle Eastern easement. This Department understands that prior commitments may
have been made and that this entire development has been through the Primary Plat approval
process. It is unlikely that Panhandle Eastern would allow any other utilities to be constructed
within their easement. This would defeat the purpose of platting a DU&SE easement on the lots
for the benefit of the local and the City utilities. The City requests that language be added to the
Plat and the Development Plan that states that any easement or right-of-way shown across or
within the Panhandle Eastern Pipeline easement is subject to the rights of that easement and
Panhandle Eastern Pipeline approval.

. 10. Engineered Fill, please provide a material specification (gradation) to establish minimum
properties of this material, or leave it out.

18. The City has had experiences where long, flat swales are filled in or modified when the homes are
constructed, creating a drainage problem. Is their any requirement on the drawings or in
subsequent agreements to control the individual homebuilder to do nothing that will alter the
swale and it's intended function from that on the approved design drawings? Has consideration
been given to changing the alignment of the pipe to shorten the swale and make the other swale
slightly longer?

27. Has the County reviewed and approved the areas with less cover?
28. The City requires subsurface drains on both sides to adequately drain the subgrade. Please add
subsurface drain crossings to the profiles.
31. The City is not assuming control of the storm sewers. However, piping at slopes less than 0.3%
are difficult to install and any joint settlement or pipe settlement may result in the piping being at

no slope, or at a reverse slope. Please review the pipe slopes with the County. If the County
accepts the proposed pipe slopes, the City will not pursue this item further.
34. Thank you for adding the detail. Will your street/paving contractor include the future depressed
curbs in his bond?
Based on additional review, the City provides the additional comments:
1. Sheet ClOD - Why is the design based on a design speed of20 MPH? Is it intended for all the
streets to have a posted speed limit of 20M PH or less? The City standard is 25 MPH.
2. Sheet ClOI- Why are the widths of some streets dimensioned F-F instead ofB-B? There's a
note in the upper right comer of the drawing that is partially cut off. On the right side of the
sheet beneath "DANGER! USE EXCESSIVE CAUTION!" is the contraction "it's." This
should be spelled "its". Maybe the heading "USE EXCESSIVE CAUTION!" should read
"USE EXTREME CAUTION!"
3. Sheet C102 - On lot 250, please correct the MFPG elevation.
4. Sheet C107 - All signs are to be installed by the City of Carmel Street Department, but please
provide a more detailed standard plan for this installation. Because of the unusual nature of
the intersection geometry, much more specific information than sign symbols in the general
location of the signs is needed. Please precisely locate the signs using stationing, distances
from intersecting centerlines, or some other method. Please refer to the IMUTCD for the
proper way of signing intersections with one-way streets. "Do Not Enter" signs will likely be
required. The City recommends the use of a sheet similar to the Intersection and Cul-de-sac
Details sheet for the Traffic Control Plan. Sidewalks and any other features that will affect
the placement of the signs should be shown. In the legend, the symbol "SN" is shown for
both the street name sign and one-way sign. Under "SPECIFICATIONS" are notes "SEE
DETAIL C805" and "SEE DETAIL C804." Where are these details? There is a stop sign
indicated at the west Milford Street/Milford Street intersection. If this is a one-way street,
why is there a stop sign at this location?
The above comments are based upon the Engineering Department's third review. Please provide our office
with a follow up letter regarding this review and revised plans, indicating all revisions. If you have

18. The lots on the south side of Milford Street are served by very long swales. This office
recommends no more than three (3) lots of consecutive rear yard swales before a storm structure

profiles to ensure there are no conflicts. There are SSD crossings between the following structures:

29. Has the owner secured permission from Panhandle Eastern Pipeline to install utilities under the
existing pipelines? Typically these companies do not allow utilities under the pipelines.
30. The City assumes that existing Structure A403 is a drop manhole.
31. The City typically requires a minimum of 0.3% slope for all storm sewers. However, the proposed
storm water system has been reviewed and approved by the City's consultant.
32. The sanitary sewer between Structures 405 and 406 is very close to the existing pipeline. The
space provided does not allow for much Contractor deviation in construction. How is this sewer to
be installed?

34. It is apparent from the details that chair back curb is to be installed along all roadways. This type
of curb does not facilitate driveway access. Is it intended to cut out the curb and install depressed

depressed curbs at driveways and for transitions between straight curb and depressed curb. The
City requires Performance Bonds for the Contractor to put the curbing in initially. How does the
builder cutting out and replacing this curbing impact the original work and bond?

36. Spacing between sidewalk joints shall be no greater than 1.25 times the width of the sidewalk.

greater.
38. The City recommends deleting duplicate details that appear on Sheets C803 and C806. The
County standard details apply for this project.
39. City and County standard is a 6" diameter SSD for street and swale under drains.
40. Revise Detail 7 on Sheet C801 to show the SSD completely under the curb section.
41. Edit all pavement sections on all sheets to be as follows: I" H.A.C. Surface #11 over 5" H.A.C.
Base #5D over 7" Compacted #53 Stone. Additionally, add a note to the pavement section
specification and any details that states that all paving is to be completed in the same paving
season.
Please provide our office with a follow up letter and revised plans indicating all revisions. It is critical that
this office be made aware of all modifications made on the plans being re-submitted, particularly if any
such changes are considered "new" or fall outside of the City's initial reviews.

Development? Since these drains will not be cover by a plat, the easements will
default back to the statutory easement per I.C. 33-9-27-33.

minimum of three-sets of drawings for approval after all issues have been resolved. The drawings
will be stamped as approved and will be signed by the City Engineer. The Owner will receive
one-set which is to be maintained on the construction site at all times. Our Public Works
Inspector will receive one-set and one-set will be maintained in the Engineering Department. We
will approve an additional two-sets of drawings, totaling five-sets if desired. The additional sets
must be provided with the minimum three-sets.
5. Please be advised that any installation of signs, walls, irrigation systems, etc. within dedicated
right of way or dedicated easements will require a Consent to Encroach Agreement with the City
of Carmel's Board of Public Works and Safetv.

design engineer. Please provide detailed Engineers Estimates for each improvement including
unit costs, quantities, materials and types of materials, etc. Upon completion and release of
individual Performance Guarantees, a three-year Maintenance Guarantee will be required. The
Maintenance Guarantee amount is based upon 15% of the Performance amount for Streets and
Curbs and 10% of the Performance amount for all other improvements. Performance Guarantees
may be Performance or Subdivision Bonds, Irrevocable Letters of Credit or
Cashier's/CertifiedlOfficial Checks. Please reference the enclosures for more detailed explanation
of our procedures.

8, HCSO Standard Detail D-16 requires all swales to have 1 % fall or underdrains
and no less then 0.5% fall. Some swales in this section do not meet the
requirement of the standard detail.
9. Please show location of street underdrain on the P & P sheets where the
underdrain crosses the storm sewer pipes and no structure in at that point. A few
locations could cause a conflict with the underdrains and storm sewer pipes in this
section.
10. Hamilton County Surveyor's Office requires 2' of cover over any regulated storm
drain. Please try to increase the cover on any storm runs that do not meet this
requirement.
11. Please label trash grate required on sheet C 1 0 1 for structure 0631.
12. The surface drainage from the rear of lots 237 thru 239 is not defined and could
cause drainage issues for the future HO. Claridge Fann Section 2 to the south of
these lots is a regulated drain subdivision and drainage facilities exist that could
provide drainage for this comer of section 12002-A. Please contact me for
additional information or ideas for this area.
13. The daylighting of the SSD drain between the gas lines is not an ideal situation
and other possible solution should be explored.
14. The curb turn-outs on Bull Court will discharge a large amount of water a surface
flow and could cause standing water problems in the area. Is the City of Cannel
acceptable with this design as part of their street system?
