Hunters Quest The applicant seeks the following development standards variance approval: Docket No. 06090025 V Chapter 23F.13.01.A ground signs prohibited in Overlay The site is located at 104-122 E Carmel Dr. and is zoned B-8/Business within the Carmel Dr - Range Line Rd Overlay. General Info: The petitioner is seeking variance approval in order to have a ground sign on the site located within the Carmel Drive - Range Line Road Overlay. Ground signs are prohibited in this overlay. Analysis: Recently, the petitioner was granted an amended sign package for this site from the Plan Commission Special Studies Committee. Previously, the site had a pylon (pole) sign that was 2l-ft in height. There are very few pole signs in Carmel, as they are slowly being phased out. Now, the petitioner would like to erect a 6- ft tall landscaped ground sign. The Carmel Dr - Range Line Rd Overlay states that ground signs are prohibited. The development plan for this site was approved and constructed prior to the creation of the Overlay zone. Findings of Fact: 1.) The approval of this variance will not be injurious to the public health, safety, morals, and general welfare of the community because: the landscaped ground sign will complement the site and the surrounding context. The sign will be set back away from the road right of way and will not obstruct the vision of drivers. 2.) The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: the landscaped ground sign will complement the site and the surrounding context. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: the petitioner may not be able to adequately identify tenants within his building, possibly negatively affecting patrons locating the site and possibly negatively affecting the tenants' success. Recommendation: The Dept. of Community Services recommends positive consideration of Docket No. 06090025 V.
