Dear Mr. Eagle:
The City has received your comment letter and drawings dated February 22, 2007 based upon the City
review of February 5, 2007.
The comments from the City review have been satisfactorily addressed with the exceptions outlined below.
Provided that the revisions below are made, the requisite number of plans may be submitted for approval.
CONSTRUCTION DRAWING COMMENTS

3. On Sheet CS-IOI, CO-Ill, CU-IOI, and CR-IOI, the outline ofa sidewalk is shown within the
10-foot asphalt path. Also the outline of a sidewalk is shown crossing the concrete aprons at the
entrances. On the plans submitted for approval, please eliminate the outline of the sidewalk from
these sheets. Also please ensure that the widths of the A.D.A. ramps correctly match the 10-foot
width of the asphalt path. On the drawings, currently the widths of the A.D.A. ramps match the 5-
foot width of a sidewalk.
These comments represent the Department of Engineering's fourth review of the construction drawings for
this project. We request that all responses to our comments be provided in writing. Failure to provide
written responses may result in the delay of the review process.
All bonds and performance guarantees must be posted prior to Engineering Department approval of
construction plans. Also, Board of Public Works and Safety approvals and any other governing agency
approvals (if required) must be obtained prior to Engineering Department approval.
The Department reserves the right to provide additional comments based on subsequent reviews.

Dear Ms Foley:
In response to your comment letter dated October 10, 2006, we submit for your review our
response along with revised plans.
BONDING REQUIREMENTS
1. The bond will be prepared and submitted through our Client.
STORMW ATER QUALITY REVIEW COMMENTS-CONSTRUCTION PLANS
B2. Sequence describing storm water quality measure implementation relative to land
disturbing activities
Separate Pre-pavement (CG-llO) and Post Pavement (CG-1l1) Storm Water
Pollution Prevention Plans were added and the reference to swales in the
sequencing were removed except for the temporary swale discharging from
the southwest silt basin.
B4. Sediment control measures for sheet flow areas
Silt fence was removed from the north perimeter. However it was
retained along the toe of the proposed slope along south parking lot.
Diversion berms were ad<;l.ed to direct the flow into the temporary silt
basins.
B5. Sediment control measures for concentrated flow areas
The silt basin and rock check dam at the southwest comer was moved away from
the tree preservation area. A temporary swale was added to drain the basin to
the exiting outfall. The silt basin and rock check dam at the northeast comer is
located around an exiting pie and is not in the tree preservation area. Therefore
its location remains per plan.
B6. Sediment control measures for storm sewer inlet protection
Beehive inlet protection was modified to be the basket type inlet protection and not the
coconut erosion control log as previously specified.
C4. Location, dimensions, specifications, and construction details of each storm
water quality measure.
Catch Basin Insert details were added on Sheet CG-502.

C5. Description of maintenance guidelines for post construction storm water quality
measures
Weare working with Lange Industries to prepare the 0.& M manual for the inserts and
will be submitted separately with the Owner Acknowledgement form. The additional
BMP will be included with the pond in the Pannatoni Development along with the
0& M manual.
As we discussed yesterday, please fmd attached Sheets CG-llO, CG-ll1, CG-501 and CG-502
to review the modifications made to the plans per the comments.

Dear Mr. Eagle:
We have reviewed the construction drawings submitted for this project for the August 16, 2006 Technical
Advisory Committee meeting. We offer the following comments:
GENERAL INFORMATION
1. The project site is currently within current City of Cannel Corporate Limits.
2. Jurisdictions:
. Street and Right of Way - Pennsylvania Street/City Center (122M Street) Drive
. Water-City of Cannel Utilities.
. Sanitary Sewer-The project is within Clay Township Regional Waste District service area.
. Stonn SewerlDrainage - City of Cannel. The Hamilton County Surveyor's Office has
jurisdiction over legal drains and discharge to legal drains.
3. Board of Public Works and Safety Approval Requirements:
. Water Availability approval:
Water Availability Approval request to the Board is based upon EDU requirements
as determined by the proposed use of the building. Water Connection Fees will be
based upon EDU calculations.
If entryway or other irrigation systems are planned, additional Water Availability
Approval from the Board will be required and additional Water Connection Fees will
be assessed based upon the size and usage of the system.
. Commercial Curb Cut-Please provide 8~ x 11 exhibits to accompany the request for
commercial curb cut approval. Include all pertinent data including radii, drive width at throat
and street, opposing drives etc.
. Temporary Construction Entrance-Board approval is required if the temporary entrance is
located at a site other than the existing approved curb cuts. Please provide exhibits as detailed
above, if applicable.
. Open Pavement Cuts in dedicated streets. It appears that there will be several instances of
open pavement cuts.
. Secondary Plat approval if applicable.
. Dedication of right of way if applicable.
. Consent to Encroach Agreements for any permanent improvement to be installed within
dedicated right of way and/or dedicated easements.
I am enclosing a schedule for Board of Public Works and Safety meeting dates and agenda
deadlines for your use. Please use the Engineering Department deadlines for submissions to the
Board.

4. TAC ReviewlDrawings submitted for approval:
We request that all comments and comment letters generated by this office be answered in writing
and be accompanied by a drawing reflecting requested revisions. Final drawings will not be
approved for construction until all issues have been resolved. The design engineer must certify all
drawings submitted for final approval. This office will require a minimum of four-sets of
approved drawings after all issues have been resolved and the construction drawings have been
approved The drawings will be stamped as approved and signed by the City Engineer and by the
Director of Carmel Utilities. The Developer/Owner will receive one-set which is to be maintained
on the construction site at all times. Carmel Utilities will receive one set. The Engineering
Department Construction Manager will receive one-set and one-set will be maintained in the
Department of Engineering. Ifmore than the minimum of four-sets are requested to be approved,
the additional sets (maximum total of two additional) must be submitted with the four required
sets.
s. Please be advised that any installation of signs, walls, irrigation systems, etc. within dedicated
right of way and/or dedicated easements will require a Consent to Encroach Agreement between
the OwnerlDeveloper and the City of Carmel. This Agreement requires Board of Public Works
and Safety approval.
6. Please provide Carmel Utilities with all initial and subsequent drawings submitted for
review. They will provide a separate review regarding these issues. Please submit to:

BONDING REOUlREMENTS
9. Upon initial review, it appears the following bonding requirements may apply to this project:
PerformancelMaintenance Guarantees
This project may be required to provide Certified Engineer's Estimates and
performancelMaintenance Guarantees for the following improvements:
. Water Mains if applicable.
. Perimeter concrete sidewalks/asphalt paths if applicable.
. Perimeter road improvements ifrequested.
. Erosion Control
Provide detailed/itemized Certified Engineer's Estimates in the amount of 100% of the cost of
labor and materials for the requested improvements. Provide individual Performance Guarantees
in the amount of the Engineer's Estimates. When the improvements have been constructed and
accepted and the Performance Guarantee is released by our BPWS, 3-Year Maintenance
Guarantees will be required in the amount of 15% of the Performance amount for streets and curbs
and 10% of the Performance amount for all other improvements.
Street CutlRight of Way Permit and Bonding Requirements
Any work in the dedicated right of way of Pennsylvania Street will require a Right of Way Permit.
If the work is included in the scope of work of a required Performance Guarantee, a separate
License and Permit Bond will not be required. If the work is not included in a Performance
Guarantee, a License and Permit bond will be required. The bond amount will be determined by
the number of instances of work in the right of way @ $2,000.00 per instance. ODell Davement

contact Fred Glaser, Department of Engineering Right of Way InspectorlManager for details
regarding this issue.
10. We have engaged Crossroad Engineers, PC to review all drainage plans and drainage calculations
submitted to this office for review. We will share Crossroad's comments as they are received.
When construction plans are submitted for review for this development, please provide a set of
drawings and drainage calculations directly to Crossroad.
Contact Amanda Foley, City of Carmel Storm Water Administrator, regarding bonding
requirements for erosion control.
AVAILABILITY AND CONNECTION FEES
11. Water Availability (acreage) Fees are required to be paid after Engineering Department approval
of the project's construction plans and prior to obtaining a Building Permit. Availability Fees are
based upon total platted acreage or legal description acreage at the current rate ofSl,OlO.oo per
acre, subject to future revisions. Based upon the legal description on the plans, the preliminary
Water Availability Fee calculation is:
7.96 Acres @ $I,OIO.OO/Acre = $8,039.60 or $8,040.00
12. Water Connection Fees are required to be paid after Engineering Department approval of the
project's construction plans and prior to obtaining a building permit. Connection Fees are based
upon the EDU calculation of the proposed usage of the building at the current rate ofSl,31O.00
per EDU, also subject to future revisions. Please provide this office with a detailed list of the
various uses planned for these buildings. It appears that the following uses may apply:
. Bars & Cocktail Lounges - 0.10 EDU/Seat
. Retail Space - 1.0 EDUIl 000 ft2
. Hotels - 0.50 EDU/Room
. Office - 0.50 EDUIlOOO ft2
. Restaurant - 0.10 EDU/Seat
. Swimming Pools - 1.60 EDUIlOOO ft2
. Barber Shop - 0.30 EDU/Chair
. Beauty Shop - 0.90 EDU/Chair
If an irrigation system Is plll1med for this development, additional Water Connection Fees wUl
be assessed based upon the recommendations of the Director of Camel UtUltles.
CONSTRUCTION DRAWING COMMENTS
A seven-page Plan Certification Form is enclosed with this letter. This form was created with the desire
and intent to streamline the plan review process. We request that you please complete this form and return
the original of this form along with complete 24" x 36" civil drawings to the Department of Engineering as
soon as possible. Comments will be generated after the Plan Certification form is returned.
Please treat each item on the form as a requirement of the Department of Engineering. Providing a "no" or
"N/A" response to any of the items does not relieve the Developer of the responsibility of meeting the
requirements of the Department of Engineering. The Department of Engineering will make the final
determination as to the acceptability of any "no" or ''N/ A" responses.
13. Any off-site easements necessary for installation of utilities and storm drainage must be secured
prior to the Department of Engineering approving the drawings.
14. All paving within the existing and proposed City right-of-way shall conform to the requirements
of the Department of Engineering. Please add a note to the drawings that the Contractor shall
contact the Department of Engineering to schedule a pre-construction meeting to review the
Department's construction requirements, staff notification requirements, required inspections for
certain stages of the work and to review the authority of the Department as it relates to work
within the existing and proposed City right-of-way.
15. Please contact Crossroad Engineers to obtain drainage review checklist for consideration in
developing construction plans and that design effort.
16. ADA ramps are required at all locations where the sidewalks or asphalt paths cross the streets.
17. Please delineate any curb cuts on the plan for sawcut, removal, and replacement.
18. An asphalt path is required along the entire Pennsylvania Street frontage, per the Alternative
Transportation Plan.
19. Please add an Asphalt Path Detail that requires I inch HMA # II surface on 2 inches HMA #8
binder on 5 inches #53 stone, if applicable.
20. For sidewalk within the right-of-way, please specify the width of the sidewalks to be 5 feet.
Please add the following notes to the sidewalk detail: "SPACING BETWEEN TRANSVERSE
JOINTS SHALL NOT EXCEED 1.25 TIMES WIDTH," "SIDEWALK BUILT WITH
DRIVEWAYS SHALL HAVE MINIMUM THICKNESS OF 6" OR THICKNESS OF
DRIVEWAY, WHICHEVER IS GREATER," and "JOINTS SHALL BE TOOLED OR SAWED
TO A DEPTH OF y.. THE SIDEWALK THICKNESS."
21. Please remove the LANDSCAPE PLAN sheet titles from the index on the cover sheet. The
Engineering Department does not approve landscaping or landscaping plans and they should not
be included in drawings submitted to Engineering for review and/or approval.
22. Please replace the STRAIGHT CONCRETE CURB DETAIL (5/C803) with the City of Carmel
standard detail.
23. For subsurface drain within the right-of-way, please add the City of Carmel subsurface drain
standard and add the note" ALL SUBSURFACE DRAIN TO BE DOUBLE WALL HANCOR
ID-Q OR EQUIVALENT" in the vicinity of the subsurface drain standard.
24. Please indicate dedication of the Right-of-Way prescribed by the City's 20-year Thoroughfare
Plan if the existing Right-of-Way is not ofsufticient width.
25. Please label and dimension the right-of-way of Pennsylvania Street.
26. Entrances with medians may be a maximum width of 46 feet. Each travel lane (on either side of
the median) shall be a maximum of 18 feet wide and the median shall be a maximum of 10 feet
wide. The north entrance is in compliance at the west end of the median, but the plans must be
revised such that the east end of the median is in compliance.
27. As the drainage design progresses, the design shall accommodate detention volume for the fully
developed site and for the fully developed thoroughfare plan right-of-way for the perimeter road
frontages. This requirement shall apply regardless of watershed limits. Please provide adequately
sized pipes to carry water from the street to the proposed ponds. Please confirm with the
Pannatoni Development that they are accommodating this requirement.
28. This project is subject to the Carmel Stormwater Management Ordinance, which was adopted
February 6, 2006.
29. All Pennsylvania Street drainage structures and bridges across the frontage of this development
must be indicated on the plans and replaced or improved by the developer to accommodate the
widening, auxiliary lanes, multi-use path, and any other required improvements to the property or
the roadway.
30. On all sheets where the street name "122ud Streef' appears, please revise to "City Center Drive."
31. Please remove the graphic scale from all sheets.
32. Please provide a maintenance oftraftic plan.
33. Please include the note "THERE SHALL BE NO WATER VALVES OR MANHOLES WITHIN
THE PAVEMENT, CURBS, OR SIDEWALKS, OR ASPHALT PATHS" on all appropriate
sheets.
34. Ifit will be necessary to relocate existing utility poles, they must be relocated to within one foot of
the proposed right-of-way. The expense of such relocation shall be borne by the Developer.
35. The Department requires that the construction drawings be developed in accordance with the City
of Carmel digital submission standards and that all required submittals for primary plat, secondary
plat, and construction drawings be made. The digital tiles must be submitted to the Department of
Engineering prior to approval of the construction plans.
36. The City has adopted a new paving policy. Please revise any notes, specifications, and details to
accommodate this policy. The language of this policy must be added to a specitication sheet on
the plans.
37. The City has adopted a new curbing policy. Please revise any notes, specifications, and details to
accommodate this policy. The language of this policy must be added to a specification sheet on the
plans.
38. As discussed at the meeting, the City's Thoroughfare Plan requires construction of half of the
improvements prescribed by the Thoroughfare Plan across the frontage. Typically, developers
provide the money equal to the value of constructing these improvements to the City for deposit in
the City's non-reverting Thoroughfare Plan fund.
39. Although not discussed at our meeting, the City is requesting right-of-way dedication for a future
roundabout at the intersection of City Center Drive and Pennsylvania Street. This right-of-way
shall be a 120-foot radius circle centered on the existing intersection of the centerline of City
Center Drive and the section line.
40. As we discussed, the piping under Pennsylvania Street to discharge storm water runoff from the
site into the Pannatoni Development must be sized to convey the 100-year storm without
overtopping the roadway.
41. Thank you for indicating the construction of a left turn lane in the existing median for northbound
traffic at the main entrance.
42. Please confirm with the Department of Community Services the need for internal vehicle
connectivity to the north parcel for a future connection.
43. The Department understands that storm water detention and post construction storm water
treatment is being provided off-site.
44. The portions of commercial driveways within the right-of-way shall be constructed of concrete
and shall have a depressed curb along them to maintain drainage.
These comments represent the Department of Engineering's initial review of the construction drawings for
this project. We request that all responses to our comments be provided in writing. Failure to provide
written responses may result in the delay of the review process.
It is critical that our office be made aware of all modifications made on the plans being resubmitted,
particularly if any such changes are considered ''new'' or fall outside of our previous reviews. Please
provide revised plans including all revisions. Please notifY us of any changes and specifically state any
changes, including changes resulting from Plan Commission, BZA or other committee meetings.
