PYStatement of Commitment
Commitment Concerning the Real Estate Made in Connection
with Development Standards Variances
The owners of the real estate located in Hamilton County, Indiana, which is described below, makes the following
commitment concerning the following parcel of real estate:
Legal Description: Lot 33 in the Secondary Plat of Asherwood, as per the plat thereof, recorded December 29,
2021, as Instrument No. 202109293 1 in the Office of the Recorder of Hamilton County, Indiana.
Statement of Commitment: Owners shall use the attached residential accessory building structure as a pool house
and shall not be used as a residence or a dwelling.
This Commitment shall be binding on the Owners, subsequent owners of the real estate and other persons acquiring
an interest herein. This Commitment may be modified or terminated by a decision of the Board of Zoning Appeals
made a public hearing after proper notice has been given. The Commitment contained in this instrument shall be
effective upon the granting of the variances under Docket No. PZ-2023-00171 V and PZ-2023-00172 V approved
by the Board of Zoning Appeals, Hearing Officer.
The undersigned will record this Commitment in the Office of the Recorder of Hamilton County, Indiana, upon
final approval of Docket Nos. PZ-2023-00171 V and PZ-2023-00172 V by the Board of Zoning Appeals Hearing
Officer and will provide a copy of the recorded Commitment to the Department of Community Services within
thirty (30) days after the approval of the variances by the Board of Zoning Appeals Hearing Officer.
