The applicant seeks the following development standards variance approval: 2. Docket No. PZ-2023-00199 V UDO Sections 7.11.E.4 & 7.12.E.4 Entryway Feature location in street right of way not allowed, Location in ROW requested at Freeland Way & W. Smoky Row intersection. The site is located at 525 North End Dr. (closer to 0 Freeland Way). It is zoned UR/Urban Residential. Filed by Wendy Creech of Old Town Companies. General Info: • The Petitioner seeks approval for a ground sign within a street median. • The site is located in the North End development, along the north side of W. Smoky Row Rd. • Immediately surrounding this site are townhomes and single family homes; a restaurant will also exist in the development. • Please see the Petitioner’s info packet for more detail on the variance request . Variance Requested: Sign in Street Right of Way - • Stormwater structures in the adjacent Common Areas affect the placement of the sign. • The sign will be located in a landscaped median of Freeland Way, just north of W. Smoky Row. • The sign will be 4-ft to 5-ft tall and read: North End Carmel, and it will also have an Old Town logo sign (which is a placeholder for the future restaurant’s name). • The sign will be made of brick with a stone cornice, and it will be externally illuminated from the ground. • The sign base will be landscaped. • The sign will not impede vision clearance triangles at the intersection. Remaining Review Comments: • The Petitioner addressed all planning/zoning review comments. Final Comments: • Consent to Encroach approval from the BPW (Board of Public Works & Safety) has been granted. • Planning Staff is supportive of a sign variance for the sign, since the overall height has been reduced, and since the location minimizes the line of sight concern for the street intersection. • The Petitioner commits to maintain the monument sign, landscaping, and landscape elements in a manner consistent with the community landscape plan, as well as the requirements and expectations set forth by the City of Carmel. • Planning Staff can be also supportive of a sign variance for the sign, if the Petitioner also commits to maintaining the ground sign lighting in the median. Findings of Fact: • Please refer to the Petitioner’s Findings of Facts included in their BZA Info Packet. Recommendation: • The Dept. of Community Services (DOCS) recommends positive consideration of this variance request with the condition of the Petitioner maintaining the monument sign, landscaping, and landscape elements (including lighting) in a manner consistent with the community landscape plan, as well as the requirements and expectations set forth by the City of Carmel, and with adoption of the Findings of Fact submitted by the Petitioner.
