(V) 482 Almond Creek Dr. Lot Cover Variance.
The applicant seeks the following development standards variance approval:
3. Docket No. PZ-2023-00204 V Silvara PUD, Section 6.1 Maximum 35% lot coverage
allowed, 42% requested. The site is located at 482 Almond Creek Dr. (Jackson’s Grant on Williams Creek
Subdivision, Lot 333). It is zoned Silvara PUD/Planned Unit Development (Ordinance Z -652-20), The
Estates/Northvale planning area. Filed by Jim Shinaver with Nelson & Frankenberger on behalf of
Wedgwood Building Company, LLC.
General Info:
• The Petitioner seeks approval for a new house with attached garage and an in-ground swimming pool with
concrete decking and porch. (The pool pump will be of a quiet design.)
• A variance is requested to exceed the allowed lot coverage.
• The site is located in the Jackson’s Grant on Williams Creek Subdivision.
• Surrounding this site are single family residential homes.
• Homeowners’ Association HOA approval has been granted.
• Please see the Petitioner’s info packet for more detail on the variance request .
Variance Requested:
Lot Coverage -
• The Silvara PUD Ordinance allows for a maximum 35% lot coverage on this lot; the Petitioner requests 42%.
This is a variance of 7% .
• The Carmel Engineering Dept. has no comment on the lot cover percentage.
• The Hamilton County Surveyor’s Office approved the petition in ProjectDox, our e-plan review software.
• There is an overall drainage plan for the neighborhood.
Review Comments:
• The Petitioner addressed all planning/zoning review comments.
Final Comments:
• The Planning Dept. supports the variance request, since the Carmel Engineering Dept. and the Hamilton
County Surveyor’s Office have no concerns with the proposed lot cover percentage.
Findings of Fact:
• Please refer to the Petitioner’s Findings of Facts included in their BZA Info Packet.
Recommendation:
• The Dept. of Community Services (DOCS) recommends positive consideration of this variance request, and
with adoption of the Findings of Fact submitted by the Petitioner.
