RESOLUTION CC 04-17-23-01 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, APPROVING AN INTERGOVERNMENTAL TRANSFER OF PROPERTY Synopsis: Transfers $20,000 from the City of Carmel, Indiana to the City of Sullivan, Indiana to assist Sullivan with its tornado relief efforts. WHEREAS, on March 31, 2023, the City of Sullivan, Indiana (“Sullivan”) was ravaged by a large tornado that resulted in the deaths of three of its citizens and millions of dollars in property and infrastructure damage; and WHEREAS, Accelerate Indiana Municipalities, the preeminent municipal advocacy organization in Indiana, has issued a request to cities and towns across the state encouraging them to assist Sullivan’s disaster relief efforts; and WHEREAS, the City of Carmel (“Carmel”) has aided local governments throughout the country in their efforts to recover from natural disasters by donating money and equipment; and WHEREAS, Carmel desires to assist Sullivan in its hour of need; and WHEREAS, Carmel and Sullivan are both municipal corporations formed under the laws of the State of Indiana; and WHEREAS, the Common Council of the City of Carmel, Indiana (the “Council”) is the fiscal body for the City of Carmel, Indiana; and WHEREAS, Indiana Code Section 36-1-11-8 authorizes the transfer or exchange of property between governmental entities upon terms and conditions agreed upon by the entities, as evidenced by the adoption of a substantially identical resolution by each entity. NOW, THEREFORE, BE IT HEREBY RESOLVED AND AGREED BY THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, AS FOLLOWS: 1. The foregoing Recitals are fully incorporated herein by this reference. 2. Carmel agrees to transfer funds in the amount of Twenty Thousand Dollars ($20,000) (the “Funds”) to Sullivan for use in its tornado relief efforts. 3. Such transfer shall take place at a time and date mutually agreed upon by Carmel and Sullivan. 4. The Common Council hereby designates Ann Bingman, fiscal officer for the City of Carmel, Indiana, as its agent for purposes of completing the transfer of the Funds. Ms. Bingman is hereby authorized to execute all documents required in connection with the transfer of the Funds pursuant to this Resolution and to take all other lawful actions necessary to complete the transfer of the Funds as contemplated herein.
