The metal garage and block garage buildings will need to be demolished or

That easement served a specific purpose as being
designated as the BMP easement for the project. That
area is already also included in the Common Area and
DUE designations. Our intent is to have the BMP
easement over that portion of the common are that will
serve as our "dry basin"

The City's Mobility and Pedestrian plan requires a 10' multi-use path along
Range Line Rd. You may elect to provide a monetary commitment equal to

waive requirements from the city's ordinance. If you are
not able to bring this project/site into compliance with
the city's transportation plan you may request a
variance from section 1.07 Compliance of the City's
UDO. You may also choose to provide a monetary
commitment to the city's non-reverting thoroughfare
fund in lieu of constructing the required right-of-way
facilities.

Section 1.07 Compliance with the Thoroughfare Plan
Section 1.07 Compliance of the City's UDO states: E. Transportation Plan: In
addition to meeting requirements of Americans with Disabilities Act (ADA),
all projects and Improvements or authorizations under the planning
jurisdiction that adjoin, include, are served by or affect existing streets
bearing a designation in the Transportation Plan shall conform to the
requirements of the Transportation Plan Section of the Comprehensive Plan
in regard to: 1. The dedication of public Rights-of-way; 2. Design and
construction of the improvements indicated by the Transportation Plan
across the roadway frontage of the project; 3. Setback; and 4. Any other
affected development standards. F. Monetary Commitment In-lieu-of
Compliance: The petitioner may elect to provide a monetary commitment
equal to the value to otherwise design and construct the improvements
indicated by the Transportation Plan across the roadway frontage. The value
of the commitment shall be equal to the difference in the value to otherwise
design and construct the improvements indicated by the Transportation Plan
across the roadway frontage, minus the cost to design and construct those
improvements indicated by the Transportation Plan across the roadway
frontage that will be installed by the petitioner. The values established above
shall be approved by the Department of Engineering. Conformance with the

This is still not correct. The maximum height per the
Old Town Overlay is 30 ft. Please just remove the Max
Bldg Ht from the Secondary Plat so there is no
confusion. The maximum height doesn't need to be on
the recorded plat.

Please refer to UDO Article 7.18 for the monument and marker standards.
Per that section, please change the external corners of the subdivision to a
concrete monument, not less than twenty-four (24) inches in depth, not less
than four (4) inches square or five (5) inches in diameter, and marked on top
with a brass plug, ferrous or magnetic rod, or other durable material securely
embedded at major corners.

An adequate easement width, as detailed in Table 701-1, beyond the actual
footprint of the stormwater quality management facility (per PC-101) as well
as a 20-foot-wide BMP access easement from a public right-of-way to each
BMP shall be provided. Please revise to reflect the layout proposed.

The newly uploaded plat shows a variety of easement
that in there totality provide adequate easement area
over the BMP. The North-South total width is 20' with a
bump out for the landscape island. Along the eastern
edge is the planned parking lot and curb line. It makes
no sense to contiinue BMP easements into paved areas.
This is also where our proposed access easement for the
BMP AND cross access for the lots begins. We overlap
the access and BMP here measureing 75' in width off
the West end of Lots 1 & 2. With the recent
engineering apporval and staffs awareness of the
design, I believe that everyone can agree that additional
easement area beyond that is presently provided for
would be "overkill". So, if any additional variance must
be sought then it is now formally requested here.

As with PZ-2021-00195, since not all drainage comments have been
adequately addressed to meet the intent of the Stormwater Ordinance, our
office will not grant approval for this project. At the direction of the
Engineering department, we will designate this project as "No Comments" to
expedite its progress without further delay stemming from drainage review.
