Carolina Commons, Sec 1, lot 22 The applicant seeks the following development standards variance approval for a garage: Docket No. 06100021 V Chapter 6.04.03.A side yard setback The site is located at 10849 Wilmington Dr. and is zoned S-2/Residence. Filed by Michael Hurley. General Info: The garage is attached to the house via a breezeway, and so it is considered a part of the primary structure. The side yard requirement in the S-2 district is 10-ft. Currently, the garage is 6.2 feet from the north property line. Analysis: The garage could be 5-ft from the north property line (without variance approval) if the garage were not connected to the house with a breezeway. Right now, it is approximately 6.2 feet from the north property line. The variance request is for 3.8 feet. The garage does match the architectural style, color, and materials of the house. The approval of this variance will not be injurious to the public health, safety, morals, and general welfare of the community because: The variance request is for 3.8 feet of distance. The garage would be allowed to be 5-ft from the north property line (without variance approval) ifit were not connected to the house with an open-air breezeway. Right now, it is approximately 6.2 feet from the north property line. 2.) The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: The variance request is for 3.8 feet of distance. The garage would be allowed to be 5-ft from the north property line (without variance approval) if it were not connected to the house with an open-air breezeway. Right now, it is approximately 6.2 feet from the north property line. 3.) The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: the garage will need to be taken down and rebuilt 10-ft from the property line, or the current owner will have to tear down the connecting breezeway, which may possibly negatively affect the quality of life for the petitioner and cause a hardship. Recommendation: The Dept. of Community Services recommends positive consideration of Docket No. 06100021 V.
