DESCRIPTION PER TITLE COMMITMENT
The Land is described as follows:
A part of the Southeast Quarter of Section 34, Township 18 North, Range 3 East, in Hamilton County, Indiana, described as follows:
Begin at a point 439.57 feet West of the Southeast corner of Section 34 in Township 18 North of Range 3 East; run thence West 191.2 feet to an iron stake; thence North 419.35 feet
to an iron stake; thence East 191.2 feet to an iron stake; thence South 419.35 feet to the place up beginning, containing 1.84 acres, more or less.
EXCEPTING THEREFROM that real estate having been conveyed to the City of Carmel, Indiana, by Warranty Deed from Emma Lou Cunningham dated February 9, 2012 and
recorded April 10, 2012 as Instrument No. 201-201-8966, and being more particularly described as follows:
A part of the Southeast Quarter of Section 34, Township 18 North, Range 3 East, in Hamilton County, Indiana, described as follows:

SURVEYOR'S REPORT
In accordance with Title 865, Article 1, Chapter 12 of the Indiana Administrative Code ("Rule 12"), the following observations and opinions are submitted regarding the various
uncertainties in the locations of the lines and corners established this survey as a result of uncertainties in availability and conditions of reference monuments; in lines of occupation;
in clarity or ambiguity of the record descriptions; and as introduced by random errors in measurement ("Relative Positional Precision"). There may be unwritten rights associated
with these uncertainties. The client should assume there is an amount of uncertainty along any line equal in magnitude to the discrepancy in the location of the lines of possession
from the surveyed lines.
There may be differences between deed or plat dimensions and measured dimensions along some of the boundary lines shown hereon.
This survey and report are based in part upon opinions formed in accordance with an Indiana Land Surveyor's responsibility to conduct a survey in accordance with “law or a
precedent” (865 IAC 1-12-11(5), Rules of the Indiana State Board of Registration for Land Surveyors). Since Indiana has no statutes addressing how to resolve boundary lines, a
solution based on principles derived from common law precedent must be relied upon as the basis for a boundary resolution.
Unless otherwise noted or depicted hereon, there is no evidence of occupation along the perimeter lines of the subject tract. All survey monuments set or found this survey are flush
with existing grade unless otherwise noted.
The purpose of this survey was to perform an ALTA/NSPS Land Title Survey of a 1.71 acre ± parcel in the Southeast Quarter of Section 34, Township 18 North, Range 03 East as
described in Instrument #2014030597 in the office of the Recorder of Hamilton County, Indiana for use in real estate development.
The horizontal location data shown on this survey is based upon standard surveying measurement practices utilizing Topcon Real Time Kinematic (RTK) Global Navigation
Satellite System (GNSS) units, a Topcon GTS-602 total station and/or data obtained from the INDOT, INCORS network. Any coordinates, if shown or used on this survey are
referenced to the Indiana State Plane Coordinate System, East Zone, referenced to the North American Datum of 1983 (NAD '83)(2011) or a local system.
The basis of bearings for this survey is referenced to the South line of the Southeast Quarter of Section 34, using monuments as described by the Hamilton County Surveyor's Office.
Said bearing is measured as North 89 degrees 37 minutes 50 seconds East according to the coordinate system noted above.
Only rights-of-way (R/W or ROW) of record are graphically depicted on this survey.
A.Availability and Conditions of Reference Monuments:
The following monuments are taken from evidence found in the field provided by the Hamilton County Surveyors Office, previous surveys (referenced herein) or calculations made
internally to the locations of the section corners to determine the Southeast Quarter of Section 34.
- Southeast Corner of the Southeast Quarter - Harrison Monument found flush per Hamilton County Surveyor's Corner Records
- Northeast Corner of the Southeast Quarter - Harrison Monument found during previous S&A survey, monument likely removed due to recent construction on Spring Mill Road.
- Southwest Corner of the Southeast Quarter - Mag Nail of unknown origin, found during previous S&A survey referenced above. Monument not found at time of this survey, likely
removed due to recent resurfacing of 116th Street. The last available Hamilton County Surveyor's Corner Record is dated August 18, 1935 and none of those ties remain. A position
for said corner was calculated based upon Cripe Boundary Calc. Sheet noted on the previous survey. The calculated position lies 0.4 feet South and 0.3 feet East of the found Mag
Nail. Said Mag Nail was accepted as the corner per this survey and the uncertainty in the position of this corner is 0.4 feet in any direction.
All monuments found or set are flush with the surface, unless otherwise noted.
There were 5/8” rebars found near three corners of the subject tract as shown on this survey.
There may be references made to monuments found at or near the corners, or along the deed lines of the subject real estate. In cases where the monument is not exactly in agreement
with this survey but within the Relative Positional Precision of the measurements on this survey, no new monument was set and the difference is shown only to accentuate the
uncertainty of that corner. In those cases where the difference is greater than the Relative Positional Precision and uncertainty in referenced monuments, caution should be exercised
before making any improvements along those lines affected. Those uncertainties should be considered to be significant and are discussed below.
B.Lines of Occupation:
Occupation along the South line of the subject tract is to improvements found along West 116th Street.
Occupation along the West line of the subject tract is to a woven wire fence which varies from plus or minus along the line to 1.4 feet West of the line.
Occupation along the North line of the subject tract is to a woven wire fence which varies from 2.4' South to 0.5' South of the line.
Occupation along the East line of the subject tract is to a woven wire fence which varies from 1.4' West to plus or minus along the line.
C.Clarity or Ambiguity of the Record Descriptions:
There was found to be a gap in deed descriptions between the subject tract and the adjoiner to the West measuring 1 foot on the North end to 0 feet on the South end.
Unless discussed above, there are no discrepancies between the record land descriptions of the subject real estate and the adjoiners. A title company and/or legal counsel should be
consulted regarding any deed overlap and deed gap areas if shown on this survey. The lines of the subject real estate can be considered to be contiguous with the adjoiners' lines if
no gap or overlaps are noted.
D.The Relative Positional Precision of the Measurements:
The maximum allowable Relative Positional Precision for and ALTA/NSPS Land Title Survey is 2 cm (0.07 feet) plus 50 parts per million (based on the direct distance between the
two corners being tested). It is recognized that in certain circumstances, the size or configuration of the surveyed property, or the relief, vegetation, or improvements on the surveyed
property, will result in the survey measurements for which the maximum allowable Relative Positional Precision may be exceeded. If the maximum allowable Relative Positional
Precision is exceeded, the surveyor shall note the reason.
Theory of Location:
The Southeast Quarter of Section 34 was defined using monuments as described in Section A of this report. The deed description for the subject tract is a metes and bounds
description utilizing only cardinal directions (North, East, South & West). The first line of the deed description, “Begin at a point 439.57 feet West of the Southeast corner of Section
34 in Township 18 North of Range 3 East”, was taken to mean along the South line of the Southeast Quarter. The distances contained within this deed were held exact and the
cardinal directions were held to be parallel to the South & East lines of the Quarter Section.
E.Positional Uncertainty:
As a result of the above observations, it is my opinion that the uncertainties in the location of the lines and corners established on this survey are as follows:
Due to Variances in reference monuments:2.4 feet (5/8” rebar with “WEIHE” cap found near Northeast corner of subject tract)
Due to Inconsistencies in lines of occupation: 2.4 feet (farthest woven wire fence measured from North line of subject tract)
Due to Discrepancies in record descriptions: 1 foot (gap between subject tract and West adjoiner)
