The applicant seeks to plat 4 lots on 2.84 acres.
The applicant seeks the following waivers:
06080008 SW: SCO Chapter 6.03.20 Private Streets.
06080023 SW: SCO Chapter 06.03.22 Accel./ Decel, Passing Lanes: request
to waive requirement of constru ction acceleration, deceleration and passing
lanes.
06080024 SW: SCO Chapter 08.09.01: Alternative Transportation: request
to waive requirement of internal sidewalks.
06080025 SW: SCO Chapter 08.09.02: Alt. Transportation: request to waive
requirement of perimeter path.
The site is located on 126th Street between Spring Violet Place and Sugar Cay
Court, and is zoned S I and S2.
Filed by Gary Murray of The Schneider Corporation for Robert E. Stein of the
Stein Investment Group.
The applicant is requesting approval of a Primary Plat to allow the construction of 3
single family detached homes. Please see the informational packet prepared by the
applicant for an overview of this project. This project is proposed to make use of a
private shared driveway (not a private street).
These parcels have two different zoning classifications, S I and S2. As proposed, these
lots meet the minimum standards associated with their zoning. The proposed layout
would require the above listed subdivision waivers.
As a point of note, it would be a legal possibility to configure these parcels to each have
individual access on 126th Street and would thus eliminate the need for the above
mentioned waivers. With the shared driveway configuration these lots will only add one
additional point of access/conflict on 126th Street.
Staff requests the following items be submitted and discussed at the Subdivision
Committee meeting.
1. Please correct your aerial photo exhibit to accurately portray the project bounds.
Your southern boundary does not terminate at the fence line - there is an easement on
the north side of the fence that is part of the lots to the south.
2. Please provide an update on all outstanding Engineering and Urban Forrester
comments and concerns.
3. Please provide a chart of comparison of how your proposed homes will compare to
the City's Draft Residential Architecture Standards.

4. Can you provide character photos of the types of houses that will be constructed on
these lots?
5. Please identify the building footprint for each of the proposed lots.
6. Will the existing trees on these lots remain? If so, please provide a tree preservation
plan that identifies the exact trees that will remain. This plan should also include
language on the practices that will be used to protect the trees and their drip line at
time of construction.
7. Will these lots be subject to covenants? If so, will these covenants include rules on
the upkeep and maintenance of the private drive? To ensure public safety access, this
dri ve must remain accessible.
The Department recommends the Plan Commission forward this item to the
October 3rd Subdivision Committee Meeting for further discussion.
