We believe many significant issues remain unresolved and the latest plan is, in fact, a step backward from the progress made between Pulte Homes and the neighbors of the surrounding subdivisions. We therefore, request that the subcommittee consider the following issues and reject this latest development plan until resolution of these issues is obtained. 1. At no time has Pulte asked for our input regarding its latest development plan. Pulte submitted this plan the Thursday before this meeting and confirmed via email request they were presenting the Friday before this meeting. At all three prior planning commission meetings regarding the proposed development, Pulte has been criticized by this committee regarding its poor cooperation with neighbors. We have been ignored in this latest plan revision. 2. The proposed high-density, duplex development violates Carmel's current master development plan. The current zoning is for single family, residential housing. What good is this plan if builders are allowed to violate it at will? 3. Besides builder profits, no compelling reason for this high-density, duplex development has been provided. At its last presentation, Pulte promised and failed to deliver the details of its analysis where it alleged financial benefits to the city of Carmel. Pulte's past actions have given us no reason to trust the integrity of its analysis. 4. Current home sales make the viability of this project questionable. Our research indicates that new home building permit applications have fallen 20-25% in Carmel. Many town homes remain unsold and new construction delayed on others. Our concern is should this subdivision be built, many of these homes will become rental properties. This introduces a whole range of potential transient, rental related problems less likely to occur in single family home subdivisions. 5. The proposed high density, duplexes have been moved to 30 feet (10 yards) from the proposed property line. From the first full planning commission meeting Pulte has been told that their buildings should be a minimum of 50 feet from the property line. We believe that closer development of the proposed high-density, two-story duplexes greatly 1 o o impacts adjacent Autumn Lake homeowners' privacy. In addition, the duplexes are only ten feet apart leaving little "blue sky" between homes. This is definitely a step backward in their proposal. 6. The many important details of the proposed high-density duplex designs are missing. This includes the exterior design, interior design, materials composition, foundation, and other critical construction specifications. Without full disclosure it is impossible to assess the final value of the homes to determine whether or not they come close to, much less equal, surrounding property values. 7. No fencing or landscaping plans have been provided specifying how the latest proposal will separate the proposed subdivision from surrounding subdivisions or will transition the proposed subdivision to others. The prior plan did provide this information. The current design does not provide consideration of this separation or transition. Again, this is a step backward. 8. Pulte continues to ignore important recommendations made by the commission. For example, it has not developed a tree preservation plan. A second example is that it has continued to specify high-density road layouts while it was recommended that Pulte explore alternative designs that would not result in an uninteresting, cookie-cutter neighborhood. A third example is that they present a single-family proposal which they have not provided evidence they have done. 9. The entrance/exit to the proposed duplex development does not meet the 500 foot minimum distance from the next public intersection as specified by Carmel city code. This requirement was met in Pulte's prior plan but has been removed from the current plan. We believe this represents a significant traffic safety issue. 10. The Carmel Fire Department, Department of Community Services, and Street Department have all previously stated they favor public streets within the proposed development. They continue to ignore the recommendations of these city departments. Many design details are missing for the proposed private roads including curbing and composition. 11. The proposed connecting stub road from the development to the Autumn lake subdivision continues to pose public safety risks to both current and future developments. Both the proposed Rohrer Road development and Autumn Lake subdivisions currently have only one access road in and out of them. Should one become blocked the proposed stub road imposes significant, unnecessary time delays in emergency service response between subdivisions. 2 , . o o 12. No guest parking is indicated on the latest plan. With high-density, duplexes specified with substandard streets this will result in parking problems. Our concern is overflow parking causing congestion in the surrounding subdivisions, especially when residents hold parties or family events. 13. No Rohrer Road roadbed improvements or traffic control improvements have been specified in the proposed plan. Besides the two other new subdivisions proposed for Rohrer Road, Pulte's proposal would add 38 high-density, duplexes with multiple cars. This will significantly add to commuting traffic. We believe that Pulte should pre- commit to a large, equitable share of the cost related to these improvements before any construction is allowed to begin. 14. No public street lighting has been indicated on the latest plan. Will there be lighting? If so, what type and locations of lights will be used. 15. The impact of digging basements has not been assessed. Will the extra dirt for 38 duplexes be spread out on the site, further raising its elevation? Or, will it be removed from the site and the elevation reduced? Our concern is increased water drainage from increased site elevation. 16. The current documentation does not address the existing water drainage problem into other subdivisions. The prior plan addressed these issues to a large extent. However, no documentation has been provided relative to how the current plan will alleviate drainage problems. 17. The current plan does not address city utilities connection issues. Dedicated water and sewer connections were made to connect the Autumn Lake subdivision when it was built. Capacity does not exist to extend this to the new development. Where is Pulte expected to make these utility connections? 18. There is no public park and Monon Trail access specified on the latest plan. In the prior Pulte plan a public park with Monon Trail access was specified. Pulte made this commitment to surrounding neighbors in its prior plans and discussions. However, it has been deleted from this plan. 19. Pulte's current plan will negatively impact surrounding property values. While Pulte's late submission of its current plan prevented us from performing a detailed survey of realtors, we did speak with a realtor whose initial impression was that the proposed high-density, duplex plan will negatively impact surrounding property values. Those homes closest to the new development will be impacted the most. Why should we be negative impacted without due compensation? 3 "' '-.) o ~w~\ Y'f\ ~""DY) ~~ D . On Thursday, August 31 S\ 2006, Pulte met with Matt Griffin of the DOCS to submit the revised site plan and the front elevation. I met with Matt the next day and this, (show paperwork), is what was ,~:,,:/~,----,_ .y . gIven to me. , (: " ~\ ", ~~ ~ -, . ~ ~ 'I- I couldn't believe it. After almost a year, these "revised" plans a\re ~ ~~ ~ )~ a joke. This is it? I don't think they are very serious about '\, ~ ~ /- building on those parcels of land. ''''>_ _._---;<<,' . On the same day that I received this paperwork, I met with Gary Duncan, Assistant City Engineer. This would be Friday, September 1 S\ 2006. Please note that this is just the day before the Labor Day Weekend. I showed Gary the latest revised site plan. Gary has given me permission to go on record with the following comments and I quote: "I thought this was dropped as I did not hear from anyone since I sent Pulte an email in October, 2005. Pulte NEVER has replied to the engineering department regarding the comments for this development in that email. Why are they still allowed to go on after ignoring us for almost a year?" End quote. I agreed with him and told him that there needed to be some type of policy in place before developers could get back on schedule with the subdivision committee. The present method of continuously returning to the committee with little or none of the suggestions made by the committee acted upon or approvals by the various departments of the city is doing nothing but wasting the committee's time and everyone one else's time. During the second week of June, I met with Steve Schutz and Will Wright who are local builders in Carmel. They expressed interest in buying this property and building 2 story town homes with basements. This is what you see here tonight. I gave them an engineering site plan and went over some of the comments that this ~ o w committee had made and told the two builders what the homeowners were also looking for. I emphasized how important it was for them to meet with the homeowners before any plans were brought to the subdivision committee, unlike Pulte. Steve and Will agreed. It has been approximately three months since that meeting and the Autumn Lake homeowners have NEVER heard from Steve Schutz, Will Wright or Pulte. No one is listening to the homeowners or this committee. There seems to be little to no respect for any of us. Tonight we ask the committee to throw out this project and keep the parcels residential. This will consist of sixty five three story town homes which will back up approximately 35 feet to the nearest residential homes in Autumn Lakes. We, the undersigned, are concerned dtizens who urge our leaders to act now to elect NOT to rezone this parcel from Rl residential to PUD. It is NOT in conformity with the comprehensive plan of low density construction. It is NOT compatible to the adjacent homes. After speaking with several realtors, the owners have come to realize that property values WILL go down in the entire subdivision. There is no way to permanently screen Autumn Lakes in such a manner that will protect the owners privacy. If the rezoning of above acreage is approved as a PUD, the homeowners have listed the following demands: We, the undersigned, are concerned citizens who urge our leaders to act now to have Pulte Homes of Indiana 1. Build two story town homes instead of three story town homes. 2. Any rear facing building to the Autumn Lakes subdivision should have dormers, shutters, and bump outs. (See exhibits of acceptable two story buildings). ' 3. Buildings will be bricked on all sides. 4. There should be many windows on the sides of all the town homes and not just a few. 5. There should be a 4-6 foot mound with a privacy fence and landscaping extending from Rohrer Road to the Monon Trail between Autumn Lakes and the proposed PUD. 6. Drainage issues are to be addressed on both sides of the proposed mound, (See number 5). 7. Create a minimum buffer of 100 feet between Autumn Lakes subdivision and proposed Monon Townes development OR ~ 8. The entrance to Monon Town shall be 500 feet from the Intersection of Rohrer Road and Nevelle Lane as required by the Engineering Department. The Carmel Fire Department, the Department of Community Services and the Street Department are all in favor of a..public street into the Monon Townes development. ~ 9. The new public street into Monon Townes should Intersect with Autumn Lake Overlook Drive and terminate in a cul- de-sac east of the extension of Autumn Lake Overlook Dr. This should help to solve the drainage problem to Autumn Lakes subdivision. 10. Put in a speed bump where Autumn Lake Overlook Dr. intersects the public street in the Monon Townes development. 11. Brick or stone walls should separate the entrance to the Monon Townes from Autumn Lake Overlook Dr. similar to the entrance from Rohrer Road with lighting and landscaping. 12. Install indirect lighting instead of globe lights for street lighting. 13. Add more than eleven guest parking spaces. 14.
