CARMEL BOARD OF ZONING APPEALS HEARING OFFICER
DEPARTMENT REPORT
MONDAY, OCTOBER 23, 2023
(V) Serafin Residence, Rear Setback Variance.
The applicant seeks the following development standards variance approval:
1. Docket No. PZ-2023-00205 V Silvara PUD Section 6.1 Minimum 20-ft rear yard
building setback allowed, 15-ft requested. The site is located at 1009 Domino Dr. (Jackson’s Grant on
Williams Creek Subdivision, Lot 145). It is zoned Silvara PUD/Planned Unit Development (Ordinance Z-
652-20), Creekside planning area. Filed by Laurie Tinsley (and Adam Garvey of Artisan Landscapes), on
behalf of Alex Serafin & Lauren Parent, owners.
General Info:
• The Petitioner seeks variance approval for a proposed residential building addition setback.
• A variance is requested have a reduced rear yard building setback.
• The site is located in the Jackson’s Grant on Williams Creek Subdivision.
• Surrounding this site are single family residential homes.
• Homeowners’ Association HOA approval has been granted with pending building permit B-2023-00938.
• Please see the Petitioner’s info packet for more detail on the variance request.
Variance Requested:
Rear Setback -
• The Silvara PUD Ordinance allows for minimum 20-ft rear yard building setback, and the Petitioner requests
15-ft. This is a variance of 5, feet or a percent change of 25% .
• The Carmel Engineering Dept. has no concern about the proposed setback.
• The Hamilton County Surveyor’s Office approved the petition in ProjectDox, our e-plan review software.
• There is a 15-ft wide drainage easement along the rear of the lot.
• The design will be an open air porch addition with covered roof that will have architectural 3-tab asphalt
shingles, and be a color to match the house.
Review Comments:
• The Petitioner addressed all planning/zoning review comments.
Final Comments:
• The Planning Dept. supports the variance request, since the Carmel Engineering Dept. and the Hamilton
County Surveyor’s Office have no concerns with the proposed building setback, and since only a few
arborvitae shrubs will be encroaching into the rear drainage/utility easement.
Findings of Fact:
• Please refer to the Petitioner’s Findings of Facts included in their BZA Info Packet.
Recommendation:
• The Dept. of Community Services (DOCS) recommends positive consideration of this variance request, and
with adoption of the Findings of Fact submitted by the Petitioner.
