DEPARTMENT REPORT
MONDAY, OCTOBER 23, 2023
(V) Hamman Accessory Building Height Variance.
The applicant seeks the following development standards variance approval:
9. Docket No. PZ-2023-00226V UDO Section 2.04 Maximum 18-ft accessory building
height allowed, 23-ft requested.
The 5.6-acre site is located at 11120 Queens Way Cir. (Queen’s Manor Subdivision, Lot 3). It is zoned
S1/Residence. Filed by Suzanne Baker of Dentons Bingham Greenebaum LLP, on behalf of Jeremiah &
Nessa Hamman, owners.
General Info:
• The Petitioner seeks approval for a 50’ x 100’ accessory building on a 5.6 acre lot.
• It will be set back from the street approximately 360 feet.
• One variance is requested to exceed the allowed accessory building height.
• The site is located in Queen’s Manor Subdivision.
• It’s understood that the Homeowners’ Association disbanded some time ago and is no longer functioning.
• Surrounding this site are single family residential homes.
• Please see the Petitioner’s info packet for more detail on the variance request.
Variance Requested:
Accessory Building Height -
• A maximum 18-ft building height is allowed for accessory buildings, and 23 feet is requested.
• This is a variance of 5 feet, or a 28% change/increase.
• Building Height is defined as the vertical distance from the lot ground level to the highest point of the roof
for a flat roof, to the deck line of a mansard roof and to the mean height between eaves and ridges for gable,
hip, and gambrel roofs. (The proposed building height is closer to 20.4’, when going by this definition.)
• The measurement up to the roof peak will be 22’ 11.5”, and the measurement up to the eaves will be 16’4”'.
• The structure will have side and rear yard building setbacks of 120 feet and 98 feet.
• The metal structure will be a black matte color which complements the house colors of white and black.
Review Comments:
• The Petitioner addressed all planning/zoning review comments.
Final Comments:
• The Planning Dept. supports the variance request, since the structure will be on such a large lot (5.6 acres);
there will be more than adequate setbacks and distance buffers to help mitigate the small height increase.
Findings of Fact:

Recommendation:
• The Dept. of Community Services (DOCS) recommends positive consideration of this variance request, and
with adoption of the Findings of Fact submitted by the Petitioner.
