The applicant seeks the following development standards variance approval, related to the Woodland Golf Training and Tennis Pavilion: 5. Docket No. PZ-2023-00203 V UDO Sections 1.07 (E) and (F) Transportation Plan Compliance required, No sidewalk requested. The site is located at 100 Woodland Ln. and is zoned P1/Parks and Recreation. Filed by E. Davis Coots of Coots Henke & Wheeler, on behalf of Woodland Country Club Inc. General Info: • The Woodland Golf Training and Tennis Pavilion project has been approved with conditions (related to seeking BZA variance approval), for docket no. PZ-2022-00252 TAC. • A BZA variance from the Transportation Plan Compliance requirement is requested. • The site is located near the Woodland Golf Club residential subdivision and the Woodland Country Club. • A golf course and single family homes surround the subject site. • Please see the Petitioner’s info packet for more detail on the variance request. Variance Requested: Transportation Plan Compliance - • The Petitioner does not want to comply with the Transportation Plan requirements regarding installation of sidewalk along the site’s street frontage (or pay what it would cost to construct said sidewalk into the Thoroughfare Fund). • The length of the 5-ft wide sidewalk required for the subject site is approximately 517 feet. • The construction cost estimate to install the sidewalk is approximately $36,000. • UDO sections 1.07 (E) and 1.07 (F) state the following regarding compliance with the Transportation Plan: E. Transportation Plan: In addition to meeting requirements of Americans with Disabilities Act (ADA), all projects and improvements or authorizations under the planning jurisdiction that adjoin, include, are served by or affect existing streets bearing a designation in the Transportation Plan shall conform to the requirements of Transportation Plan Section of the Comprehensive Plan in regard to: 1. The dedication of public Rights-of-way; 2. Design and construction of the improvements indicated by the Transportation Plan across the roadway frontage of the project; 3. Setback; and 4. Any other affected development standards. F. Monetary Commitment In-lieu-of Compliance: The petitioner may elect to provide a monetary commitment equal to the value to otherwise design and construct the improvements indicated by the Transportation Plan across the roadway frontage. The value of the commitment shall be equal to the difference in the value to otherwise design and construct the improvements indicated by the Transportation Plan across the roadway frontage, minus the cost to design and construct those improvements indicated by the Transportation Plan across the roadway frontage that will be installed by the petitioner. The values established above shall be approved by the Department of Engineering. Conformance with the Transportation Plan as outlined above shall be in addition to any improvements required: 1. On the application form for a Subdivision; 2. In Article 9, Section 9.03(B)(2)(e)(v): Service Reports; and 3. Any other applicable standards. Review Comments: • All planning/zoning review comments related to the variance applications have been addressed. 17 of 19 Final Comments: • The Carmel Engineering Dept. and the Carmel Transportation Systems Administrator/ADA Coordinator are not supportive of this variance request. • Also, the Planning Dept. is not supportive of this variance request. • The sidewalk requirement is applied to all new projects. There are two options for compliance - the sidewalk segment can be installed by the Petitioner, or the Petitioner can pay into the Thoroughfare Fund for what it would cost to construct the sidewalk. • A construction cost estimate has been provided by the Petitioner. Findings of Fact: • Please direct the BZA Attorney to write up the negative Findings of Fact. Recommendation: • The Dept. of Community Services (DOCS) recommends negative consideration of the variance request.
