DEPARTMENT REPORT

(V) Meyer Outdoor Fireplace Variance.
The applicant seeks the following development standards variance approval:
6. Docket No. PZ-2023-00211 V UDO Section 5.02 Minimum 5-ft side/rear yard setback
for accessory structures required, 1-ft requested. The site is located at 11179 Westminster Way and
is zoned S2/Residence (Kingswood Subdivision Lot 19). Filed by Jared & Kyra Meyer, owners.
General Info:
• The Petitioner seeks approval for the side yard setback of an existing outdoor fireplace structure constructed
by a prior landowner.
• A complaint was initially received by the Carmel Code Enforcement Dept., prompting investigation.
• The site is located in the Kingswood Subdivision.
• Single Family dwellings surround the site.
• Please see the Petitioner’s info packet for more detail on the variance request.
Variance Requested:
Accessory Structure Side Setback -
• Per the UDO, an accessory structure/building must be located at least 5-ft from any side/rear property line.
• The requested setback for this existing outdoor fireplace structure is approximately 1 foot.
• This is a variance of 4 feet, or an 80% change.
• The outdoor fireplace is approximately 11 feet tall to the top of the chimney.
• The neighbor’s house to the north is located approximately 14 feet from the outdoor fireplace structure.
Review Comments:
• All planning/zoning review comments related to the variance application had been addressed.
Final Comments:
• The Planning Dept. is supportive of this variance request.
• The Code Enforcement Dept. has no concerns with the variance request.
Findings of Fact:
• Please refer to the Petitioner’s Findings of Facts included in their BZA Info Packet.
Recommendation:
• The Dept. of Community Services (DOCS) recommends positive consideration of the variance request, and
with the adoption of the Findings of Facts submitted by the Petitioner.
