STATEMENT OF VARIANCE REQUEST

Request to allow a sign to be placed on the Drive -Up
Canopy which would face the parking lot and not be seen
from either street but would be only visible from the
parking lot area of the Bank.
ODO Section 5.39 (1) does not allow this sign but we are
seeking a variance to allow this sign.
STATEMENT OF SUPPORT
Docket No. PZ-2023-00250V
This Variance Request will allow BMO Bank to install and BMO Log sign on
the south side of the Blue Panel on the outside edge of the drive -up canopy.
This sign will only be visible to the Bank customers as it faces the parking lot
and is not visible from the streets.

FINDINGS OF FACT SHEET - DEVELOPMENT STANDARDS VARIANCE
CARMEL ADVISORY BOARD OF ZONING APPEALS

Petitioner: S-Mart Real Estate, Inc., Warren Johnson and/or Brian Johnson
The approval of this variance will not be injurious to the public health, safety, morals and
general welfare of the community because:
This variance will have no effect on public safety, health, morals, or General welfare
of the community as only deals with a sign which is only visible from the parking
area on the rear of the BMO Bank Building.
The use and value of the area adjacent to the property included in the variance will not be
affected in a substantially adverse manner because:
Granting this variance will not negatively affect the adjacent properties as it will only
be seen from the parking lot by customers of the Bank.
The strict application of the terms of the Unified Development to the property will result in
practical difficulties in the use of the property because:
As with any business, visibility, accessibility and appearance are critical to the
success of any business. Not allowing this sign will remove the corporate image
that BMO desires to present to its customers and alter an image BMO strives for in
its drive up canopy area.
DECISION
IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that Development
Standards Variance Docket No. PZ-2023-00250V is granted, subject to any conditions stated in
the minutes of this Board, which are incorporated herein by reference and made a part hereof.
