Dear Mr. Wert:
At the meeting held on Monday, October 23, 2023, the Carmel Advisory Board of Zoning Appeals took the
following action regarding the Use Variance (UV) and Variance (V) requests filed by you for the property located
at 10402 N. College Avenue:
APPROVED: Rosie’s Gardens Expansion, Use Variance & Developmental Standards Variance approvals for:
• Docket No. PZ-2023-00198 UV: Prohibited Uses – Storage and/or Warehousing Outdoor prohibited –
existing and proposed is granted.
• Docket No. PZ-2023-00200 V: No parking allowed in the Front Yard, Parking is granted.
• Docket No. PZ-2023-00201 V: Number of signs – 1 sign per street frontage allowed, 3 existing and 4
granted.
Please be advised that per Article 9.15 of the Unified Development Ordinance, the aforementioned Use Variance
approval is valid for three (3) years. By that time, either continuous construction of the improvements must be
underway, or a written request for a one-time, six-month extension of the approval must have been received and
approval granted by this Department. The expiration date of the use variance approval is October 23, 2026.
Please include a copy of this letter with any permit application.
