of Zoning Appeals and Indiana law will be provided. This request is not made for purposes of
delay but to allow Cingular the opportunity to fully explore opportunities with regard to this site.

I am in receipt of your e-mail, dated April 12, 2006, outlining the Department of Community
Services review comments regarding Cingular's filings in the above-referenced dockets and can
provide the following responses. I will respond to those comments as numbered 1 - 16 in your
e-mail. At the outset, please be advised that we did not proceed with the notice for the May 22nd
docket because of the need for an additional variance as outlined in more detail in response to
No. 10 below. /
1. Make sure the public notice meeting time to the newspaper and neighbors reads 6
p.m. It is suggested to send the notice to the Indianapolis Star newspaper by Noon, two
days prior to the printing deadline (317-444-7163 or email: publicnotices@indystar.com).
This will confirm that the notice to the neighbors will read "6:00 p.m." for the Board of
Zoning Appeals ("BZA") public meeting time. Notice will be submitted to the Indianapolis Star
prior to the stated deadline. We are proceeding under the assumption that this matter will be
docketed for the June 26, 2006 BZA meeting.
2. Plans must be submitted to T AC members by Mav 2. Attached is the T AC members
list. Provide copies of Letters of Transmittal to DOCS as proof of delivery.
Per the follow-up e-mails we exchange, a complete set of plans (reduced-size - 11 x 17)
for the project shall be presented to the Technical Advisory Committee ("T AC") bye-mail prior
to the deadline and copies ofthe letters of transmittal will be submitted to the Department of

3. Provide filled out and notarized the Petitioner's Public Notice Affidavits (page 6 of
both applications).
Enclosed please find the original and one (1) copy of the completed Petitioner's Public
Notice Affidavit for each currently filed petition. However, since notice has not yet been sent,
and therefore a supplemental submission of each affidavit will be submitted along with the new
petition to be filed.
4. Please provide material used and color elevations of the equipment building.
Enclosed please find one (1) color photograph of the equipment buildings and elevation
drawing of the equipment building. I have also enclosed a piece of the fa9ade that will be used
for the equipment shelter.
5. Please bring material and color samples to the BZA meeting.
We will bring a sample of the fa9ade of the equipment building to the BZA meeting.
6. Per Chapter 25.13.01.7, provide commitments regarding co-location.
Enclosed please find written commitments including commitments for collocation for the
site. Signed commitments will be forthcoming to you by the deadline for the new hearing date

7. Will the proposed equipment building be able to house other co-locators & their
equipment?
The equipment building will not be able to house other collocators' equipment, as it will
be completely occupied by Cingular. However, Cingular has a lease area large enough for at
least one (1) additional carrier and other carriers will be able to lease property from the
landowner for their own equipment structures. There is every reason to believe sufficient land is
available for additional carriers' equipment.
8. Please provide an exhibit showing the proposed tower's coverage area.

9. Provide an exhibit showing Cingular's current coverage area and gaps of service in
the township.
Enclosed please find two coverage maps for all of Carmel-Clay. One reflects all of the
coverage area for Clay Township without this Site 410 or Sites 194,340,337,339 and 415, some
of which will be proposed to be located within Clay Township and some of which might be
located outside of Clay Township. The other coverage map reflects Clay Township with this
Site 410 and Sites 194,340,337 and 415 after installation. I have also enclosed a color
"proposed" and "existing" Cingular site map, which does not include radio frequency coverage
data, for your reference. This has previously been provided to Mike Hollibaugh. See report of
Hamed Zia.
10. Landscape Plan: re-review the requirements of Chapter 25.13.01.3 regarding plant
type, spacing and planting area width.
After review, Cingular will require an additional development standard variance of the
landscape requirements under Chapter 25 13.01.3 of the Zoning Ordinance because to comply
with those requirements substantially interferes with the primary use of the official site as a golf
course. The proposed wireless telecommunications tower will be located adjacent to the
maintenance and equipment storage facility for the golf course. To install and maintain a 15'
landscape buffer around the perimeter of the fenced area which contains the Tower and the radio
equipment building will interfere with the staging area used for maintenance and construction
activities for the golf course. It would not be as desirable to neighboring properties to expand the
maintenance facility and staging area when the landscaping will be virtually out of sight. We
anticipate adding the new development standard variance to the current Docket No. 06040015 V
subject to staff's approval as to the procedure.
11. Fence Type: discuss whether or not the homeowners' association would prefer a
shadowbox fence to a chain-link fence.
Cingular has contacted the neighborhood association to discuss the type of fence they
would prefer and will provide you with that information as soon as they respond. I note the
drawings reflect a chain-link fence, but the photographic simulations reflect a wooded fence.
Please also note that the Brookshire Neighborhood Association has just changed presidents.
12. Lighting: will this monopole have a strobe light or any lighting?

The monopole structure will have no lighting or special identification painting. See

13. Equipment Building: show that the humminglbuzzing of the equipment will not be
heard by the nearest neighbor.
There should be no sound coming from the building as no generators will be utilized,
only radio equipment, and the radio equipment is silent. Back-up power will be utilized through
solid battery cells.
14. On the site plan, showllabel the distance of the tower to the closest property line,
and showllabel the required distance from a residential property.
On the last page of the site plans presented which is described as the "Parent Tract
Detail", the distance to property lines was reflected as well as the distance to the nearest
residential property. Cingular will provide additional information if required.
15. Please make checks payable to the City of Carmel.
Checks for fees will be made out as instructed.
16. Additional comments may be made at the TAC meeting.
Cingular intends to participate in the T AC meeting and will develop responses to all

STATEMENT OF COMMITMENTS
COMMITMENTS CONCERNING THE USE OR DEVELOPMENT OF REAL ESTATE MADE IN
CONNECTION WITH DEVELOPMENT STANDARDS VARIANCE AND SPECIAL EXCEPTION
In accordance with IC 36-7-4-921, New Cingular Wireless PCS, LLC ("Petitioner") the Lessee
of the real estate located in Hamilton County, City of Carmel, Indiana, which is described in Exhibit A
attached hereto and incorporated by reference ("Real Estate"), makes the following commitments
concerning the use and development of the Real Estate in connection with its petitions for
Development Standards Variance and Special Exception:
STATEMENT OF COMMITMENTS
1. The tower will be designed and erected in such a manner as to reasonably accommodate
equipment of up to 4 wireless communication service providers.
2. Petitioner and its successors and assigns will offer the tower to any wireless communication
service provider that seeks to collocate equipment on the tower at commercially reasonable
lease or license terms so as to accomplish the purpose of minimizing the number of such towers
that must be erected in the Carmel-Clay community, and Petitioner will agree to submit any
disputes regarding the commercial reasonableness of such terms to binding arbitration.
3. Petitioner will notify the director of the Department of Community Services within 30 days
after any oral or written communication from a wireless communication service provider
inquiring about collocation on the tower and providing the director with the name and address
of the provider making the inquiry.
4. Petitioner shall construct and maintain a wood privacy fence around its leased area and 15'
landscaped and maintained area as depicted on the landscape site plan prepared by First Group
Engineering and dated April 25, 2006.
MISCELLANEOUS
1. These commitments shall be binding on the Petitioner, successors and assigns, and other
persons acquiring an interest in the real estate.
2. These commitments shall be effective upon the adopting of Petitioner's Special Exception and
granting of Developmental Standards Variance under Docket No. 06040014 SE and Docket
No. 06040015 V, respectively, and shall continue in effect so long as (i) the Real Estate is used
for wireless telecommunications purposes; or (ii) until these commitments are vacated by the
Carmel-Clay Board of Zoning Appeals at a public hearing after proper notice has been given.
3. These commitments may be enforced by the City of Carmel, Indiana or the Carmel-Clay Board
of Zoning Appeals or its duly authorized agent.
The undersigned hereby authorizes City of Carmel or its designee to record this commitment in the
Office of the Recorder of Hamilton County, Indiana, upon final approval of Docket No. 06040014 SE
and Docket No. 06040015 V.

Dear Board Members:
I am the principal radio frequency engineer responsible for necessary build-out of wireless
communication sites in Clay Township, Carmel, Indiana consistent with customer demand and
system engineering requirements. I have enclosed a copy of my resume, which outlines my
credentials and experience. I am writing this report to make certain representations in
accordance with the Carmel Zoning Ordinance, Section 25.13.01.07 and other related matters.
I. I have enclosed radio frequency coverage maps which reflect the before and after
coverage with the proposed site at Brookshire Golf Course, as well as coverage maps for the
entire Clay Township area. Those maps were prepared by me or under my direct supervision
and accurately reflect coverage in the Clay Township area.
2. Referring to the engineer drawings presented by First Group Engineering, Inc., the
proposed 135' monopole structure can have additional collocators (not Cingular) so long as they
are separated from each other at a distance of at least 10' vertically. This, however, does not
account for the possibility that a collocator might not be interested in collocating if its mounting
position on the proposed pole is too low.
3. Pursuant to the license that Cingular Wireless holds with the Federal Communications
Commission ("FCC"), the tower and the antenna will be operated in compliance with all
applicable federal commercial mobile radio telecommunications service requirements as well as
applicable Federal Aviation Administration ("FAA") regulations concerning lighting and/or
marking oft4~~~~VH~Jure. The proposed structure, however, bec,ause of its he~ght will not require
lighting and/or':spedhl markings under FAA regulations. The site is further ,not subject to

regulation of the Indiana Tall Strucfures Act as it does not meet the minimum height of200'
above ground level.
4. Prior to the filing of the petitions by Cingular Wireless in this case, a thorough search
was done within the vicinity of the proposed site for collocation opportunities, and there are no
collocation opportunities in this area for the requirements of this site.
Hopefully this answers the requirements that are required under Section 25.13.02(3) of the
Carmel Zoning Ordinance and related matters.
